Basically suppreme court got interstate commerce wrong and massively expanded the power of federal government. Same as with Chevron deference. The current court seems to be inclined to reign that back in. Hopefully interstate commerce can be reevaluated too.

Its an extremely hot topic among Canadians. With all the hand holding and safety regulations the government forces on us, including Occupational Health and Safety forcing ear protection on the jobsite, noise pollution laws and bylaws stipulating exactly what type of mufflers you can and can't use - they seemingly don't care about sportsman's hearing safety. In Canada the firearm is possibly one of the few things in the country that emits sound at that decibel level that does not REQUIRE sound moderation. It's how our government operates here, if there is something they can't force you out of legally - they will make it as inconvenient as possible for you to do it... and don't even get me started about predator/pest control at night being illegal too - even with todays technological advances in Infrared and Thremals.

As far as I know there's no federal tax/state tax on wheat I've been farming raising wheat for 40+ years. 95% of Wheat aren't a protected varieties, you can grow it and do whatever you please with it...If that truly were the case saving any gardin seed from a previous year and planting harvesting and eating/preserving/canning would be illegal?

Ryan's answer is testimony to how freedom is in peril. The wheat farmer and buying bread. Voter's need to pay attention and rein the federal government in. Amos Miller is a current example.

Wickard v Filburn was a farmer that produced wheat when there was a cap on production. He argued that he kept it for his own use, so it never even went on the market. The BS decision that came down was that commerce was affected because the farmer would not have to buy wheat from the market, and in that way he affected interstate commerce. A completely BS deal that should be overturned.

The Federal government interstate commerce excuse is WAY out of line with the intention of the founders.

I am an attorney. My advice is to stay out of jail and buy NFA items properly.

You will pay the government, obey the government, serve the government. Obey. Submit. You are not a citizen, you are a subject. That's what the Constitution says, I think.

This already happened in Kansas, surprised the lawyer didn't mention that. All they have to do is keep quiet and don't post about their supressors on the internet. With the size of Texans' egos that will be impossible.

the entire issue with his legal reasoning is he isnt using an original interpretation of the Constitution because he is using a modern dictionary. A dictionary of the time will show the definition of regulate meant to make normal and regular not to control. I like his shooting but he needs to read more.

Here's how this works; interstate commerce has NOOTHING to do with NFA items lol. NOT A THING. All NFA items require a background check and tax stamp the moment you desire to take ownership of one, in ANY part of the United States. How about this; take your 11.5" upper and pin it to your plain old non SBR'ed lower, THEN fill out your form 1 and see what happens to you. Or take those gun buyback fools a few weeks ago who chop sawed those rifles just forward of the front action ring. REGARDLESS of WHERE you are, the very second that blade finished cutting through that barrel, you're in possession of an unregistered nfa item. Or, say you own a lathe, and you take some aluminum bar stock and spin it down to 1.355" OD and turn it into a baffle-that VERY MOMENT you're in violation. It doesn't matter if it crossed any state lines. If you're a licensed NFA manufacturer and you make a can, under no circumstances can you transfer it to ANYONE without the proper forms and all the ATF requirements that go with it. Where you are within the U.S. is irrelevant. A tax stamp is required regardless.

Every state needs a law on their books and protections for their citizens within their state to prevent federal overreach against infringements. Commerce should be irrelevant. GCA/NFA is irrelevant.

For the insatiably curious, the case cited is Wickard v. Filburn, 317 US 111 (1942), US Supreme Court. The case essentially gives the federal government carte blanche to do whatever the hell it wants.

And who has the $$$s to fight the feds. And If I understand this right from my neighbor who is a retired agent. The ATF has no warnings. They start at 10 years and 25k.
