Josh Sitzer, who successfully sued the National Association of Realtors (NAR) over real estate commission practices, has co-founded a startup named Landian. This venture aims to capitalize on the changes brought about by the lawsuit, which led to a $418 million settlement and the abolition of the NAR's "Participation Rule" that mandated seller-side agents to offer compensation to buyer brokers. The lawsuit, initiated in 2019, challenged the anti-competitive nature of the real estate industry, where sellers often felt coerced into paying a 3% commission to buyer's agents.
Landian offers a flat-fee service model for real estate transactions, allowing homebuyers to pay for services à la carte. For instance, users can pay $49 for a home tour and $199 for offer preparation. Alternatively, they can opt for a comprehensive package costing $1,799, which includes multiple tours and preparation sessions, payable only upon closing a deal. This model aims to reduce the high commission costs traditionally associated with real estate transactions.
The startup, which is currently in beta and emerging from stealth mode, allows users to import listings from any real estate site and engage with local agents without incurring commission fees. Sitzer's co-founders, Bryce Galen and Neal Batra, believe that this new model will lead the change in the real estate industry, contrasting with established companies like Redfin and Zillow that have thrived under the traditional commission-based system. Landian is currently funded by friends and family and is seeking to raise a pre-seed investment round

What if the offers are not accepted, do I pay again for my next offers? Who opens escrow, watches your timelines? Who orders your inspections? Who negotiates a Request for Repairs? Who calls the lender when the appraisal has not been done? Who makes sure your lender is on time, and you are safe to remove contingencies?

All this feels like the “disruptive” era of Zillow, Redfin, purple bricks, etc. And while they certainly put their stamp on the market, from an individual agent perspective - just keep your head down and take right action every day. You’ll be fine.

I agree. Zillow Offers fizzled as fast as it started. The disrupters don't get it at a granular level. Redfin has probably done it better than any of them and still isn't profitable and has horrible reviews.

So many have tried this and it has never worked and I don't think it ever will because this is a huge decision and experience, knowledge, expertise and hands on advocacy are crucial to a buyer being represented.

The discount brokers, flat fee brokers of the past have never made much of a dent because 1. The majority of transactions were done by full commissioned brokers. 2. The full commissioned brokers told consumers if you pay for a discount broker "you get what you pay for". Essentially the consumer blindly believed them. 3. There was no lawsuit going on when these other flat fee/low commissioned brokers started. Everything has changed as consumers are more aware than ever about these lawsuits in the RE industry and the changes. So this wave is much different. Consumers now are questioning why they once paid 5%-6% on a listing. So they will even distrust Realtors more than ever. The flat fee model (especially on the buy side) makes total sense because the buyers and agents incentives are aligned. *The most important fact is there is zero correlation between how much an agent charges and their experience/expertise.

Yeah let's see what all they do for that flat fee, and how much hand holding they provide, problem solving they do, negotiations they do, etc. I just had a client use a flat fee MLS broker for $500 and he literally did nothing for the seller. Her home stayed on the market for over 6 months, when everything else sold much faster. He did no follow up, and when things went awry with the buyer lender (not me) he did nothing to find out what was going on, and an extension to the contract was never done. This whole lawsuit is major BS, it's doing a massive disservice to the homebuyer and home seller. Realtors do a ton for their clients, I see this daily.

And his entire lawsuit was based on the premise that the fee to the buyer brokers was “not negotiable”… how is a flat fee company negotiable for a buyer now? It’s worse! As realtors, we don’t get paid anything until we close. With this platform buyers might pay $1799 and then decide they don’t want to buy a house at this time… awful for the clients! And it includes writing an offer, but does it include negotiating counter offers? I hope that he gets hammered by the media and that this hypocrisy is fully exposed.

I don't see where it was mentioned that the Landian Buyer's Agent will require them to sign a Buyer Broker Agreement. Wonder how that would work after the first five showings? Seems like something is missing. This is such a great video!

