I want to settle my credit card debt. I plan on sending them a letter explaining my situation. The worst they can say is no. My question is which address is best to send it to. The one that the payments go to or the "card services" address. There are different addresses on the statement.
What can you do about a default judgement that has been garnished but the amount garnished is more than the original judgement plus the added interest. Ive called the colleters attny and asked and they gave me a vague answer and said it was court fees. But I looked it up and the lawyer lied. Can I file a countersuit

US code 15-1692i Debt collectors cannot sue. Besides the collector purchased your debt, which voids the original contract between you and the original Loaner. You didn't sign a contract with the debt collector, so you don't have a responsibility of the debt

Yeah Midland for example just doing me for something back in 2000 I don't know 15 and it's for $1,200 and it's been on my credit every year and I reported to all of them and showed them a court order from the Massachusetts judge in court that they dismissed it and said I had nothing to do with it and I don't owe anything and they're still putting it on there even though I showed it due credit companies
Hi there! What happens if I live abroad but a sherif is coming to my moms address looking for me to serve me. She told him I was overseas and the next time he came he left a card with a file number his name and a number. I called they said ok we will tell him that you are overseas but he came back 3 days later.
This probably won't get the case dismissed, but if could give you extra time to work out a plan to settle the debt and resolve the case. Lack of service isn't typically a defense in most cases.
I answered a debt lawsuit using solosuit and just denied everything and filed, they responded about 2 months later and sent me copies of the original credit card agreement contract. What do I do know? do I file for motions for arbitration? all they sent me was just all the original paperwork from the original creditor. now what?

Would any of you know by any chance when they change the amount of time that a bankruptcy stays on your credit from 7 years to 10 years? Because it was 7 years I think when I was in court in 2017 and now they're saying it's 10 years I was grandfathered in they can't do that can they I mean if they changed the rules like that it should be from the date they started it not going back with anybody that's already on there you know what I mean? Cuz it was supposed to come off this year 7 years now they want to keep it on another 3 years that's just wrong and I filed in 2017 has it been like that since before then? So I always heard 7 years then I'm hearing 10 years I think it really did change recently if so I'm going to fight it Susan somebody that's already filed with an agreement of 7 years being on your record you can't just change it to 10 your defaulting on the agreement you know like you're doing it cuz they think that's how many years it'll be on there cuz I don't know son's just wrong with that but just wondering what it was your opinions on that? Good point! But having a credit card can be a great way to build credit. So, if you do decide to open a credit account, be sure to make payments on time and only spend the money that you have!
Filing an answer isn't simple when you are served 10 days before the court date that is located in a distant county, you have no idea what the debt is about, you are on SSI so no money for help and legal aid has a 6 week backlog for appts and you were on your way out of state to care for your father while he has surgery when you were served. Can't cancel the trip as dad already paid for new tires and a tune up to get me there and he needs the help, I couldn't let him down. Now they have been sending me paperwork for years and most recently a filing to extend the default judgement. The only help legal aid had for me was you are on SSI, they can not collect, don't worry about it. But the constant harassment has been extremely detrimental to my mental health which is why I am on SSI in the first place. Is there any way to get them to leave me alone short of death? I'm over 60 and been on SSI about 30 years due to the side effects of a brain injury. My condition has never improved in all this time.
If there is already a default judgment in your case, you can try filing a motion to set aside judgment (also known as a motion to vacate judgment in some times).
