If this ever happens and they try to 'interview' me I plan to ask them to point out the camera, ask them to be sure it's working, and then sing "Hava Nagila", substituting "I want a lawyer" and "I want one now" for the original lyrics. They fit the tune very well indeed.

Also, people being wrongly arrested may think police officers will do the right thing when given proof that they're not the one who "did it". Anyone who didn't "do it" might think the phrase only REALLY applies to people who did it, and that they can convince the officers to help them out and avoid the court process by defending themselves to the *officers.* Nope. A police officer will *not* help you as an arrested person/suspect, *even if you are innocent.*

Canada has a right to remain silent. Its not called the 5th amendment, but I am sure they watch enough american cop shows up there that the intent would be clear.
@geocachingwombles I don't think that's the case in every state. I've been arrested at least 5 times and I can tell you that for the first 24 hours it's pretty worthless to get an attorney involved. They're not gonna be any help aside from advising you of your rights which you should already know. I've asked for my phone call for my attorney a few times when I've gotten to the jail with no success. One time they even said "if you can get your lawyer to come here at 2 in the morning by all means but I want the lawyers name.".
@@twesj I never seen anyone get a lawyer in my town. They simply go there and sit for a few weeks then see a trial and the public defender thats court appointed shows up 5 minutes before ur trial to get a understanding about what its about and quickly decide to be as useless as they can possibly be. Most people can't afford a lawyer for a criminal case. 5 tops out of like every 100 people id reckon. Which would make sense because most crimes are acts out of poverty like stealing because someone is hungry or desperate.

Genuine question: So what if you don’t have a criminal lawyer on speed dial and you don’t want to use the one thats provided to you? Like am I supposed to use my one call to call a lawyer and hope they high-tail it down to the station?
Same rules apply, do not speak until you get your public defender. Or have a family member hire a criminal lawyer for you. The only thing you need to say “hey uncle jimmy, I’ve been arrested and need a lawyer, this line is monitored so I cannot discuss this further over phone”

@@chuggeez_8851 Yeah, you can refuse. The officer has already made his mind of whether to take you in or not. The field sobriety test just gives them more evidence to use against you... Not to mention they are hard and people fail them stone cold sober all the time. The best thing to do is just to ensure that you have a blood (if you are sure you are sober) or breathalyzer test (if you need to argue uncertainty of exam sensitivity in court) at the police station, getting a lawyer, and fighting a false DUI/suing for damages.
@@chuggeez_8851 yup... like Night Shock Playz said...... . if they want to see if im drunk or not.... then do a blood test . . im not refusing.... im just refusing a "walk like this and look like this" test..... you can take my blood anytime you want . . . also.... at least in montana they must wait 30 mins after pulling you over if you have an open container . also, if you burp/hiccup.... they must wit another 15 mins (iirc) before doing a breathalyzer test (as that burp is going to be straight booe from your gut..... not whats actually in your blood stream.... which is what the law says.... its not GAC.... its BAC)
@@nightshockplayz5894 I mean it really doesn’t matter because usually you having a license means you give them consent to test your sobriety so even if you refuse it’s still a dui or something like it
5th doesn't mean you aren't arrested. It makes it clear you're choosing to use your right to remain silent/not to self-incriminate which is protected. If you just stayed silent without invoking the 5th that could be used against you in a criminal trial. Invoking the 5th cannot be held against you (except in some civil cases but the video is about getting arrested).
I learned after the first time I was ever arrested that honest is definitely NOT the best policy cause they will 100% use anything you say against you. And they can lie on their reports too.
Ask for a lawyer and invoke the 5th as soon as they start asking you questions. They are trying to get you to say or do something so they can arrest you. Otherwise, they would've already arrested you.
Just remember in some states you are required to identify yourself during booking. Separate laws from stop and identify statutes in the states that have them.
