RESTRICTIONS IN BUYING A FARM OR AGRICULTURAL LOT UNDER PHILIPPINE LAWS | CLOA & DAR CLEARANCE

Are you thinking of buying a farm or agricultural land? Watch this video first!
Many think that real estate transactions involving farm or agricultural lands are just the same as any other real property dealing. This notion most often leads to problems, especially when the purchase transaction is already completed, and the realization does not come until the buyer attempts to have the title transferred in his/her name.
This is because the Register of Deeds requires, on top of the other requirements, the Transfer Clearance from the Department of Agrarian Reform or the DAR Clearance. The DAR, in turn, requires proof that the vendor’s and the vendee’s aggregate landholdings do not exceed five (5) hectares. This is in view of the limitation imposed by the Comprehensive Agrarian Reform Law (CARL or RA 6657) on ownership of agricultural lands - that is, no one should own more than five (5) hectares. This prohibition continues under RA 9700 or the Comprehensive Agrarian Reform Law Extension with Reforms (CARPER).
DAR Administrative Order No. 04, Series of 2021, which was issued on May 17, 2021, has streamlined the process and the requirements in requesting for Land Transfer Clearance (DAR Clearance).
Note that the government may acquire agricultural land, through expropriation or by purchase, even beyond the 5-hectare limit. Government entities are also exempt from the requirement of DAR Clearance.
In the case of Agrarian Reform Cooperatives, the retention area or land ownership limit is computed as number of members multiplied by five (5) hectares.

This CARP screwed up our Agricultural system. People who are into commercial farming business and wants to scale up their business cannot do so because of this limitations. That CARP turns into CRAP.

Sir ask kolang po ano po ang dapat naming gawin dahil yong 8.5 hectar naming lupa ay gustong bawasan po ng DAR dahil dapt daw po bawat taga pagmana ay 5 hectar lang pano po yong 8.5 po iyon pro nasa lolo kopa ang name at ang mag hahati non 7 na magkakapatid na mga tiya at tiyo namin at pag dating saming mga anak hahatiin namin ang higit nalang sa 1 hectar pano po naging subra iyon sinabe na namin na hindi po aatbot yan ng 5 hectar pag na subdivide na didaw pwdi...at pinapapirma kami na pumapayag daw kami na ipag bilibsa landbank at sila papo ang namimili ng area yong pinipili nila yong mga productive like nyogan at taniman ang matitira wlang nyong at dpwdi maging taniman at bakt po iilan lang kami sa dami ng may lupa dito na lalawak samin 4 lang kami ang babawasan..sana po ma help po ninyo ako

Feb 1, 2022 6pm. Magandang hapon po Atty. . Base po sa inyong karanasan , ano po ba sa palagay nyo ang pangunahing dahilan for already 5 yrs now ay kung bakit hindi po ako mabigyan ng account ng Land Bank Officel para mabayaran ko ang CLOA or EP Property namin para makakuha po kami ng Cancellation of Mortgage and Certification of Full-Payment. May apat na properties po kami under CLOA /EP. Yung 3 properties ay may account na po at nabayaran na po namin. Samantalang ang unang nabanggit kong CLOA property ay di namin magawa bayaran dahil wala pa nga po account na binibigay ang Land Bank. Napagkasunduan na po namin na ibenta ang properties dahil lampas na po ito sa restriction period of 10 years since we acquired the property. Yung tatlo CloA lots ay matagal na po namin nakuha ang account ng lote sa Land bank pero nagtataka po kami kung bakit tumagal ng 5 yrs ang isang CLOA lot namin na iyon pa naman ang nais naming ibenta. Sana masagot ninyo po kami. Maraming salamat po Atty sa paglilinaw at pagtugon.

Hello po Atty., binanggit nyo po ang DAR Admin Order No. 6 series of 2016 pero di ba po this was suspended under DAR Admin Order No. 1 series of 2017? Does this mean po na yung mga properties na pinapamana ay hindi na exempted sa pagkuha ng DAR clearance? Thanks po

Sir ano po ang mag-a-apply sa required na transfer clearance sa transfer of awarded lands (CLOA/EP). yang po bang LTC under DAR Administrative Order No. 04, Series of 2021 or yun pong DAR Administrative Order No. 06, Series of 2016? nakakalito po kasi yung section 1.2 (Exclusion) ng 4-2021 na nagsasabi na hindi daw ito applicable sa any form of transfer pf awarded land covered by CLOA/EP po.

