❤️ When he gives us a new Documentary I say to hubby “Oh Good! This is what I’m doing tonight!” I make an evening of it. I really do. Cup of tea, get a candle going, the lights are low. LPR- this was so interesting, and I do love your Documentaries (though they are very tragic). ☹️ Officer Brailsford gave me a sense that he has a bit of a “rock star” complex. Now, I respect the Police. But he seems without a hint of humility or compassion!

My jaw absolutely dropped when the jury came back with either and/or both of their verdicts being not guilty! This could so easily have been avoided when he was on the ground, the woman had already been detained in handcuffs, and they could have simply walked over to him (especially seeing there were so many of cops, so some could have obviously stood around with their guns still pointed at him) and handcuffed him. This cop, no doubt, was and had been on a power trip. BTW, nice engraving he had gotten there on his gun... not professional at all. And now he is set for life at the expense of the taxpayers without even having to work for the PD. What an absolute smack in the face to Daniel's family. My heart aches for his little girls especially. Glad his parents at least prevailed in their civil suit, and I'm hoping the same happens for his common-law wife. Never heard of this case, and you did a phenomenal job of covering this. You had my attention the whole time, although I did have to of course just take a couple-minute breaks for tasks around the house. Anyhow, so glad you uploaded today... it was well worth the wait, just a phenomenal job all around, so thank you and hope you have a wonderful rest of your week! See you in the next one, sir.

Shooting someone that was obviously unarmed and completely overwhelmed with the situation would be unthinkable in germany. We may have some rude officers as well sometimes, especially in the bigger cities, but none would go so far, ever. The situation escalated when the officer simply gave him too many instructions. I work in the costumer service and see it on a daily basis that when i give too much input at once, ppl may not be able to follow and stop listening until i break it down and repeat the current step serveral times so that the costumer catches up again. This is was a massive flaw by the officer. He caused a problem, put the overly stressed victim in a situation where he couldnt follow instructions and i really have the feeling he was like "aw fuck it, lets shoot". This man is supposed to be trained to handle these situations. And Id consider make a scared civilian follow my commands as the absolute basics. I cannot stress enough how unacceptable this is.

Damn that stressed me ME out I was on edge scared to death to make one move while watching that. Imagine having guns pointed at you while being screamed to not make one mistake of moving or you'll be blown away. Being put in that stressful situation I would automatically be confused and I would probably accidentally move out of nervousness. And some people wonder why people are scared of police. It's cause of shit like this.

The video of Daniel’s death is one of the most upsetting, appalling things I ever witnessed. We need to rethink the use of deadly force by law enforcement in this country. Understand being an LEO is dangerous, but shooting someone 50 times as a matter of protocol because you briefly can’t see their hands is beyond unacceptable.

I dont at all agree with what happened, but he also did not perfectly conduct his manner as the police was ordering him to do. This is a borderline case in many aspects, the police are trained to shoot a suspect if they think they pose a threat (can be other reasons too) Daniel did not comply perfectly this is partly on Daniel but also partly on the police officer barking orders one after another, so no order can be complied with when it is expressively said. Daniel was acting in a very defeatist way that should not be constructed as a threat unless that threat is realized, that would be seeing daniel with a weapon. No weapon no one shoots because the police has the upper hand majorly, he is down on all fours, appears to slip and tries to right himself which is a very natural instinctual act, that you are programmed to do by your biology. He posed no real threat but a very minor perceived threat that the officer made the erroneous judgement that it was a threat. This doesnt absolve the officer by any measure, I am not saying that the police officer should have shot in a different way, what i am saying is that he should wait a split second in this instance before making those shots, to confirm that he posed a threat or if it was a mistake. Its easy to just see and react emotionally, im not saying you did that by the way, but the reality is somewhere in between our emotions and our thoughts. We could justify this killing by ignoring our emotions and that is clearly wrong, We could also say that he did comply (which he didnt) on an emotional basis. But the truth is somewhere in between.

