Always keep your cannabis in a hemp container. When they ask about the smell of suspected marijuana just say that by smell alone they can't determine if it's legal hemp or illegal marijuana. This complicates their probable cause to search even if a canine is used because legal hemp contains a low amount of delta 9 thc. Meaning that even if they use an onsite test it will be positive for the presence of THC. However, lab testing would be required to confirm that the THC amount is above the limit to be classified as legal cannabis(Hemp/CBD flower). Never admit to ever using or possessing illegal marijuana. Technically, the cop would have to let you go, but he may try to get a search warrant or use a canine as probable cause anyway. If he doesn't let you go and finds cannabis in a legal hemp labeled container then he would still have to get what he suspects is illegal cannabis lab tested to confirm the level of delta-9 THC. He will still have to let you go until further testing is done. Once the lab results confirm it contains more than the legal amount of delta-9 THC they could put a warrant out for your arrest. Although, a good lawyer can file a motion for dismissal based on an invalid probable cause. The smell of cannabis and canine hit isnt sufficient enough to differentiate between low(legal) and high(illegal) delta 9 thc. Only the presence of THC can be suspected which isn't illegal unless verified to be above the legal threshold. This is the main reason why law enforcement were rallying against the legalization of Hemp. It looks and smells similar to "marijuana" and is essentially the same plant but is differentiated only by levels of specifically delta-9 THC. For decades they were able to use it for probable cause to search even if they didn't really smell it. A lawyer relayed this information to me before the legalization of Hemp and I have used this 2 times. To avoid the headache of this even happening, use cruise control to always maintain a legal speed and don't smoke in your vehicle.However, some cops are crooked and will still use it as an excuse to search your vehicle to fish for unrelated crimes or violations.

I'm in Oklahoma. I would never thought that we would be legal here and illegal in other places to where they actually want to press charges on you. I got pulled over and they said they smell weed and ask me do I smoke I told them "when I can.. but I haven't smoked recently"... they searched my car and found a half of a blunt I told them "my bad if I would have known that was there I would have smoked it already"... when I was in Austin Texas and I got a DUI the officer took the joint out of my wallet and place it in my console so that when I got my truck out of impound my weed was still there they don't even prosecute anything under a quarter pound and anything less than a gram of heroin or cocaine it's just a misdemeanor. But what's crazy is that having the oil based THC like a vape pen is a felony
