I am somebody who works at the state level, policy is an interpretation of legislation. The judge is correct on that matter. However, in order to implement the laws that were previously passed, you would need to have some guidance, we don't just magically come up with the interpretation. It goes through lawyers. The idea that a judge would just come down and suddenly interpret how all laws are to be implemented right out of the gate without a case, is a bit insane. Furthermore, interpretation does change depending on the administration that is in power. Policy is constantly changing because of this. I'm sure rulings could also have an impact, but at the end of the day again we need to interpret new laws that coming to being, and this is done without a case before a judge.
