The confession of Accused No1 is different to that one of No 2....I was expecting that they should be similar...but lawyers will deal with it, whom am I a poor layperson like me, and the judge too knows how to deal with situations like these...15/3/2024
Judging by the comments. Even if this guys can take the stand and confess we would intentionally reject that confession just to perpetuate a narrative that none of us can prove beyond reasonable doubt.

With my little understanding on the alleged confessions, why Kelly Khumalo not arrested pho. Cos it seems all the accused persons were arrested, based on the alleged confessions made by the two accused?

The law does not allow those mentioned in the confessions to be prosecuted. It will be illegal to arrest someone simply because his or her name is mentioned or implied in the confessions.
Remember according to Ginida's affidavit they have evidence that implicate Kelly including cellphone linkages as well as a photo on her phone similar to one in one of the accused's cellphone

It seems like you are the one who does not know what hearsay evidence is. Neither Sibiya or Ntanzi claimed to have been inside the house when Meyiwa was shot.

The judge is now forced to dismiss all the evidence since it implicates Kelly. Otherwise if the court use all this evidence to issue a judgement against the accused ; they will be compelled to charge Kelly as well.
Zungu statement collaborate with Ntanzi’s confession.. Sibiya never mentioned any of the guys on the dock.. physical evidence doesn’t match the accused.. now it’s a question of were Buthelezi’s brother found and assessed against the physical evidence
It actually does, but nkane is actually his nephew gwabini. Sfiso nkane zungu... Zungu used the nicknames to get these guys arrested, he didn't know their names but the lady was typing their full names. They denied the nicknames. Carlos buthelezi is Carlos Mncube, sfiso nkane zungu is fisokuthle ntuli. Mthoko, not this one. It's the same but altered to fit the guys on the dock. When asked about the mix up with the names, he said he will bring original statement. Then baloyi came and said it was shredded
The only people wasting the public's time is the defence..they use every tactic in the book to delay the proceedings. Simply because they don't have a case
This is an embarrassment of the SA justice system, even the most ignorant person would tell that this case is not genuine, it’s a poorly crafted case which is worse than a ferry tell story.
I may agree the accused wouldn't write that statement in English,i have a matric and college, it is difficult to write an affidavit if not prepared..usually i will first find what is needed before i go at saps or uf lucky find a capable officer.raphadu knows they are the one's who made a statement to be signed.

Where I struggle with this whole 'voluntary' confessions thing is why would an accused person voluntarily confess when they have not been promised s204 protection.My compression is neither 1 or 2 pulled the trigger,so why voluntarily compromise yourself for nothing in exchange.I guess both accused were dying for prison time.Nx state must do better

Whenever Adv Baloyi makes a statement, he backs it up with the relevant authority when requested to do so. The defence is often unable to backup their arguments. Adv Mnisi, c'mon sir!

@thereal_papandu the police writes what is being said by the deponent so you must say Ntanzi made the statement because you were not there to judge how the statement was written
After listening again I realised it. The names are replaced. He says sefiso zungu aka nkane. Carlos buthelezi and mthoko who was with maphisa. But zungu did mention a mthoko that wasn't this one in his testimony. No wonder these guys were denying the nicknames. Something is fishy there
My question is, if the state are in possession of the statements that implicate Kelly in this case why she is not arrested..but bcz I don't know the law rather let me wait until the judgement day
What we should bare in mind is that people involved in an incident may recall the incident differently, due to many reasons and influences. The judge will use his experience and many legal tools to arrives as to what he believes is most probable, and based on all of that, make a judgement. He will be well aware that such a decision could be appealed.
Because the mastermind may not always have direct evidence linking them to the crime. It's always better to proceed against them with convictions of the foot soldiers in hand.
Remember that Gininda has put it in record that he applied for her arrest and the NPA has still to approve that. I guess he has done his job and can't go ahead with the arrest unless approved
What is confusing is the whole time I was thinking Kelly was being protected but now seems like she's not, because if that was the case she would not have been involved or mentioned on the confessions , then again if Kelly goes down she won't want to go down alone, she will start talking then the whole truth will be out , the people who were in the house will now talk
The statement only impacts the deponent not anyone mentioned. As a result, NPA didn't grant J50 for Kelly as there was no evidence linking her to the crime.
If the confession of Ntanzi is to be believed, which i think it should, it will corroborate the evidence given by the lady (Neighbour of Khumalos) who was sitting with a friend (Yolanda) in a M/V outside the yard that a slenderly built man ran passed the M/V in which she was and after sone few mins or second 02 men also ran past towards the Park and the other was having dreadlocks...that slender man possibly was him (Ntanzi as he went to sit in the polo M/V)...the 02 who later followed him u ll judge for yourself..This is my opinion and it my be very wrong and get criticised. 16/3/2024
I guess when the accused persons were arrested, statements from the people in the house including her(Nthabiseng) were already taken by the police. So what if Ntanzi's alleged statement was written to support Nthabiseng's version?? What if???🤷🏽♂

The case is not over yet, these confessions are taking us somewhere, relax , accused no1 was just trying to confuse the cops hoping they will hit a dead end, give it few days you will understand.

They were arrested in 2018 or 19 four years after the commission of offence I would have been surprised if he mentioned exact date and time....he surely wasn't using a diary or was he? I bet you don't remember the exact time and date you called someone last month
The police arrested Muzi..he gave them a false statement,they proceeded with their investigation and arrested Ntanzi and told him Muzi told the truth.. so he fell for it and told the truth😂😂.
But muzi makes sense. Ntanzi says they took money and phones. But they didn't take anything according to the victims. Mapopola even said they had to check for coins to buy soup. Didn't have money on them
What truth coz his statement clashes with what the witnesses said. They said two suspects the statement said he pulled the trigger the statement says Mncube did and how could he have seen that when he was in the car? The witnesses said they did not have money the statement says he stole money and cellphones. A lot of other things said here clashed but I will highlight only these few things. These statements don't match coz the whole story is made up.
Makhosonke buthelezi who was mentioned by gininda as the shooter. Gininda wants to say he implicated these guys. But he is not alive so he can't give evidence. How does he mention these guys but ntanzi doesn't mention him and sibiya doesn't mention ntanzi, Mncube, ntuli and maphisa. Doesn't add up. If they were all there there must be some connection
