Ok well it looks like the easement agreement was only for 2 properties. It is a private road, if you want to use it talk to the owner and get rights. Normally those agreements aren't very expensive but will have usage conditions. Private property with a public easement is every plot of land but that doesn't mean you can drive on the utilities easement in your neighbor's lot. Now that it's gone to the news it is going to be a big fight. If the city allowed new property to be built where there was no public road I think the city should have to buy the road from the landowner and take over care. This is also why you don't buy land that requires an easement for access.
This is a simple case. Who owns the land? Is there a legal easement? Once property becomes public use the government will take it away and make it theirs.
Not really. Once it cuts off access to anything, there is legal precedence that can remove the ownership of it. If there is truly someone who can't access their house without this road, and it has been in use for a reasonable amount of time for such access, it's going to rip away ownership.
Well to me it seem absurbed homes were able to be built and yet the homeowners can not use the road to get home even if it is consider public property. They city should just take the over since it is on public land if homeowners cannot reach a agreement where people cannot have access to the land. At the same time one person should not be responsible for the cost of the road.
It's not public property. There is an easement on the PRIVATE property. However the legal agreement for the "road" (actually drive) was for only two homes. And those two homes had the legal right to USE the drive and the legal RESPONSIBILITY to maintain it. No one else.
I worked for Claire for over 2 years maintaining that property and all his others throughout maple plain. He’s a great & honest guy, I’m guessing he’s in the right & this new guy is trying some bullshit.
