I can't express to you how much you've helped me overstand the basics and the dynamics of many areas. DESPITE what many local attorneys proclaimed, I successfully had the 2nd DCA grant a Stay on a Writ of Possession and Writ of Certiorari.. I'm not a fan of attorneys, but I am a fan of YOU...

The point was never made. Should I choose a magistrate judge just because the district court judge is busy, what advantage that to me?

I think if you asked 10 different lawyers, you would get many differences of opinion. Typically, I consent to the magistrate. SV

In the eastern district court of California, all local county cases are prescreened by a magistrate to stop remedy against an entity.

Can a Magistrate Judge issue a "writ of habeas corpus ad prosequendum" pursuant to title 18 usc 2241(c)(5) on a criminal complaint not an indictment, not an information to a County Jail where personI is not serving a term of imprisonment but being held in one state for extradition to another state on probation violation charge when he has not been sentenced???

Never consent, it's a rubber stamp to dismiss the case due to overload vs fundamental principles of the Bill of rights or the constitution... Very slim pickings for federal civil rights attorneys lol you think that's by accident people 🤷 just like the lower magistrates playing jurisdiction games with you, The Magistrate's call you a CRIMINAL for CIVIL maters of law, it's up to you to know the difference between subject matter jurisdiction and consent to a jurisdiction... All the while the judiciary ignores such pesky civil rights cases because they don't pay the same commission... And when you bring up that old dusty forgotten contract to the people called the constitution they call you a terrorist... 🤷🤷🤷 Rule 73 you must consent to a magistrate means no jurisdiction to begin with you give power to someone that is a pawn to the actual judge... Marinate on that... The king always sacrifices pawns just so he/she doesn't have to be bothered with pesky civil rights cases... Eww that's so king Arthur days... Lol I hate all immunity, immunity is like someone who never was held accountable and is standing in front of you demanding you call them a potato and to respect their authority because they identify as Mr Miss potato and you have zero right to disagree... And that's final because I'm a life long God I mean judge... Basically

I curious how you got a phone in prison and got the internet 😂😂😂 I'm very sure you want a judge involved in civil rights vs a rubber stamp magistrate clearing said judges docket... And habeas corpus cases take over a year to even start, which is bananas, but this is why they dangle carrots for inmates to get a magistrate involved who plays golf with the judge not you... So, I'd definitely want a judge involved because it's 50/50 vs 100% nope... Lol but keeping it 💯

Consenting to a Magistrate judge allows for your case to move quicker.

@@ItmeFatima What do u mean they block civil cases? I filed a federal lawsuit and consented to a magistrate only because the judge they assigned is pro cop and the magistrate used to be a defense attorney. Plus they showed the rules that consenting to a magistrate allows for the case to move along quicker.

@@jaymorgan. not in my district...they purposefully misconstrue the complaints..if one cites premise a, they will cite premise b.

@@ItmeFatima lol The Court of appeals in my jurisdiction is good for misconstruing complaints. I've had that happen a couple times. Federal court is a different ball game. This is only my second time in federal court but this time I'm doing it without an attorney and I'm sure there will be some obstacle I'll have to maneuver through whether I have a magistrate or article III judge.

Magistrate Judges are called baby judges, that's just something a big wig patent attorney once said to me. It was his momentary biased opinion. Maybe he was just having a bad day - a general comment he once made. I believed him at that time, in his over generalization - or profiling... just that's maybe the prejudices of some judges and attorneys.. Studying tentative rulings of judges is the local, local, local, local rules.. His only credibility to me, besides being my friend; was that he had all of the California Federal District Ct. Certificates on his wall. I would not consent. I'm unresolved biased to a magistrate judge now. Hearings in Ct. (biased) expert insider's views. I have no experience or test for camparison. Layperson. I surmise that a District Court Judge is for the real BIG BOY MATTERS. Also, I personally like the the concept to make DEMAND for a Jury Trial best. That you have to make a DEMAND for A JURY trial is interesting to me the rules, a MUST to do so in Federal Ct. To each his own. I have a fair and balanced - naive or honest view of US legal system and I am keeping an open mind. Thank you again Attorney Steve for helping to educate me. I've learned a lot from you. Best KK.
