Sir if after reference lower court judge da mind us reference opposite decision lyi howe then reference wala decion order krn lyi lower court judge bound a ya apne according hi order suna skda?
Sir suppose cjm nae kisi ko 7 yr ki imprisonment ki. DJ mai uski appeal hogi aur DJ nae upheld krdi imprisonment toh kya phr HC mai appeal hogi ya revision? Thanks 🙏
Sir jse plaintiff hai usne defendant se ek property purchase ki or usne half amount dedi or usse baad m pta chlta hai ki defendant ne apni property pe loan liya hua hai or vo baad m plaintiff ko baat btata hai . plaintiff usse amount vapas krne k liye bolti hai but defendant usse amount nhi deta or plaintiff case file krdeta hai .sir ese situation pe koi high court ya supreme court ki koi judgement hai ?

सर जी,अगर कोई लड़की लड़के का Rape कर दे या करने के लिये मजबूर करे तो लड़की के लिये कौन सी सजा है भारतीय कानून मे? अगर लड़की झूठी पायी जाती है या बलात्कार करती है तो उसे कोई सजा मिलेगी या सिर्फ ये कहकर कोर्ट छोड़ देती है की जाने दो ,लड़की से गलती हो गई? क्या हमारे देश मे Gender equality है,अगर है तो male - female दोनो के लिये समान कानून क्यों नही? धन्यवाद
Female can't commit rape. But if she make a complaint of rape and thereafter police came to the conclusion that she made the false statement, then can be liable for the offence of make making statement or giving false evidence
As mentioned in subsection (1)... if magistrate is satisfied that any provisions in act , ordinance or regulations is invalid or inoperative.. it shall refer the case to highcourt for decision. Subsection (2) is like a exeption to this rule... According to that cos or mm may refer any question of law arising in the hearing of case. Hopefully I am right ... Otherwise appologise
