Why not? 1 screen 2 movies bud. Judge was sustaining objections before defence could even ask their questions. Costello reacted like any reasonable lawyer would have, with awe. Judge got embarrassed because he knew the objections didn’t hold water, and Costello’s reactions (as well as the AUDIENCE in the court room) confirmed it.

The reason they may not call him is because of what else could come out during discovery and/or cross examination. He may have more info the defense doesn't want Infront of the Jury. It's a risk assessment, because this jury likely tainted regardless.

This guy went before the Grand Jury with evidence that Trump was innocent and the Prosecutors refused to let the grand jury hear it. The Defense knew about him as well. The only reason he is so front and center right now is because Cohen is testifying and this guy testified in front of Congress this past week.
