The problem is that The Atlantic "sourced" the comment and is protected by the 1st amendment with no clear direction on where the burden of proof rests. 35 years ago, I wanted to go into journalism. I loved the integrity required to live in that world - but as I started taking classes at the Poynter Institute, it became very clear that integrity was not required - and that when you cite your "source", even in anonymity, that's good enough. There was no longer a need to verify and validate stories. I got out then knowing that there was no more room for Walter Kronkite in journalism.
There's no "he said, she said" about the fact that Trump didn't pay for her funeral as promised. He exploited her and the family before the 2020 election for political gain. The funeral bill came after the election and he didn't pay it. The military and donations ultimately had to cover the cost.

He could absolutely sue for defamation. This was done intentionally because he is doing so well in the polls with Hispanic Americans, less than two weeks before an election, by a ‘journalist’ who has a long history of writing defamatory pieces about Trump, and he’s using one ‘anonymous source’ with no substantiation, no further corroboration, a family that is telling a completely different story, and he used the family by saying he was going to write a piece exclusively about their family member, but then lied about the timing of the article and came out with it at a strategic time, to directly affect the election. Trump has paid for MANY things behind the scenes for many people, for many reasons. There are scores of stories of people of all ethnicities that can tell a story about a time that he helped the, financially out of the goodness of his own heart, no one writes about those stories, but this narrative makes no sense, and a real journalist would have used corroboration behaviour to back up this one ‘anonymous source’. I could call the WSJ tomorrow and say ‘Kamala killed someone in a hit and run and laughed about it’ and that would be like them publishing a story the next day about it. This was done on purpose, to defame him, especially with a demographic he’s doing well with, and for the purpose of negatively impacting the election - he absolutely could sue.
The re-victimization of this family breaks my heart. It is unethically and morally wrong. I personally cried when I read what The Atlantic wrote because what we went through as a community at Fort Hood when Vanessa was murdered was so devastating and shook us to the core.
