The plaintiff gave the defendant a deposit for an apartment. Unfortunately, the plaintiff says he was told two months later the apartment was no longer available. The defendant won’t return his security deposit, so the plaintiff is suing. The defendant claims the plaintiff dragged his feet trying to come up with the deposit money, and then he backed out all of a sudden.

Sometimes it's just best to cut your loses. The defendant was willing to cut the $350 she was out of until the plaintiff insisted upon a lawsuit. Plaintiff not only loses but now has to pay an extra $350. Dude should have let well enough be.

Well then if he's working 70-80hrs a week ladies, then he shouldn't have a problem coming up with the rest of the security deposit 🤔 my opinion is she definitely dodged a bullet. I feel like she would have been having issues with getting her rent on time.🤷🏾‍♀️

That's the kind of landlord I am but I've been burned by 3 tenants and so I've learned that you can't be kind to people. Generally speaking if you're too kind you always get taken for a sucker.

Anybody who has to "work out" how they're going to pay the deposit is very likely going to have to "work out" how to meet the rent every month.

When the plaintiff couldn't come up with the total security initially, she should have foreseen that he would be a problem.She tried working with him, but he dropped the ball. So many people have no clue as to what a security deposit entails.

She said he was working 60-70 hrs a week so it really surprised me that he would have trouble paying the $600 over the course of a couple months but that could indicate that he might also have trouble paying the $950 in rent at some point as well

That request to make the deposit in installments would have been denied. He can't pay the deposit, then he most likely couldn't pay the rent.

If the Plaintiff listened instead of constantly rifling through his papers he would have understood why he lost(he kept repeating that he didn't understand after the verdict was rendered). If he had told her weeks earlier he couldn't come up with the money, she may have had time to rent out the unit. But, he ignored her until 2 days before the end of the month. His own procrastination in dealing with the situation made things worse for him and the Defendant was rightly awarded the 350 she was asking for.

It's because the way they try to go is an open wall with the cameras leading into the studio. I suspect it's the way they come in and the other way is just used as an exit to make it faster transition between cases.

It sounds like this landlady is actually really nice and it sounds like she dodged a bullet with this one. If he was struggling just to get the deposit and the first months rent, he would've paid late or skipped payment altogether and he probably would've been one of those tenants that is a pain in the behind to get out through eviction and would have tied her up in court for months. He sounds like a total deadbeat if you ask me and if this guy is working 70 to 80 hours a week, how in the heck can he not afford $950 a month in rent? I only work a typical 40 hour week and I pay more than that and I'm a single mom of an almost teenager. Dude has to be spending his money on habits or something in order to not be able to afford that working as much as he does even if his job is minimum wage, it would have to be more than that once it hits over 40 hours if it's with one employer which it sounds like it is, which means that at 70 to 80 hours a week he probably makes at least what I do or more so I find it ridiculous that he couldn't get himself together.

There is no such word as "textes." It's texts. Plaintiff wasted the court's time. If the plaintiff can't understand JM's ruling then he's ignorant. If he needed a judge to explain it to him, that's stupidity.

He can't afford the move in money then he can't afford the place She was so patient his biweekly payments turned out to be monthly. She gave him more time and he still couldn't make it right. She is lucky he didn't become a tenant. She was gonna end up in court for payments either way.

Did he sign a lease? When did the other tenants move? She's telling him he has no proof but what's hers besides a fiance who has reason to lie for her 🤔 she asked for nothing.

he probably DIDN'T sign a lease yet, but that's irrelevant because he wasn't suing for rent. He was suing to get back his security deposit. It took this man MONTHS to make payments on a security deposit and he still never paid in full. the landlord couldn't keep holding the property for him, she gave him 2 days to come up with the balance of the money and he couldn't. apartment security deposits are NON REFUNDABLE. This was an open and shut case.

I would never let someone like the plaintiff slide in anyway on rent if I was a landlord. You will pay your rent on time or you're out, end of story. Pay your rent on time like the rest of us good, honest people!