So he sued NAR and won and turn around to do exactly what the real estate market was doing anyways but worst. I’ve had clients that I’ve written over 15 contracts so. So he wants it to be fair to the seller and buyer but he’s in actuality making it worse for buyer and sellers. He should have just taken his money and invested it in stock. Leave the real estate industry alone. Matter of fact I can see someone suing him in the near future.

Infiltrators like Sitzler prey on Buyers who don’t know how much work goes into each transaction, good RE Brokers are juggling many balls and the amount of multitasking for the Buyer is greatly overlooked but these plethora of services can’t easily be quantified and line items of cost attributed. Hope that he and his type fade into the sea of you get what you pay for, and as for NAR they sold agents out for a big money grab, low standards that our industry doesn’t deserve.

I bet you They will tie in different fees for additional items and by the time you are done you would have paid over what you would have in commission. I mean a friend was looking for a home and the agent took her to 29 showings before she found the one she wanted. The agent was not charging for all the those. The guy starting this is not only showing his true colors and his intentions all along but will learn the hard way the day someone sues him. Hopefully he will have the money to pay.

This company may not be the game changer yet but to all of the Realtors out there please tell me an arguement why a commission should be charged on the buy side?? A commission only incentivizes the buying agent to : 1. Not look at lower priced properties since they will make less 2) creates no incentive to negotiate down on a price on an offer since the agent will make less. A flat fee broker who explains this will be able to take biz away from commissioned ones unless the buyers are at a 3rd grade level intellectually. So it doesn't matter that past flat fees brokers haven't worked it will eventually when consumers become more educated. On the list side it may not make so much sense to charge flat fees since I want to incentivize my broker to get the highest price.

Discount brokers will thrive under the new, unrigged process. See the first #5 below, & #6 below. Traditional brokerages will go out of business, or lower their fees. Our free market is BRUTAL. Old Rigged System: 1. Seller FORCED to pay buyer agent fee. 2. Buyer FORCED to hire agent, supposedly for free, which was a lie. 3. Which FORCED the seller to include the buyer agent fee in the sale price. 4. Buyer FORCED to pay higher home price. 5. Discount brokers FORCED out of business, as agents will STEER their buyers to homes with higher agent fees. Bottom line: FORCED = RIGGED SYSTEM New Unrigged System: 1. Seller not FORCED to pay buyer agent fee, but he’ll tell his seller’s agent that he will pay a 3% buyer agent fee, to attract more prospective buyers. This is the only way to keep agents from STEERING buyers AWAY from his home. 2. Buyer not FORCED to hire agent, but still can. 3. Represented 3% buyer offers will be lower than unrepresented buyer offers (due to the 3% buyer agent fee being an expense for the seller). 4. Represented 1% discount buyer offers will be lower than 0% unrepresented buyer offers & 3% buyer offers (due to the buyer agent fees being an expense for the seller). 5. Seller will accept the unrepresented 0% buyer offers (if received), otherwise, he’ll accept 1% represented discount buyer offers (if received), as they will be higher than the offers from the 3% represented buyers. 6. I see some potential issues with Landian. The agents doing the tours and the offers will be running on their Brokers' E and O, Docs, and Transaction Management, so there is potential liability. Could Landian be considered "Practicing Real Estate" without a license by the states? Only some people shop at Walmart.

It is a massive over-simplification of the purchase transaction from inception to closing. It is the minuatae and responsiveness that keeps things moving forward. I have always viewed my role as a project manager overseeing all the small details, third party deliverables, timelines, obstacles etc. You want nothing less than someone managing all the details with your single largest purchase while you still have to go to work everyday and plan a move.

Hey thanks for doing this video Tristan. So Mr/Mrs Buyer, there are certainly fee based solutions out there. As a professional real estate agent for 20 years, my feeling is this company is doing the least amount of work for you they can for a fee that increases as you move along one of the most important financial decisions you may make. My question is will they truly be on your side.

