Actually that dictum should apply to anybody holding a public office. Or to any decent human being even who don't. Civility should not cease with office.
Mr.Dave assessment is so right and he is always inspiring. Thank you Mr.Dave for being so upfront and enlightening the nation about the crises in the functioning of the Supreme Court which is raising lot of suspicion about their motives.
Very good interview once again Karan ...we are privileged to have you as an anchor in our country & a classic interviewer of course ...besides you & Ravish Kumar, nobody else comes to my mind for having such a unique & flawless in the line of journalism. Regards from Jammu.
Yes I support you that the judges are of two types. But my opinion says one type are those who were amenable to Prashant Bhooshan type advocates and other like Justices Deepak Mishra, Bobade and last chief Justice who stick to JUSTICE and nEver get influenced
personal vendatta by CJI....and he is going to make sure that prashant bhushan is found guilty no matter what happens in hearing...democracy dancing pants down
Wah! What a masterful handling, and conduct, of the interview, as usual, by Mr. Karan Thapar! And remarkably spot-on answers by Mr. Dave. Thank you, sirs.
Always good and learning experience to listen to Senior Advocate Mr. Dave. I salute his controlled courage. He tells things without them telling. Look forward to decisions of contempt proceedings against Prashant Bhushan, Advocate. Some forces out of Judiciary seems have intruded the Judiciary. Obviously, Mr. Thapar asks only the relevant questions which I like the most.Good to see a veteran doing the job which young journalists should have been doing in main stream media.
Judiciary is a mockery as on today. Normally, judiciary should not deal with the cases on temperaments. Another aspect is now judiciary is not independent. This is one classic case to prove.
Sir you are genius sir rightly commenting on the issue.... I saw your questioning Mozi and he ran away by drinking water.. He was unable to answer you.... On this occasion and issue you please interview live.... Still hats off to you sir with folded hands....
CJI was not sitting on the chair of the justice but on Harley Davidson that too violating COVID Lockdown rules to invoke contempt of court... This is shockingly shameful
@rulia ram I have very strong antipathy towards Islam, koran, muhammod but your views reflect that your idea respresent the upper caste hindu fan club members, blindly following a most incompetent person.
Prashant Bhushan is a great human being . Existance of such human being is very essential on this earth .May the supreme controller of this nature/ universe dispense justice to him .
This interview conducted by Mr. Karan thapar with Dushtantji regarding Mr. Prashat Bhushans contempt case really valuable and it is very knowledgeable to every body case it is very interesting it gives important message and Supreme Court's attitude of the Judges
So many people repeatedly allege corruption charges against politicians, Govt officials and many other individuals and institutions in the country. Even retired SC judges have pointed out corruption in judiciary. Why such allegations against judges alone is not being tollerated? Is it b'cas no judge is corrupt or b'cas they are given the tool of slapping contempt cases as they want? Then, why not similarly arm the other sections of the society also with powers to adjudicate contempt proceedings by themselves?
@@vselvaraj9619 bc from judges some form of justice is expected & they decide on many life & death cases, à wrong judgement can Ruin a person's life. We expect them to be holier than thou but we forget that they are also weak inept humans.l
Late Mr. Arun jaitley has objected that judiciary should be kept away from politics. What does Rajya Sabha seat to Mr.Ranjan Gogoi indicate ? That also Mr.Gogoi was Manoneet ( directly elected ) ???
Great, Mr. Dave has rightly brought up facts that are eroding people's confidence in judiciary especially the honorable supreme court. Mr. Karan Thapar's interviews are always very interesting. India deserves more and more such outspoken personalities
If peasant is punished, surely it is an honor for him for upholding the rule of law and human dignity on one hand and on the other side it will expose the meanness and shamelessness and criminal depth of those slaves
Prashant Bhushan is a man who stood by fighting for justice of the voiceless poor. It’s really sad to hear the present developments. Karan Thapar must be appreciated for taking up this issue for a public debate.
The SC listing the old contempt case now appears to reveal its burning urge and to take avenge (and vendeta?) by display of its prerogative in listing casesinvolving itself to serve selfish purpose, on priority, before serving others.
It's not just the BJP, Congress too does it and has been doing it well before BJP. Like Shourie said BJP is just Congress with Cow! All of these VIPs are crooks.