As always, this documentary is top notch and full of unbiased information presented in such an interesting and straightforward manner with no extra drama. I love your style. I've watched every single episode, just on TV, so no commenting for a while. This episode however, needed to be commented on. ***SPOILERS*** This episode had me yelling at the TV for the last 30 minutes. It was interesting business as usual, a bit of an introduction, a bit of background, then the police video began. When the cop starts to abuse the bejesus out of them as they finally emerge from the room, I began to get a little mouthy myself. I mean, it's not like they leave a hotel room and suddenly face multiple heavily armed cops who are yelling at them. Who would think in a situation like that, that abuse and threats could end with one party being shot? I understand being firm and direct at first, but the poor bastard was OBVIOUSLY not being threatening and he was co-operating as best he could while filling his shorts. When the shots occur, that's when I really started yelling. Woke up my poor puppy. From that point on, I was disgusted, but unfortunately not surprised, by the subsequent events and the American justice system (not that I think the Australian justice system would have been any better). Ohh, the language hurled towards the television when the smug bastard is on the stand should not be used in polite company. I was really disappointed in the jury for letting him walk AFTER seeing the bodycam footage. At that point I just yelled, "What the fuck, America?" at my TV. The thing that really got me was the part of the autopsy report that was on the screen for a hot minute. To have been shot at that angle (back of the neck and upper back through to the chest) if he was reaching to pull up his shorts, his head would have had to have been down near the floor. He also had thin shorts and a shirt on, would a gun be that easy to hide? I honestly don't know the answer to the last one and it will bug me. Thanks for another fantastically informative documentary that will have me thinking over a lot of issues and have my neighbours thinking I'm batshit crazy.

This is such a sad case. I'm from the UK so I hadn't heard of this case before but there were two things I noticed. 1 the officer asked are you both drunk, and Mr shaver said no, because only 1 of them were drunk which was him, therefore he didn't lie. 2) "the officer ordered him to crawl toward them, and I personally would have put my hands on the floor and crawled in the same way as he did, they should have said "remain kneeling and use your knees to move towards us with your hands in the air." His shorts were falling down which is why he probably went to pull them up. It makes me sad and angry that in my opinion the officer got away with murder not only that but a nice pay packet and after previous unsatisfactory work ethics on multiple occasions, whilst Mr Shaver's partner and children struggle on in many ways I imagine. The Army have much more stricter guidelines and disciplines when it comes to shooting whilst in action. It makes you wonder how much protection the police in every country have supporting them. You get a worse sentence for insulting an officer than he got for killing this poor man. Excuse the amount I wrote, I feel passionate about this case. Brilliant work again though, thorough and informative video again, love your channel x

I really like how you played Doane & Brailsford’s bodycam footage side-by-side; it shows how narrow the field of view of the camera is. Doane’s footage hardly shows Brailsford at all, yet Brailsford is barely two feet to the right and slightly ahead of Doane…you should be able to see him! Makes me wonder why they chose not to go with a fisheye lens, except cost of course. The missed footage may not always be relevant, but I’d rather have it and not need it, as they say.

The cop talking absolutely pisses me off. I get it’s an extremely stressful job. I do appreciate the police. But how you deal with and talk to people can determine the outcome. I wouldn’t want this guy to walk my dog. I know y’all get treated bad for nothing a lot of times but you have to treat the next person you deal with with respect. Some may disagree with me but how that officer talked to them hyped up the situation. It hyped up the young cop that them. Im just as pissed at the guy “talking” as I am with the guy that shot him. RIP So so so sad

I entirely agree. In a different post, I said that I felt that energy of the police is a video game/Hollywood film/simulation. He was talking so aggressively, it was bound to go wrong. I also said that the threat IS THE GUN not the guy. When they've got the would-be offenders on the floor prostrate, why not first REMOVE THE THREAT? It makes no sense. They don't even ask him to confirm whether there is a weapon in his possession. Wouldn't you while you're interrogating send officers to sweep the hotel room? None of this made sense to me, though, this is an edited version of the event.

