Ok so we're dealing with estate theft in a way that our family members simply take possession of real property among other things. So my question is how can I take instant action against these greedy family members? With little to no resources.

My mother. Has in her will to take ownership of her house, is it that simple that I just take ownership and not go into probate? And will there be any taxes for me to pay?

My dad died with a home owned 100%. In 1997 he was married and divorced. In that divorce judgment it says my dad has full ownership of that property and his ex wife has none. Now 2022 with my dads death we found that he neglected to change the title, so on title it is my dad and his ex wife from 1997. The ex wife has not contributed to that house, has not lived in that house, has not gotten mail at that house for now 24 years. How does this house get handled for an asset? Do I have to take his ex wife to court to fight for ownership? Does having that judgment saying she isn’t the owner in 1997 help me? Or does she get the house? Help please

Hi Paul my mom passed away in December 2020 my brother passed away in May 2020 I was POA the bank said I could not be both POA and beneficiary so I told the bank leave my sister as beneficiary they did not unknown to me now we are going through probate the account is frozen I live in Arizona what a mess

Excellent discussion. You did not address the possibility of people carefully titling all of their assets so that there is no probate even though there is no trust either. For example, making sure that all investment accounts are Transfer on Death. Making sure that the house deed is titled in a certain way (eg:community property WROS) etc. I believe that there is a middle ground whereby you don't have to go through probate hell but you also don't have to form a trust. It takes some attention but it's possible. Any comments?

We agree with you. We have Beneficiary Trust Deeds on our properties and Transfer on Death instruments on our accounts. Can we talk about this???

My mother had a very small estate. Every bank account, investment, etc. had beneficiaries. And she had done a Deed Transfer on Death for her home. It was very simple to access and transfer everything. My mother had zero debt so no concerns about creditors needing to be paid. I spoke with an attorney about everything and he said that my mom was smart to do all that. We did not have to probate. He said it saved us several thousand dollars. However, if she had gone to a nursing home, the house would have been used to pay. I’m in Oklahoma.

we did the probate part for my mother for $1500 in TN in 2012. that's bogus wanting a cut of the estate.

spend the money and discuss it with a local attorney who has a good reputation setting up trusts. The best protection of assets is in a an irrevocable trust.

My dad have a will he passed over the dead of the house to my son with his name we did have public notary president at the time passed over the dead to my son the public notary was here for about one hour she asked him if he knew why she was at the house he said because he wanted to pass the house to my son the dead she was talking to him what will happen to the house if he will passed away he said he wanted my son to keep paying the mortgage and that he wanted to put the dead in he's grandsons name so the public notary asked him 3 times if anything should happen to him I need you to point at the person and say he's name Roy Jr my grandson to take over the dead to pay the house so again she asked him who do you want to take over the house dead and I need you to point at the person so he did 3 times At he's grandsons so she asked him to sign his name so she can take it to the court house so it will be filled in the court house to comfem that it got filed in court but my sister was saying that he don't know what he was signing went to court for the house and the lawyer said just to sale it and all 4 kids will get the money I asked the judge if my son was going to get reimbursed for all the money he put into the house he said yes he was going to get his money so know my sister is saying that my son and I need to pay the lawyer we didn't hire him my sister did she was in charge with he's finance and she don't pay any bills our the mortgage for 2 years so my son took over the mortgage payments know she is telling us that we need to move in order to sale the house my son paid the property taxes for 2 years we have all the mortgage payments in my son's name and the property taxes so was in wrong for the judge to not allow the dead in my son's name the house is under probate what can we do for my son to keep the house never one's did he want to pass the house to my sister
