No getting around it, my previous video about public domain superheroes had sound issues, and could have better edited visually. So finally I have the remake where hopefully the improvements make it more worth your while.

I hadn't realized there were so many previous Thor's in comic form. I had seen one or two, but some of these were new to me. Good research.

Erik Larsen has a character called Super Patriot and last I heard the NFL hasn't sued him. So yeah Pat Patriot is fine.

Really love War Eagle's backstory. The costume and name are a bit silly, which must be why he doesnt get picked up by this kind of lists, but that could certainly be played around with in the story. Would be cool if you did more sequels to this, though. That video was also how I found your channel, I think.

Thanks for the watching. I’ll take your suggestion into consideration. And one cool thing that has happened by Dynamite and the like is that they have updated PD characters to the times and awesome fashion.

You can also use mythology as your heroes like thor or hercules they are in public domain

Perseus was the great-grandfather of Hercules so he could potentially be used as a superhero character.

Hugo Hercules had super strength in comic stripe in 1902, he also lifted steamed powered engine car off the track to be repaired and pull rest of train at train speed full of passengers. Popeye in 1929 also had super strength, speed and tough. Lothar in Mandrake the magician stories which started in 1934 had great strength, speed and was invulnerable fire, lightning, magic bolt and weapons of man. All those plus many characters from mythology had those powers before Action comics #1 had Superman in 1938 which wasn't even first use of term Superman as a Play was named Man and superman in 1903 and term was used other times also before Action comics ever used it. So how they got copyright on already existing word I don't know.

It’s always been a slippery slope. If DC were as litigious now as they were during the 40’s, they’d have literally hundreds of Supes clones to sue over. The coincidences between Batman and “The Bat Strikes” are very suspicious. Nowadays, it’s the idea of using common Lu implemented superpowers, hoping that a different background and personality will make a new character attractive enough. But you’re right about all the strong men of the platinum and golden ages. That was a super popular trope then them. And I would pay a high price to make sense of how DC’s Superman with his name caught on. Thanks for your insight.

I’m no lawyer that can give you the best answer. I know Disney has had successful lawsuits against other production companies that have used characters that fit the bill - Snow White, Cinderella, etc., and while Sherlock Holmes qualifies, Sir Arthur Conan Doyle’s descendants are fighting hard to keep receiving royalties for that property. You may want to to do extra due diligence that no one even claims entitlement to the property, otherwise consult an intellectual property lawyer.

@@kcthesledgestoryteller Can use Snow White and Cinderella just don't copy Disney Corporations or other versions of it that are copywritten. Stories came from Grimm Fairy tales published in 1818 I think it was based on earlier stories. Can use Thor from mythology but don't copy Marvel comics version, nor their movie version.

@hydrolito Cinderella and Snow White both back centuries, yes, and in many iterations. But there have been cases where Disney used their expensive lawyers to go after those who have made their own productions of them. Unclear how many cases they won. I’d just do your homework on both what arguments they pushed, and what other unique takes have been done on the pre-1929, since we’ve about to cross into there year when everything 1928 - back will be public domain.

MLJ became Archie Comics don't copy their version of Thor. If they kept any copywrite on it don't know but why take a chance? DC comics also had a version of Thor in story Jimmy the red, Thor's Pal a Jimmy Olsen story. Don't copy that either.
