It's a long overdue change in favor of property owners and is hopefully the first step in making HOA communities more fair and equitable for everyone.

FYI, historical society's are brutal. In San Antonio, the "King William District," sued the home owner because of her red house color. She had to go to court, she won by proving with photos, that the 1890's house, was this color when built.

I lived in an HOA and wanted a few hens for eggs. They were not allowed and they would not talk about it. Some land directly behind our house and bordering the subdivision became available and we bought it. It is unincorporated and there are no rules so I got my chickens and a rooster too. They also controlled how big gardens could be. We eventually sold that house and built a house on the land. We also enjoy bon fires, a huge garden, and letting the grass get a little long if we are busy. It was glorious to learn the HOA called the city to complain about my chickens and they were told there is nothing they can do. 😂

My stepfather kept chickens. I can’t imagine anyone thinking chickens could be kept in an HOA. Many cities prohibit it. We lived in an unincorporated area that was zoned for livestock.

@@genxx2724 I understand that many city’s have restrictions but our city allowed hens (no free ranging, no roosters etc) but they would not even allow me to approach the board with a proposal. To your point, if you want chickens, don’t buy a house in an HOA.

@@BootheRoo22 Right. What’s the point of submitting a proposal to violate the CC&Rs? The board has no authority to approve it. Both roosters and hens both make a ton of noise and there’s good reason for them not to be allowed. The eggs you can raise are much better than commercial eggs, but chickens are a nuisance.

I don't have a HOA here in my NC neighborhood but I always enforce my personal HOA rules against my neighbor to move her trash can back to her driveway off the road! You know how? I take it up there for her because she is a kind sweet older woman and its the least I can do for her!!

That's nice. I have an empty lot next to my house and my HOA rule is no trash will be allowed to collect there. I enforce it by once a week going out there and picking up all the trash that is blown there from the wind.

My wife and I lived in a private gated golfing community, she golfed I did not. I did however spent 2 years on the board of directors and I soon learned that God himself could please some of the Karen's, after about 5 years we moved out to start enjoying life again. People move into these HOA communities and soon realize that besides paying the house payment and property taxes you have about zero control over your "area". some of the most miserable people in the world move into these communities and soon get involved in the HOA then spread their misery around to the rest of the people.

I agree. My ex husband, who I had to call recently, boasted that he’s part of the HOA dictatorship. He’s retired and so this is his new outlet for asserting his annoying “leadership” talents”. No exaggeration when I decided to divorce him one of the many reasons was to get away from the wannabe “upscale” HOA community that was filled with busybodies.

it really is about spreading the misery. And using the board as your personal tool and army to rule over your neighbors any time they do something you don't like. And always with the same response: "if you don't like it then move", or "how would you like it if your neighbors decided to mow the lawn while you host a party?". Red herrings and overbearing, controlling, miserable people. Never again!

I worked for an HOA in SW Florida. The Karens were everywhere and when the Covid mandates started, it was open season for them to spread as much toxic misery around that they could. It is something I will never forget.

My parents built a house in an HOA. The board would not approve any of their proposed paint colors. The color of the president’s house, which was recently painted, was acceptable to my mom, so she asked what the brand and the color were. Certainly that would provide closure on the issue of paint. He dismissively claimed he did not have the information and was unable to obtain it. The administrator claimed not to have the information on file, which is BS because it had to be approved. The president is an attorney, by the way. Clearly their only interest was in being obstreperous and harassing my parents, and the administrator had been instructed not to provide the information. My mom obtained the information from the painting contractor and submitted it for approval. The board objected to the color. My parents said, “That’s interesting, because this is the color that is on Mr. President’s house.“

The HOA said we paid fees late one month. We showed proof that wasnt so. They took us to court and put a lean on the house. We showed the judge the paperwork and it was dismissed. They acknowledged the fault. 2yrs later they took us back to court for the same issue. Dismissed again. Year 4. Another lean and court. All for $36.00 in late fees. Which we did not owe.

Agreed, but in some instances the city becomes the HOA as they gain more power. Also they want to work with developers and if your slice of the pie dosen't fit on their desert menu it can become a problem. Think Cape Coral Florida, Coral Gables, Boca Raton. We are never truly free or own our house with endless taxes. Sad. Cities in Fl. are trying to annex neighborhoods that have no interest in being incorperated, but town councils are pushing forward as hard as they can anyway.

The city is going to maintain the pool, playgrounds, landscaping, trash pickup, snow removal (in those places) exterior maintanance of a condo like painting and roof replacement/repairs? Who’s going to carry the insurance for the complex/neighborhood? HOA fees cover a ton of stuff, way beyond mowing the grass.

