Regarding the notarial prohibition in notarizing an instrument outside the "regular place of business" but withing the territorial jurisdiction may I have ask for clarification by way of an example. example in your case, you are commissioned in the prov of rizal particularly for the cities and municipalities of binangonan, angono and taytay, what if an elderly who has limited mobility wanted to make a donation but she is not confined in a hospital, neither detained or currently staying in a hotel or in a public office where oaths and affirmation can be made, she is at her residence in a remote area. Can you go to her house and notarize the instrument?

Hi Atty Duka! Sir, pwede pong humingi ng clarification regarding your discussion on the prohibitions? Sabi niyo po kasi sa example niyo that if a client is detained somewhere despite him/her being outside the territorial jurisdiction, the notary public CAN perform notarial acts as an exception. However, how do we reconcile it with the express provision of the law which is: A notary public shall not perform a notarial act outside his regular place of work or business; provided, however, that on certain exceptional occasions or situations, a notarial act may be performed at the request of the parties IN THE FOLLOWING SITES LOCATED WITHIN HIS TERRITORIAL JURISDICTION: (1) public offices, convention halls, and similar places where oaths of office may be administered; (2) public function areas in hotels and similar places for the signing of instruments or documents requiring notarization; (3) hospitals and other medical institutions where a party to an instrument or document is confined for treatment; and (4) any place where a party to an instrument or document requiring notarization is under detention. Hindi po ba, Atty, na dapat within parin sa territorial jurisdiction niya yung mga nasabing sites above at yung reckoning lang ng exceptions is when it is OUTSIDE the Notary Public's regular place of work or business? Hello Dean 👋🏻 I have a question which I hope you can help me with. We know from your lecture that it is important for the client to appear before the notary public. What if the client is bedridden in a place outside of the notarial comission of a notary public, must the notary public visit the bedridden client in the latter's house? And may he validly notarize a document in the house of the client which is outside of his jurisdiction? Thank you very much, Dean. can the lawyer who supervised the witness on making judicial affidavit also notarize the same document?

Pwede po bang magnotaryo ang isang notary public na nagtatrabaho sa LGU ng mga documents sa ibang departments of the same LGU? Example, sa Agriculture department sya tapos nonotaryoan nya documents ng Assessor’s Office?

hi Atty. Question po, nasa akin po ang original copy ng Notarized deed of sale (notarized back in 1981) pero kailangan ko kasi ng Certified True Copy nito galing sa Clerk of Court. Requirement kasi ito ng BIR for transfer of properties. Sabi ng Clerk of Court, wala daw sila copy. Nakahingi naman ako recently ng Attestation doon sa nag notarize at naka indicate sa attestation nya na na-verify nya yun document at ito ay true and authentic. kailangan ko pa ba humingi ng Certificate of Authority for a Notarial Act to prove authenticity of his seal. Pero diba year 2004 lang naman naging effective ang rule na ito?

Atty. Halimbawa po ang nkalagay notary public until December 32, 2020 pero ngnotarize ng documents after ng Dec/31/2020. My mikkaso po ba sa lawyer na yn ng ngnotarize ng counter-affidavit ng Dec/15/2021

Hi, question po Sir, bale if in case the signatory is outside the Philippines, ano po kaya pwede gawin? Bale need po talaga umuwi and be in the presence of the lawyer that will notarize? or there are other means via DFA red ribbon of the document

Good day, Atty. Duka May I get your advice regarding notarization? I need to sign a Deed of Absolute Sale of Land with the other party being represented by a government agency located in the province of La Union in Region 1. As I am residing in Manila, can I sign all copies of the document and have it notarized here in Manila and then send the same document copies back to La Union for the other party to sign and have them notarized by their notary public in La Union? Therefore, the Acknowledgment section will consist of two portions--one for each party. Should both parties be required to have their own witness(es) during the signing at the two different locations? Thank you.

Hello, Atty. duka. may question po ako. Meron kasi akong property na ibebenta sa dumaguete city pero yung buyer ko since pupunta siya dito sa Surigao, pwede ba kami magpa notaryo nalang dito sa Surigao kahit ang property ay nasa dumaguete city? or should we (buyer and seller) go to Dumaguete city for the deed of sale to be notarized by a notary public in dumaguete?
