The plaintiff prepaid the defendant for landscaping services, but the plaintiff changed his mind and hired someone else. The defendant said he would give him the refund, but he didn't, so the plaintiff is suing. The defendant says the plaintiff went behind his back and hired some of his employees. The defendant also claims he returned the money minus the work and costs, so he doesn't believe he owes any more cash

These guys are both absolutely nuts. Imagine being so complicated over something as asinine as paying someone for yard work. Imagine if it was over something important for big money.

So Robert, the defendant, lost the case. Judge Milan concluded he cannot charge Jack, the plaintiff, for the use of his equipment that “his employees” used. Since Robert chose to part ways with Jack, he had to return $300 of the monies given to him from his current contract with Jack….:I believe. Conversation with Doug -Robert believes Jack is conniving for going behind his back and using his employees for a side job. Jack doesn’t care too much because he hired new guys to care for his lawn. He wasn’t happy that he didn’t receive more money back but respects the judge decision. He believes Robert was sending him phony bills and was charging him for frivolous things. This is what I took from this damn near 40 minute slug show.

While I agree a lot of verbal somersaults are indicative of not wanting to answer questions, with these two (especially Plaintiff), it's also about an ineffective, non-limear thought process. I find it fascinating. This really can be taken as a lesson in communication and how quickly a listener can become exhausted, frustrated, and/or disinterested if you can't articulate your idea in a certain amount of time and don't know how to prioritize important information over frivolous details.

This case was so dull it practically put me to sleep. I've witnessed more excitement watching soil on the gardening channel. It was incredibly tedious to watch; it took two whole business days for the litigants to respond to a single question. I'm not sure I even remember what the case was originally about. Even during their conversation with Doug in the hallway, they seemed to carry on as if anyone cared to listen. Adding insult to injury, the case went on for an extra 38 minutes, as if determined to test the patience of everyone involved.

I understand why she went with the contractors amount for spring clean up. We have a landscape business and everything is going up faster than you can keep up- gas, fertilizer, labor, insurance, liability, printer cartridges, equipment, upkeep on the trucks and trailers, internet, phone- everything you need to keep a business going. I’m glad she believed him on that.

Bad manners to go behind the guys back and hire his people! When I was younger and doing my internship, someone tried to hire me for cheap and drop my boss, and as young as I was, I knew that was wrong. I was excited at first at the prospect of landing my first client, but I turned it down. Just plain wrong.

If he thinks his tools are worth 300, then he needs to get from his employees, I agree with her he didn't tell them to bring your tools, not responsible to pay you.
