You may believe that, but guilty or not everyone deserves representation and if you can't understand why, then YOU are the one who should never be able to get representation when you need it. When a lawyer takes a case, they are bound by law to provide the best representation possible. Again, if you don't understand why, you're a F'n fool.
They can be represented outside of the house, which is where MR Florez belongs. If the new owner cant' live there, neither should Mr. Florez be allowed to live there. He wasn't living there for 30 days after the house was sold so you can't even invoke the 30 day rule. This is not what the law was written for and you and everyone else knows it.

I got two squatters and two different apartments in my three family I've taken these two and four other during the pandemic cuz they had no place to live. Three of them became hoarder with over 150 bags of food given from the school rotting away in a cube refrigerator. left on the rug with soda bottles; spilled on the rug. a cat litter box that smell here to high heaven.. they left eventually. I got two squatters one of them had me attacked by homophobic pizza store owner.. just 2 years ago. and the police refused to make a report so I can claim some victims compensation to help pay for my medical bills,meds physical and psychological therapy. It's caused me a lot of depression cuz I can't hardly walk anymore they just 73 I was still very athletic. but now with the torn meniscus in my left causing me scoliosis and lack of balance... so this is thanks again for helping homeless people you never know they were homeless cuz they're more well-dressed than I am.. I'm the one limping what does permanent injury and I see people crossing the street avoid passing me by because they think I'm homeless I presume when I'm walking with my cane now.. so that's the American Justice we have with squatters destroying new owners like me. I've been out to get homeless and tenant activist since 1977.. I've lost over $200,000 with these two squatters in 2 qpts. I got to pay all the bills electricity gas water heaters mogage repairs plenty of them cause by squatters so that's what you get for helping orher. they get free representation and I got to pay for psychiatrist and medical bills American Justice is a joke.. Our fathers fought qnd died to destructive thieves the police and cheap politicians and 20 senior citizen; agency s. Wouldn't help me get Justice or even a police report.. he has right to the property. he was included in the purchase price of the property; why do you think the bank reduced the rate of the property? they sold it with him included.

they purchased the property with him included. That is the reason for the reduced rate on the property. The seller (bank I assume) didn't want to go thru the hassle of evicting the guy, so they adjusted the rate to place the liability on the owners.
This is ridiculous. The employer is DEAD. This squatter does not now and did not EVER own the property. He cannot keep on working for someone who is DEAD. The house has been sold. This squatter was not on his employer's list of beneficiaries. OUT.

he does not need to own the property. He was living there so he is afforded squatter rights. The onus is on the owners to legally evict him which is a process.

Did the buyers not see the interior of the house before they purchased it? How is it that they were not aware that an individual was residing there? Perhaps there was a price reduction due to the thorny issue of ridding the premises of the persistent squatter.
As much as the squatter is in the wrong, no one has addressed the real cause of this issue. Bret Flores (Fisher)'s client's family sold that property to the Landa's knowing there was an existing squatter issue that could take a long time to resolve through tenant/landlord court. The Landa's should have every right to make the squatter and the prior owner's responsible for their legal expenses.
The bottom line is it does not matter what revelation he has. If something was worked out between the last owner and him then he should have had a legal document stating something like a will or a lease.
If there was a will stating he should get the house, then it wouldn’t have gone on the market to be sold. Sue the squatter, the realtor, and everyone involved in letting this happen.
The owners are complete idiots for not signing leases immediately to renters of their choosing and having them immediately move in. The squatter will NOT have superior rights to the legal tenants and have to abide by exactly the same rules that can only be resolved in court- and have to live with those owner chosen tenants which can and should make the squatter’s life miserable.