There's the other side of the coin in places where the city/county refuses to maintain infrastructure because they consider the sub-division "private". Case in point, many sub-divisions on the Big Island in the State of Hawaii were deemed "private", property owners have to pay (millions) for their own roads, yet the State says they cannot restrict access to the public. Half of the owners refuse to pay HOA/Maintenance fees and it's legal because the sub-D's were formed before these HOA laws were enacted. It's a real mess and has been going on for over 50 years.

At one time, I had an HOA. They sent out a notice to every residence that regular trick or treating was banned and there would only be trunk and treat at the clubhouse. I called them right up and asked them who they thought they were to tell me who could come to my door? 2 days later we all got another notice saying the HOA had changed their minds.

I lived in a "Condo Gestapo" enclave many years ago - and one of the members of the HOA board literally got on his bicycle each and every day with his clipboard - his pencil etc . . and as HIS LIFE'S PURPOSE was to find "infractions". And so - I and my neighbors got "infraction tickets" for having a grill - backing into your car parking space - feeding cats and on and on. I will NEVER LIVE in a community that has an HOA.

@@LynxStarAutothey need to easily see the license plate, check for expired tags, etc. People will park cars with expired registration or no plates at all. The rules are in place for a reason... usually they will send a warning first. Nobody wants a colony of stray cats on property pooping everywhere. One lady in our community used to throw birdseed on our breezeway corridor to encourage birds to flock to her window. Messy and trashy.

My HOA is pretty intense. They have so many rules you almost need an assistant walking around just making sure you don’t violate one of the 99,999 rules. I will say, in 5ish years or so when I move into a new home I will not be moving into an HOA community. And this is coming from a guy with 0 violations.

I was on the board of my old neighborhood HOA. SO many Karens came to meetings demanding we enforce rules the Karen's made up. No such rule in the C&Rs. They just wanted to control their neighbors. They would get so mad when we told them "no." Now, imagine them getting a board seat. You will win every case but have to deal with their crap and possible legal expenses.

Getting rid of HOAs in most large cities could literally run your condo's value down to zero. If you think that's an exaggeration, see Detroit, Birmingham, Chicago etc.

This new law in Florida was probably passed because the Real Estate Agents demanded it. I noticed that the agents here would use the lack of an HOA was a sales tool to promote certain properties. Houses in HOAs were probably shunned by certain buyers making them harder to sell. Then the sellers would have to lower the price in order to attract buyers. So essentially, HOAs depress home values, not maintain it, as they want us to believe.

People who purchase property in an HOA know they are purchasing it subject to the CCRs. By purchasing the property, they agree to this. Valid complaints would be if there is harassment, or arbitrary, inconsistent enforcement of the rules.

My HOA got sued by our former HOA president! He was pissed that we voted him out so he went after us. Too bad for the HOA officers who also got sued individually by him unless they paid $4,000 to settle out.

In our HOA there is an HOA Board member election every year. The HOA members (the home owners) nominate who they want on ballot for new board or even existing board members can run again, if nominated. HOA Board members do not automatically renew every year.

I too live in a gated community with an HOA that uses a property management company to do its bidding….I appreciate that the HOA rules needs to be enforced in order to prevent my beloved community from turning into a “Ghetto”…..However, in the past, I did get “nickel-dime” written violations for not complying with the established rules…In my defense, I thoroughly read the rules and found out that my “supposed violation” had no merit…I therefore challenged the HOA’s call and they finally admitted their error….Always, fight for your rights…BUT….be sure that you are 100% right before entering the fight!!….😊

I live there. This looks like an area around Cherokee park or somewhere off Bardstown Road. Big old houses. I like them but from living in one, the first thing I think about when I see them is how hard it’s going to be to service anything around the roof. Hello scaffolding. Mike likes the beach, no beach around here unless you count a beach at the Ohio River about 15 minutes away.

My HOA told me what kind of blinds I could hang in my windows. It is nice to exclude agent fees from the value of the house to reduce property taxes.

That’s pretty common in condo complexes and that information would be in the CC&Rs you signed off on at closing, plus it’s available in advance to read and decide if it’s for you.

Yes! The county includes the realtor's fee in the reappraisal of the house for tax purposes. I've always kvetched about that, but no one seems to understand what I'm talking about! Thanks! Because you get it!

We have soooooo many HOA stories. The worst? A really close friend of our family (more like family to all of us) retired and bought a beautiful brand new home in a gated, HOA neighborhood. Exactly one month to the day, a board member arrived without notice to do an "inspection" of their home...and get this, the inside included. Being new to the whole HOA scenario, the wife welcomed them in. The total "dings" they got added up to 7...and the board member was as only there for a matter of minutes. Seems that if you decide to upgrade your appliances throughout the house, you need to notify the board ahead of time and "get permission" first. That included submitting exactly which appliances you were installing. But the thing that really chapped their asses was the beautiful landscaping they hired a landscaper to install in the rear yard. Mind you it was only dirt when purchased, as all new homes were, They spent $14,000.00 total on it. Artificial turf, curbing, plants with drip systems, etc. They were written up and fined $300 for not submitting blueprints ahead of time. Nothing wrong with what was done, nope, it was all fine. Absolutely beautiful. They were pissed cuz our friends had the audacity to take their solid dirt year yard and beautify it. They appealed it at a board neeting. They lost and get this... they had to pay an additional $200 for administrative board fees.. in other words the board got paid for their time saying you loose, pay it.

