Sheriffs Finally Lockout a California Tenant Who Avoided Eviction for Over a Year!

Things get very Tense when the Tenant decides to make an unexpected appearance at the Property before the police arrive to execute the lockout. Watch as Property Manager Jayson Yoss joins the San Diego Sheriffs, and the legal team from Hoffman & Forde to serve an eviction on this nonpaying Tenant.
The property owner had to wait 8 months before the court granted the eviction. However, the Tenant filed multiple motions to avoid the sheriff lockout delaying recovery for another 5 months! All in all this Landlord paid over $21,000 in legal fees and court costs and had to wait 13 months to get rid of this squatter.
After over a year of harassment and no rent from the Tenant, the Landlord is devastated to find both of her units in shambles, with virtually no way for her and her family to recoup more than a small amount of money from a default judgment.

I'm glad she got her property back, but please remember that there are also really bad landlords. This goes both ways.

Totally agree with you...there are some terrible Landlords, and there a lot that just don't know what they "don't know." We are working on several projects with Tenants who have been subject to unfair treatment and substandard living conditions by Landlords for upcoming videos.

Due diligence on Tenants is an Absolute 100%...if you don't do the basic credit, criminal, income verification, your odds of having a non-paying tenant go up exponentially

Paying the extra money to background check doesn't always work either. I paid a real-estate agent over a grand to find the right tennant, and that tennant was the worst. Ruind a newly built 6 year old home I had (bleached carpets, water damage on wall, killed lawn, stole lawn equipment, had multiple people living there even with my monthly visits, and they still wanted all their deposit back). They got a "lawyer" involved and I called their bluff and sent my own return letter to tennant and lawyer and they went away. I guess it could have been worse.🤷🏻‍♂️

Thats a scenario that we hear too often. We have eviction videos here on youtube displaying Tenants that we believe "scammed" their way into the Property and caused a huge amount of damage on the way out (unpaid rent, damage to the Property, legal fees). Its unfortunate that there are times when the proper protocols aren't properly applied!

Nothing is really perfect but doing your due diligence is really your only defense. Of course there’s bad tenants who don’t have any records. Some are smart to leave before they get evicted to avoid having a record. So they just hop from place to place causing damage and leaving debts. It’s why even if a tenant leaves I still sue them for damages and any missed rent and late fees. That way if a future landlord look at their record they’ll see that they’ve been sued by me and maybe they’ll look up my name and give me a call to ask.

@@CharlesCurran-m9p No, I graduated from Berkeley School of Law. The belt has the iconic logo with the initial, so that kind of gives it away. My comment was about the juxtaposition of the haves and the have nots. When you’re crying “Woe is me” about economic loss, draping yourself with the trappings of wealth is comical.

I notice that the “squatter” could afford a nice new truck. For a bonus I’d notify the repo guys in case he’s not paying for that either.

He’s just playing the game California allows. Just like the other side can use lawyers; so can tenants. This is why I don’t rent property in California. California plays games with the laws written. A good lawyer can run an actual owner into selling property to tenants for a dollar. With legal fees of 100k 😝

I would agree that a good lawyer can make an eviction very costly...but its ultimately the circumstances of the eviction that make things costly. I would argue that a Tenant WITHOUT an attorney can do more damage and create more delays than with one. The reasons are simply that the attorney is bound by legal and ethical standards that a tenant appearing pro-per is not held to...plus the court will give a tenant much more lattitude than an attorney. Bottom line is its the laws in california and the backed up court system that have contributed to these "long term evictions." Screen well, work to find common sense solutions with your Landlord/Tenant counterpart and hire a good attorney if you can't work things out.

Yeah well a lot of landlords are scum of the earth, so tenants REAL TENANTS need protecting. Squatters rights are stupid. They always have been, people shouldn't be able to stay in someones property for free. But her saying she "worked hard" as a landlord is like really? All the landlords I know, didn't work hard they got lucky, they inherited money, or bought cheap properties at the right time. My landlord raised my rent from 800 to 1,700. The greed is unreal.

Ok you bring up some good points but saying the Landlords you know didn’t work hard isn’t a good overview of all tenants. But totally agree that there a good tenants out there that are being lumped in with these squatters and that is not right

@@JSunSD2000 100% accurate...every situation is different, and what most everyone wants is just a fair and speedy adjudication of these issues...taking 12 months to get a basic day in court and then eviction and then lockout is just ridiculous and hurts everyone (Landlords and Tenants)

There are amazing tenants and landlords. You have to look past your own situation. Unfair laws are whats making the situation worse. I saved from 16yo to 30yo, didn't have a fancy car, clothes, didn't party and was able to purchase two small condos which I rented out to two nice families. I never inherited money and I don't see why its bad for someone to buy property at the right time. Thats not luck, its being smart which isnt illegal. One of those families was decent and the other horrible. The laws towards landlords are unfair in CA. I sold both properties and will never have investment properties again. Btw, for the 7 years my tenants rented from me, I raised rent once and they did not even appreciate it. Even tho costs to maintain the properties go up every single year.

7months of no rent. 5 months to get the deadbeat tenants out and I was one of the lucky ones. Cali do better. Be fairer to both sides.

There are no "new owners" - the cops lock out "trespassers or non-paying Tenants." The people who get "instant access" are the rightful property owners

Landlords don't usually spend money on "background checks" - Tenants pay application fees that cover the screening of credit/criminal/eviction/rental history/and to collect work/income information. A good PM can perform this service and save you time, energy and the potential to poorly screen

I’ve done a few hundred evictions. Don’t hang out in the front yard before the sheriffs arrive. How could none of these people know this? Always wait in your car a few houses away.

Though we generally agree its good to maintain a "low profile until the Sheriff arrives," Its a video - we had security on site and didn't trespass onto the premises until possession had been restored ;)

@@Goldenwestmanagement the idea is that you don’t want the tenants to even know you’re out there. They could have been stewing and preparing in there. You want the element of surprise. I once had a sheriff threaten to cancel over something like that(forget which county,maybe LA) That was unusual though.

@@brandonadler1022 I appreciate that - except for the fact that there literally a sign posted on the door saying "Writ of Restitution" and says the specific day the Sheriff is coming to take back the property! The whole thing is extremely telegraphed. People who want to "do harm" are going to do it, and for a lot of other reasons than just being evicted

@@Goldenwestmanagement thats a noteworthy difference. The counties around here specifically don’t tell them the time of scheduled eviction. They’re only informed that there will be an upcoming eviction, which seems safer.

It’s not true, when the building’s owner wants to evict you they do it, without a reason, you go to court (without a lawyer) because you don’t have $$$ and the judge always goes in favor of the owner, never the tenant😡😡

a lot of how the court responds to a filing is determined by the state/local laws and court leanings. But generally if you don't pay rent, the Landlord files for an eviction and then the Tenant can respond (citing the reason for not paying rent). A judge listens to both parties and makes a ruling one way or the other. But to say it NEVER goes in favor of the Tenant is definitely NOT accurate. Again, Arizona vs California courts have WIDELY differing results

Why be scared? We have the best law enforcement group in town...and its a felony if you come back (no more civil court stuff at that point)...the Tenant made out - they got a year free...at this point in time everyone else is just doing their job and trying to move on!