Ok so of that $49/ showing and $199/offer. How much does Redfin or Zillow get? How much does Landian get? And what is left for the agent? Let’s say the website gets 30% for generating the lead, so per showing roughly $35 flows to the company and let’s say Landian take another 30% so the agent is left with roughly $25/showing. And offer flows like this (rounded #s)$200,$140 ,$98. Yeah, I predict everyone involved with this plan will go broke in less than a year. The agents will loose money with every transaction. Hard pass from me.

sitzer doesn't care how much agents get because this was his plan all along to disrupt the entire industry, to file this lawsuit to create dissension, and then to leave the industry in utter chaos in anarchy. Then he swoops in as if he's the savior to protect the buyers and to look out for the little guy home sellers. If I had to guess, his next step will be to deregulate the industry where brokerages are no longer needed and agents won't be required to have a license.

We Realtors get paid only if the real estate property sale goes through. They charge their fees upfront and what they offer in exchange for their fees most likely will not get a property under contract, so the buyer may have to pay them again, with no guarantee it will get anywhere.

They also say that they are NOT a brokerage, but they have Landian Agents. How are these Agents getting paid? All agents have to be paid through their Brokerage. There is so much on this website that makes absolutely no sense.

I don't think this person has front hand experience because these are the first questions that came to my mind. Do they call back Monday -Friday 9am-5pm for a follow up "offer strategy session"? The house will be under contract with someone else by the time that happens. Its such a half-baked business plan. Sounds good in theory but will fall apart on execution. 🥴

Buyer beware, if you have to pay upfront for nothing; you’ll get nothing but a big bill to pay these flat fee companies. As a Realtor, I never had any buyer sign an agreement, or pay a fee upfront. We are now being forced to make buyers sign agreements that would create possible conflicts and confusion. The good old fashioned system we had is trust that is established. But now buyers have to realize fees they are responsible for; this is insane, but remember buyers, all fees are negotiable and we hope this NAR lawsuit is going to never finalize. Buyers will push back; I am sure very few buyers would pay this scheme flat fee with no guarantee of anything. This flat fee is like a big rip off and like a scam!

The guy doesn't understand how real estate works. Some buyers take months to find the right home thats why the percentage commission is so effective. A flat fee on the buyer side makes no sense especially in a sellers market where they will struggle to find a home. This company will be out of business in a year tops...

The bottom line is customer service period!!!! You cannot get that from a website or some bozo CEO sitting in a corporate office. You need agents/people that care about their clients and have the local expertise that clients need. You cannot put a price tag on an agents value to their clients. These clowns don't know the local markets and can't help them at all there. Who guides them through the process? Is Landian going to set up the home inspections and advise on those, I think not. I can't see any agents selling out to these scumbags, they are just in it to make money for themselves, they will not care about the people. I promise you, there is bigger money and people behind this and this is just another attempt to crush another industry and take it away from hard working people. Do some digging on these founders and follow the money.

How does Landian work for buyers buying from out of state and trying to coordinate a contingent sale. 🥴 As a listing agent, I would be having a frank discussion with my Sellers about my concerns of an unrepresented buyer trying to pull that off. This guy is so short-sighted and doesnt really understand the business. I feel bad for his family and friends who will lose money on his venture.

They are only offering a Tour & Offering session…. So they aren’t actually offering full agency depending upon state. Once a client goes under contract, I’d bet you there would be additional fees for additional services.

I agree. The buyers and sellers I have spoken with in the last 2 weeks aren't angry. They are angry at the people who brought the lawsuit and pushed more expenses on the closing statemwnt. When I explain it to them and that I'll be negotiating for their best interests until we can get keys in their hands they are ready to commit to working together. What sounds better? Paying out of pocket upfront costs for no service or no upfront out of pocket costs for full-service? It's a no-brainer for the vast majority of people.

Nothing has really changed though, there's now a form with the offer that asks the seller to pay the buyer's agent commission. That's it. Most sellers are going to do it, as it is customary. So no buyers are going to want to pay out of their pocket for any of that! Yes, I know that they DO pay it in the price they pay for the house, essentially. I don't think this Landian will take off, as most normal people have no clue about this lawsuit / change... and the agents already have a "patch" to fix it. It is almost trying to solve a problem that almost doesn't even exist.