@Muan Suantak Absolutely agree! We should not think "party". What is wrong, is wrong. Politicians and trolls use these tricks to distract attention from the issue.
@rulia ram So a corrupt ED, CBI, EC, Police, judiciary, etc, etc suddenly meet your approval because we are under a political party of your liking? By the way, Prashant Bhushan was questioning every one of your favorite institutions before Modi came to the scene.
What Mr Prashant Bhushan has said isn't Contempt ....... *It's an attempt to help SC get back it's falling stature !!* >>>> Take good advice .... OR Fall in the People's eyes !
If it is going on , SC will be left alone with only Govt . People of India would not allow anybody for long run to harm their rights which they enjoy by virtue of the Constitution of India .
Here in the US there is no such thing like holding someone in contempt because that person criticized or made fun of the Justices including the Chief Justic of the Supreme Court. India should have similar law too.
also strange is that they haven't been able to isolate this virus yet ... i've watched Dr Andrew Kaufman say that on you tube, his interview with Del Bigtree got banned along with Bigtree's channel ... well it appears what's happening in our great country appears to be quite unmanageable in the plans of the higher-ups, the ones operating on the global level ... i think that is a positive ... we need to awaken more of us to see that they are not able to pull this off ... their plans to vaccinate the world with their poison ... have a laugh on that one guys ... hahaha
Why aren't the judges ready to face criticism ? Then it clearly gives us an idea about mishandling of cases and giving favourable decision to some people
Mr. Dushyant Dave looks very knowledgeable and truth loving person , he really deserve to be president of supreme court bar association, keep it up sir, we have to be united against the fight for justice.
The blue planet had a great chance in the galaxy to turn out to be the paradise, yet it didn't happen, for the corner stone was missing, that simply nothing but 'JUSTICE " !
Where ego is concerned priorities like case pendency takes a back seat. I and I also know that many like me are unable to find common cause with many things that the Supreme Court judges are doing. We have a CJI behaving like a rockstar and that too on property belonging to a political activist regardless of its colour. Will this not be critiqued. Justice Mishra the judge who is the prime mover in this contempt petition is the one who gave that amazing endorsement of the PM. He also asked in the Rajasthan case as to why dissent is suppressed. Why the double standards? Have we also forgotten the nomination of CJI Gogoi easily one of the most forgettable CJIs the Supreme Court has had, to the Rajya Sabha? Why this type of indiscreet behaviour on the part of some judges and most of the others acting with absolute dignity. If your behaviour is questionable it will be questioned.
How many yesterday judges like M.C.Chagla ,Sri Subba Rao ,gajendraghatkar ,Dharmadhikari ,Dr Chandrachud ,Khanna ,the list goes faced this type of situation from public ,advocates or others. Why they were respected ,adored.
Prashant Bhushan is the son of Shanti Bhushan who won for Raj Narain against Indira Gandhi in the early 1970’s. Ageing father and his son will be burning the midnight oil to win the case and make the judiciary look foolish. Let us see what happens.
The great saint Thiruvalluvar says: "the best way to punish a wrong doer is to do him a favour to put him in embarrasment". Even presuming that Mr.Bhushan has done wrong, the SC shouldn't be in an alacrity to punish him. The wrong gets ballooned due to the SC taking cognisance of it. Magnanimity elates, not the act of taking avenge! Image of the SC or it's judges won't go up by exercising the contempt prerogative.
Karanji and Dushyantji, Many many thanks for your discussion in the right time at the right placed. Nowadays the beautiful symbol of the court "holding a balanced in the hands of folded eye" is meaningless. With these mentalities in all institutions including the elected members "how we will fight the world, specially, the China". The Indian need to wait the 23rd century to compete the other advanced countries.
Justice VR Krishna Iyer in his book *The Majesty of the Judiciary * has quoted from the book “Judges” written by David Pannick: “Judicial independence was not designed as, and should not be allowed to become, a shield for judicial misbehaviour or a barrier to examination of complaints about injudicious conduct on apolitical criteria. That a man who has an arguable case that a judge has acted corruptly or maliciously to his detriment should have no cause of action against the judge is quite indefensible.”
Actually contempt of court law should be done away with. It stifles voices of knowledgeable people. And also puts restraint on aggrieved persons in a court of law. But it is not surprising that Dave being a lawyer would not suggest abolition of law of contempt of court.