There were so many police, why didn’t some of them just approach the “suspects” when they were on the floor while the others left their guns pointed at them? Like, does anyone know if there’s an actual reason. Seems like nothing other than a power trip of the cop barking instructions for so long.
@mreko1566
@mreko1566 3 года назад
There are several reasons why they didn't do that. All the cops knew from the call was someone was pointing a rifle out the window. They dont know who is armed, or how many people are armed, and they dont know if theres someone else in the room that didn't come out who could also be armed. So the main issue comes down to crossfire. The hallway doesn't have much cover and the hidden doors are an issue that I already described. But yeah, if Daniel did have a gun and decided to pull it when one of the cops was coming at him, the backup police behind the approaching officer cant fire without risking hitting their own man.
@mreko1566
@mreko1566 3 года назад
The other thing you should keep in mind is they (the cops) did have a lot of firepower in that hallway, yet only one cop fired. In videos where u see multiple cops and an armed suspect they all shoot IF they see a weapon... and we know at least one other cop had lethal weapons drawn, and he was right next to Brailsford.

As always, very well done. This one will stick with me for a long time, I can tell. Sometimes, it's one of the smaller things in a story or video that I have a hard-time shaking. In this case, it's when the ex-officer barks at him to bring his arms up again after putting him behind his back the first time. Daniel brings his arms forward and, just the way he moves, you can see he is 100% scared shitless. All so very sad and so completely preventable. The ex-officer was on a power trip from start to finish. How many times did he bark/threaten that he would shoot or this would end badly or that Daniel would die before he murdered him? So very sad.

Good episode! I followed this case from the begining and as you stated this was the begining of the bodycam era, we had to wait years for the actual shooting to be released. I couldn't believe the prosecution wouldn't allow his widow to view the footage without signing an NDA... they're supposed to be on the side of the people... I still feel for Daniel's family, and I hope they're doing better now. I'll never forget the heartbreaking video his widow put out shortly after the killing, it's basically just her laying in bed in pitch black darkness, and all you hear is one of his young daughters in another room crying that she wants her daddy over and over.... the mom tearfully explaining that's all her daughter does now. Daniel's death was senseless... they got called out there because he was seen with a rifle, did they think he stuck it in the back pocket of his gym shorts, and it somehow remained hidden under his t shirt while they made him get on his knees to crawl?

The fact that this happens every day, and that this case wasn't national news for a week is just fucked. Now that I have watched most of the video, I have to say- amazing job. Absolutely top-tier in every possible way. I am very much looking forward to all of your videos and will be telling anyone and everyone about this channel. So good!

@@LPRPresents Thank you! I'm on to another episode already. Daniel Shaver, though. Just so far beyond the realm of anything acceptable. Just the way those hogs were speaking should've been enough to be fired 'IF YOU MAKE A MISTAKE- WE WILL SHOOT YOU' ...Man, STFU. The thought that there are people out there that say, "Should have followed their commands better. The girl could do it..." Makes me struggle with wtf this country even is anymore. As if the girl got away unscathed- like she's not traumatized. You can see it in her. They probably tried hard to charge her with something. Goddamn sociopathic cops playing Simon Says with military grade weaponry. Sick shit.

I have a question for any AZ resident that is a legal gun owner. I looked up that AZ issues CCW but they are not required so obviously they must have a sh-t ton of residents with weapons in the homes and/or vehicles. It must've been the fact that they pointed their gun outside a commercial bldg where innocent people were that warranted this response?? If I was in the room, I would most def would not have come out! Idk who's out there and haven't seen any badges and don't know why they're calling me out. Calling them on the phone was a better idea. I still would've verified with hotel staff that it was indeed police. Then I would've complied. Police were still absolute assholes. And then...the f'n sh-t show. Then how nice dude is to her after the big f-ck up.

Strangely, Mesa AZ is largely considered one of the safest places in America to live. I thought about including that in the episode but as I tried to support the data from the US Census, all I could find was countless incidents involving police misconduct.

