The constitution says that the speaker has to declare seats vacant in a case of defection but Ameahule did not declared any seat vacant at the time of the alleged defection. Therefore the responsibility lies on the judiciary. More over A court affidavit is not the is not the the party procedure of defection. Therefore Ameahule remains speaker!!
