Why is fubara and oko jumbo afraid of approaching the federal high court but rather go to the state high court, court of appeal and supreme Court? The answer is simple: 1. There was a matter before justice omotosho of the federal high court Abuja which involves the governor, self acclaimed speaker ehie and co including oko jumbo, the 27 lawmakers, chief judge of Rivers State, inec and PDP. Before the judgement was issued the governor and the then speaker withdrew all there applications and never defended the matters and judgement was given recognising the 27 lawmakers. Now the court of appeal iis saying that the state high court has no jurisdiction to entertain the matter of defection but only the federal high court and advices fubara and oko jumbo to approach the federal high court. Now the problem become how are they going to do that knowing fully well that judgement has been given already on the matter in which they did not defect. Secondly if they go for an appeal, u can not appeal a judgement the u did not defend but u withdrew all ur application. Thirdly if they go to the supreme Court it will throw out there application because they will ask them are they appealing against the federal high court judgement or the court of appeal knowing that the appeal court have told to go back to the federal high court. So fubara and oko junmo are now In a fix hence they keep running to the Rivers State high court for quick injunction to delay the lawmakers from impeaching him. His days in office are numbered
I believe that if a senior advocate gives counsels to a client that the supreme court dismisses as nonsense, that senior advocate should lose that title
But before these outline, what was the governor's offense. Those 25 law makers are drowning men, just making excuses. They are just making excusing to support their illegal actions.
Ex legislatures? How? Is there any court of competent jurisdiction that have declared there seats vacant? Pls educate me. U can't just seat in the studio and say things contrary to the court judgement. Let fubara and oko jumbo show us one judgement they have secured that validated the vacancy of the seats of the lawmakers. Let oko jumbo show us one judgement that recognises him as speaker. They say they have gone to supreme Court yet the there is no record of transmission from the supreme Court to the 27 lawmakers as of today. What is still stoping them from going to the court. Constitution stated it clearly upon defection to another political party without any division at the federal level, you automatically lose your seat.... The then speaker red their defection during their seating.... Why is it hard for you to chose truth over evil and lies
It’s Automatic, section 109 made it very clear that when you leave a political party that sponsors you to another political party without any division in the party that sponsors you, you automatically lose your seat.
You don't seem to understand how the Constitution works. Their defection from the PDP to the APC sealed their fate as ex-legislators. It wasn't the Rivers state High Court that declared their seats vacant, that Court only (erroneously) barred them from parading themselves as legislators. The Appeal Court judgment means they can parade themselves as legislators but it doesn't mean they legally are. It's up to the ex-legislators to get the Federal High Court to rule that they're still legislators. The matter, incidentally is before the Federal High Court.
My guy, what happened to the judgement of Justice omotosho from the Federal high court Abuja? It recognised the 27 lawmakers and prohibits the governor from presenting, making request and dealing with any legislators other than the one led by martins amawhule. That judgement is still subsisting.
@@nyenkeikechi3049 is not true... The judgment simply stated that state high court lacks jurisdiction to hear the matter, the main issue is defection... They are yet to interpret it
