He is wrong to dismiss Madison's inconsistency as a "so whats the problem?". The problem is that it reflects the degree that the supposed "Father of the Constitution" (a claim he rejected for himself) had confidence in the ability to deal with situation. If as this speaker says Madison was dealing with new situations as they came then why have a constitution? The inconsistencies were more profound and contradictory in scope. He went from his Virginia Plan that practically called for a national veto on state laws, and a two house legislature with no equal representation in either chambers. In a private letter he wrote that he wanted the relationship between the states and the national government to be like that between counties and their states. In other words to do away with states as distinct political sovereigns. From that he goes to his Virginia Resolutions which despite his protestations clearly was a nullificationist document and his Report of 1800 which reaffirmed it. This isnt a thing to dismiss with a "so whats the problem?"