This is going on on my block. Squatters broke into a home that was bought via foreclosure and the new owner is trying to get them out. All kinds of illegal activity is going on. This is in Queens as well.😡
What a selfish, violent scumbag he is...His actions with his wife say everything...He definitely does not deserve to live there...Unbelievable how the courts, or whatever, keep these squatters rights laws...What's up with that...?...They bought it, it should be a "Cut and dry" case...If those people ever get to move in, they should sue him for damages to the house, wait time, etc....i don't know about these defense lawyers who support criminals, just for money....
before you close on a house you do a final walk through, the house should be 100% empty before you sign the documents, no sign of someone living there....empty. Right after closing you change the locks...
Thank God I live in Maryland. Squatters have to occupy the living space for 20yrs before their rights to the property kicks in. In New York after only 30 days they have rights to the property. This is a lesson for everyone to educate themselves on squatter rights/laws prior opening your home to family, friends, caregivers, air bnb/rentals, etc. for extended stays.
If he was earning $3k per week, he should have more than enough to live somewhere else...Much more to this story than meets the eye....Who spends $2m on a house w/o a walk throug, and home inspection, the REA that listed the property, did so w/o a walk through.....all these ppl walked through the house w,lo detecting someone had set up shop there???
OK HERE'S THE BIG QUESTIONS. Was the property EMPTY when the buyers went to view it ANNNNND before they closed on the property did they do a day before/day off walk thru? If that property was empty DIRT BUM squatter moved in after and he needs to go. The courts are trash, this need to be separate from landlord tenant court.. WHY would anyone allow a stranger to live in a any property for free especially a 2 million dollar.. UGHHH

Thank you again for reporting on this issue weeks before you did the '7 On Your side" bit for Adele also in queens who got arrested. And thank you for cracking this whole squatter issue wide open.. At the beginning of the pandemic l helped and took in 5 nicely dressed clean who were homeless thought that'd be thankful but they became back stabbers. 3 the moved out because they became hoarders and caused roach infestation. No I got two left. 0ne undocumented who I saved from ice picking him up. He says if I get him out he's going to fall down the stairs and sue me. The other squatter occupying a second in my three family in Brooklyn. Ray a deadbeat father just like Roberto has also threatened me by saying he'll have some friends at the pizza store change my mind if I ask him again to leave and go to the hotels in Manhattan where mayor de Basio had offered the homwless in 2020. So in 2021 one of his friends attacked me at The Pizza store destroying my knee and meniscus making me cry for the rest of my life. What's worse is the police at 68 precinct refused to make a report why people ask me. Well the store owner is good friends with police. They let him get away with anything . So this American Justice where are fathers fought and died only to keep the the corrupt status quo in America.
Taking advantage of a SENIOR and hoped he would have inherited the property after the man’s death. This is not the only case, there were many before and many more will come after. I hope this is resolved in favor of the new owners soon.
Currently going through a similar situation not too far from where this couple lives. The court system is a joke. We can't get rid of people like this because they know the system better than us landlords. Our lawyer said that people who voted for DeBlasio are to blame because he started this mess. I never voted for a Democrat in my life but it's people like me and these folks who pay the price of voters that do.

it's simple. The bank sold the property with the tenant included. This is why they will eventually have to buy him out. he is a "hold over" tenant. They should not have agreed to the reduced rate with the stipulation written in the contract they'd be purchasing the property with him on it. The only remedy is to legally evict him.
Ok so they bought the house and it was up to the bank what it was sold for it sounds like he's a loser who thinks he is owed. I think that they stop paying the utilities and I think he's had plenty of time to get his shit together. We lost our first house we moved out before the bank told us to because it was our fault we learned a lesson from it but this guy acts like someone owes him something and they don't. The old owner died and maybe that needs to be looked into also from the sound of it
This problem is easy to solve. The owners can legally sign a 1 month lease with a male that they know and trust who can legally move in with Brett Flores and make his life a living hell. It's been done before over and over.
Squatters need to be kicked out immediately higher strong man and get the guy out of the house. This is ridiculous. Squatters have more rights than any homeowner. It’s unbelievable.
The owner should have done her homework before spending two million dollars for a home she can't occupy.! I would have the electricity and heat turned off and let the squatter pay the bill and see how long he last there!
Honestly the owners are only wasting there time, energy and money going to court. Just meet with the squatter, and ask him his price for vacanting the property. That is way cheaper and quicker in the long run. Yes they will spend more money but at least they can have there home. Also by doing this the squatter won't feel less tempted to damage there property.
Your comment about property damage made me think of our own experience. Years ago when we were house hunting in Toronto, we looked at a foreclosure. Bank got rid of the tenants & the place was empty but the previous people that lived there dumped cement down every drain in the house. I don't think they were squatters--just disgruntled tenants or previous homeowners that were pissed off. Fortunately, we found another house that we are still in. I often wonder what happened with that sale because we would never buy that !

Crazy law. They need to eliminate it. What purpose does it serve? Only for crazy people when you’re the one who paid your money/ secured a loan. Contracts/ title/ records filed at Department of Buildings are facts! If you don’t have it you don’t belong there. 😮