Hate to critique based on a clip, but I hv to say that I knew it was going to come back NG because the prosecutor's examination of the officer was sub-par. Stick to the questioning til you get an answer. Get the Judge to instruct him to answer yes or no. If you've got a person on the stand who is not going to play ball, get them to read aloud prior testimony to impeach them. From this clip which is actually key testimony for a "beyond a reasonable doubt" conviction, you HAVE to have a forceful, clean examination. If I were on this jury, even I would have had difficulty understanding what the protocol is for the officers, what constitutes a break in that protocol, and the exact responsibilities of all the officers of that night were. They should have pushed the DA's office to retry the case (and they might have) and, if all else failed, filed a civil suit against the whole lot of them. Seems like a failure of the team as a whole. It appeared to me as an overly aggressive approach for the situation. What's more concerning than even that was the sort of "video game" / Hollywood film mentality that was going on. The police should absolutely not have reinstated this guy, and, in fact, should have suspended the whole lot. They seemed to be the one's that were "altered." Further, it's inconceivable to me why they didn't search the room after apprehension before doing anything else further. Wouldn't you want to first confirm the position/possession of the gun? In other words, wouldn't protocol demand that they identify the source of the threat and eliminate? The guy is not the threat, the WEAPON is. This would be a hard one to convict unless the prosecution laid out fully the parameters of police procedure.

Poppa Brailsford helped his son get off, probably called in a few favors. There’s no way that his son didn’t escalate that event to murder. And an innocent man, husband and father is dead. The guy was crying and begging not to be shot already. And he was a threat? No way. Cop was trigger and power hungry. Know his kind well, esp the attitude and slipperiness on the stand. Real well. This case upsets me. Hadn’t Jeremy been talking to him? Why didn’t he just call him and find out what was going on? It didn’t have to escalate to that level. Those people outside by the pool blew it out of proportion and Jeremy from the hotel didn’t handle this well either. It’s ridiculous. They could of explained what Daniel was doing there, he’d talked to them for a couple days! This was a senseless murder of an innocent man and even though Brailsford walked away clean, he does have Daniels blood on his hands; in his “heart”, he knows what he did. He has a problem with power and should not be a cop. Esp his kind of cop.

**spoiler alert** im at 22:58 & trying to understand why these cops are going in so damn hot. it looks like a military team. all of this based on a report of someone allegedly having a rifle in a motel room. ESPECIALLY when they're in an OPEN CARRY STATE! it's already outrageous and they haven't even gotten started yet.
@loveforeignaccents
@loveforeignaccents 3 года назад
@@trintdaddylandis Yeah, but look at what happened with the Las Vegas mass shooting, and that is an open carry state as well. And, yes, I know that happened after this did. I think they were just taking the utmost precaution seeing that it was a hotel; therefore, many guests, employees/staff whose lives might have been at stake. And it wasn't "someone allegedly having a rifle". It was an actual rifle in a motel room that a couple of folks saw was pointed out of his window. I would be scared shitless!
@trintdaddylandis
@trintdaddylandis 3 года назад
@@loveforeignaccents negative. they had absolutely no reason to think anyone was at risk. it was simply a report that someone saw a gun through a window. those windows don't even open.
@loveforeignaccents
@loveforeignaccents 3 года назад
@@trintdaddylandis Check your facts and/or listen to the video. At 16:04, "Daniel and Luis point the rifle barrel out the window." And at 16:51 the hotel employee reports to 911dispatch "pointing a rifle outside of one of the windows in our building." Both of which obviously indicate the hotel windows are able to be opened. Wikipedia also states, regarding this case, "a rifle had been pointed out of the window of Shaver's hotel room."
@trintdaddylandis
@trintdaddylandis 3 года назад
@@loveforeignaccents even if they thought the rifle HAD been pointed out the window, their response was still not warranted. they had no reason to suspect anyone was in danger & this is evidenced by taking their sweet time to get set up to storm the room. too much police response. no reason 2 officers couldn't have handled that call imo. thanks!

This case is one that is necessary to cover, as it shows that though the problem of police violence disproportionately affects black people; it is in fact a universal result of our system of policing and the conditions precipitated by a country held hostage by the gun lobby and their political servants.

You’ve got a lot to learn about people in general with comments like “he’s not even black” and the presumption about your racist cop theory. Before you try to argue go read the stats about who’s more likely to get shot. Also learn about people in general. Every profession has good and bad. Cops is one of the only professions that everyone gets see someone’s awful mistake or the ugliness of a officer. How’d you like if all your mistakes were aired for the world to see. I know you are young. I just ask you try not to judge unless you know absolute facts. And when dealing with people nothing is absolute. Please for the future of society I hope people that think like you are not so quick to judge.
