I don't think Agent 4 is a war criminal for the same reason as the enemy octolings--everything we've seen them do was under Marie's orders. I guess you could also make an argument for Marie being a super war criminal for recruiting a child soldier and directing them to attack the Octarians.

I think new agent three should be well below deep cut in the criminal tier. She didn't break into alterna, but simply fell in as a result of DJ Octavio's negligence. In our world throwing little buddy into Octavio's vaccum would certainly be animal cruelty, but considering he's a salmonid most inklings probably wouldn't care. Shiver, Frye, and Big man all regularly steal and sell various items from the crater area, on top of all the alterna shenanigans. Oh, and if grizzco weapons are illegal, than weaponized mecha sharks certainly are too.