Good day atty. Ask ko lang Po, what if Ang property is resi-farm that consists of 10has and it has min. of 100sqm lot cut what does it mean? Since ang rules Po is 750sqm min. Cut based on property law and pwede Po ba siya tayuan Ng Bahay? And ask ko na Rin kelan po standard ng processing of title before turn over. San ko po kayu pwede I reach for my every concern Po. Good evening atty. Good Afternoon, Atty. meron sana akong ipapaconsult. May binenta sa akin na agricultural land (2,004sq.m.) at meron na kaming Deed of Sale. Yung nagbenta ay yung mismong nanay at ito ay mana nya na ipinamana naman nya sa anak nya through Deed of Donation bago ibinenta at pumirma mismo sa Deed of Sale ang anak. Kaya lang ayaw ibigay ng may-ari ang titulo at kopya ng resibo ng tax na binayaran. Ang gusto singilin kami sa tax pero hindi naman kami binibigyan ng kopya. Ito pa ang malupet after 2 years ng maayos at macultivate at mapatayuan na ng bahay na namin yung lupa ang gustong mangyari ay ibabalik na lang daw ang pera namin at kukuhain na ulit ang property.

May tanong po qko, meron po kami lupa, aprobado na po ang plano ng regional office ng DENR ang lupa. Nag apply po kami ng tax declaration sa munisipyo, pero ayaw po kami pahintulutan, inihain po ang ang request sa sangguniang bayan ng munisipyo, Naclassify po ng DENR na dried creek at accreeted land po ang lupa namin nabigyan din po kami ng certification of alieanble and disposable. Nagbigay din po ng certification ang DPWH upang certify na wala na silang future plan sa lote namin, hiningan po kami ng certification kasi po hinarangan ng DPWH ng concrete riprap ang dried creek. Matagal na po kami nakatira at in possesion po ng lupa since 2009. Ano po kaya ang magandng aksyon namin para magrant ang request namin na maissuehan ng tax declqration.

Sir ask kolang po ano po ang step naming gagawin dahil gusto to pong bawasan ng DAR ang 8.5hectar na lupa ng lolo ko at pag hahatian pa ng 7 na tiya at tiyo ko...hindi rin po lahat ng park pwdi pag taniman ng palay....yong pinipili nila na gusto nilang kunin yong palayan...at bkt po iilan lang kami ang babawasan hndi nalang nila nilahat para dnaman pangit sa pkiramdam dahil po madaming agriculturla land dito at higit na mallaki kay sasamin..ano po dapar naming gawin para ma i contest...pwdi poba ipa subdivide nalang namin par d matuloy ang pag babawas..o makkuha parin ba ng DAR kahit na d cla tito at tita mag pirma tnx

Pano bumili ng farmland more than 5 hectares for livestock like cows, pigs, chickens, goats? tapos part of it will be fruit bearing trees, citrus trees and food for the cows? Will need a bigger farmland especially for the cows. Parang yung Farm ni Bea Alonzo which I think is more 16 hectares or more. thank you in advance Atty.

Ang balita dyan, hindi buong 16 hectares ang nasa pangalan ni Bea. Portions of the land are co-owned by her family.

Agricultural land ang may 5-hectare limit. Hindi naman kasama sa CARP Law ang residential, commercial or industrial land 🤣

Ang hirap maunawaan kaya hindi ako magtataka kung bakit mayroong middle man, under the table na nangyayari. Kailangan din talgang mayroong abogadong gagabay kaya lang parang doktor din kung maningil ng professional fee, maliban na lang kung mayroong edukasyon ang makakabili ng lupa at kayang pagtiyagaang mairehistro ang nabiling lupa.

Ang tanong ko po attorney, applicable ba ito kahit maliit lng na sukat na agricultural land? Halimbawa 900 square meters lng.

As long as agricultural land po, applicable pa rin po. Meaning, required pa rin ang DAR Clearance. Titingnan po kasi ng DAR kung lumagpas na sa 5 hectares na limit yung agricultural land na pagmamay-ari po ninyo.

@@hannahrodero-ortega4025 If there is “padulas”, there must be corruption, and that constitutes a crime. Only that it is not prosecuted for one reason or another. For one, evidence is an indispensable requirement. Commission of a crime is one thing; it’s prosecution is another thing.
