Tanong po Atty., in the case where there is a thief that breaks into my house, is this considered an attack and am I legally allowed to defend myself using a firearm to stop the threat? In this second scenario, if someone breaks into my home and they are holding a weapon. Am I legally allowed to defend myself using a firearm to stop the threat? Third scenario: Multiple people break into my house without weapons and are refusing to leave even after confrtonted. Am I allowed legally to defend myself using a firearm to stop the threats to me and my family?

For the Battered Woman's Syndrome, I think you NEED to have two cycles of violence before the defense can become available. So I think kailangan na may tender loving phase after the second battering episode.
This is a very good point of discussion. Nagtanong ako kay atty dalam about this last year who is also a fellow criminal law professor. Ito ang message niya: "Dili dol.. Cycle of violence is a mere indicia of existence of battery (nakalimot ko sa jurispridence).. Pwede wa pa kahuman two cycles of violence, basta at least naay kaduha mga battering incident.. Tama man pud kay kung tan awon nimu ang cycle of violence, sa tunga (ikaduhang phase) nga part ang acute battering.. Sa ato pa, bisan dili mahuman ang two (2) cycles, basta niagi kaduha nga battering incident, pwede na muapply ang BWS as just circ under Section 3c in relation to Sections 26 and 27 of RA 9262..sorry now ra kareply paps, nabusy ug taman.."
@@egosumpulcher1 Yeah that seems to be the more logical interpretation. Differing interpretations kasi sa mga authors. Probably a result of the vagueness sa Genosa case. The SC's term "battering episodes" could mean the cycle of violence or just the acute battering incident. Interesting how a few word choices can create a great deal of nuance sa law. Thanks Atty!

Dun po sa Mistaken of Fact, pag po ba nag file ka ng charges against a person na feeling mo minanyak ka kasi iba yung dating sayo ng pagsagi ng kamay niya sa part ng katawan mo kahit di naman sadya pero you honestly thought na na-violate ka kahit di ka sure kung minanyak ka ba talaga or di naman sinadya, pwede po ba maging excuse yung mistake of fact sa pag file mo ng maling criminal case against sa tao na yun?
Wala namang magfifile sau.. kc kung ganyan ang ifofollow natin eh di dapat lahat ng acquitted cases mafifile.an nanaman ngaun ng mga kaso ung nagcomplain sa kanila so wala ng katapusan na cycle.. hehe