Where I live, neighborhoods with active HOAs are more desirable. Home values in these areas are much higher than non-HOA because city codes and other appearance rules are inforced. Most of the rules are easy to follow and obvious to homeowners who have any pride of ownership.

I'm a trustee in a condo association. You wouldn't believe the dirt bags who never pay their condo fees or special assessments. When you try to collect, the courts in Massachusetts don't really recognize the condo docs. So everyone else pays and suffers because of a bunch of deadbeats. These types are usually foreign investors who rent out their properties. They don't understand US laws nor condo documents and the courts give them a free pass. I'd never buy a condo again just for this reason.

@@SAMS1N Because they are entitled and don't think the law applies to them. You must pay for shared common expenses and maintenence. We don't have contact information, they don't attend meetings, it's like they don't exist. We can't even get a mailing address. The one we get from the town no one responds to. The ones in this status are Chinese. The town is even after them for health code violations originating from their unit, the condo association has had to pay for repairs that effect the integrity of the building.

It’s crazy to me that a person would even move into a neighborhood with an HOA. I wouldn’t consider it not even for one second. Like who are these people that just willfully accept being told what to do? I mean I could understand like a super basic HOA that you know cost 100 to 500 bucks a YEAR…. But anyone that buys a house and just knowingly accepts that they’re gonna have to pay 500 600 700 a month. Well, you apparently make bad decisions. Fight with your wallet. You enabled them.

I’ve lived in many HOA communities. Never had any problems with any of them. They don’t “tell you what to do”. The CC&Rs lay out all the rules of the complex, they’re available beforehand and you sign off on them at closing.

As a former agent: This industry needs disruption imo. Flat fee (not saying cheap) but flat fees across the board. I do no believe that most agents do any more work for the sale of a $100K v. $1 mil. house. Same with title companies.

A friend of mine lives in the neighborhood where half of it is in an HOA. It starts with the house next to her. In fact, the house next to her is there the HOA president or whatever lives. My friends daughter is disabled, requires a wheelchair or a wheeled walker. So my friend moved her trashcan to the side of the house so that there would be more room in the driveway to make it functional for her daughter to be able to get in and out of the car. The HOA, lady came over and asked her to move it. I would’ve told that lady to F off in no uncertain terms, but my friend is nicer than I am. She was kissing the ladies butt because she was going to try to convince her to vote a certain way for the school elections. What a crock of crap people put up with.

Coming from a 38 yo male so take it as you will. It's like everything in life. Everything starts off as a very very good idea, and it works for many years very well. Until PEOPLE GET CORRUPTED!!!! It happens through everything from HOAs to the fed, to unions, to the welfare state. Each one started with noble goals and worked for a long time, until they realized there was massive money to be made and line the ones in power pocket with said money. Sadly it's the way of the world. Leave early enough to see yourself the hero or stay and become the villains

Michael - I recommend that you volunteer for your Board to get a taste of what it’s really like. Some owners refuse to pay their assessments, repair broken out window glass, falling down fences, treat cockroach infestations affecting their attached neighbors, etc. unless pressured. Just sayin!

Maintenance is a good argument. The HOA where I first lived covered all exterior elements/maintenance, lawn care and snow removal, along with maintenance on about 2 miles of walking trails in our neighborhood. It’s great for older people who don’t want to be cutting grass or shoveling snow after a Midwest snowstorm. I don’t think I’d like to live in one again anytime soon, but I understand why people would want to live in that particular community.

In theory some covenants and light HOA is good to help maintain an attractive neighborhood and your property values. Nobody wants a true trash collecting, deteriorating eyesore next door with junk cars, old appliances, piles of trash, etc. But many HOAs attract micromanaging busy-bodies who become little tyrants with nothing else to do but harass neighbors. When I lived in HOAs (never again), I would receive nasty letters about the most inane stuff, threats of fines, etc. It was very annoying. In the worst instances, they can charge high HOA fees, squander the money, make huge assessments for collective repairs, use your money for things you don't want or need or agree to, etc. and place a lien on your property if you don't pay.

Not all HOAs are run by tyrants. Our board tries to minimize interference with our homeowners. We don’t go looking for violators unless it’s egregious and can’t be overlooked. All of our financials are open to the public. We are open to homeowner inputs, but we get very little in this category. Everyone keeps their homes up with little to no prompting. Our HOA works.
