Hi Mr. Devin! I have great news about my situation.Just got off the phone with SSA. She told me I'll be getting 1350.00 a month. She also told me that I could have been getting this since I turned 60. I say, better late then never! Thank-the Lord I'm getting it!! Hi Devin. Thank you so much for this VLOG. My wife recently passed away and I applied for survivor’s benefit. When I go a call from the SSA about my claim, I got what I believe was bad information. I thought they were wrong but with what you taught us AND downloading the OIG report you referenced, I am confident I am right. I will be speaking to them again next week but am now armed with knowledge.

Hi Devin Carroll, I am new to your videos & yes, I subscribed. I am curious as to if either me(age 60) or my mom(age 77) would be eligible for Social Security survivor benefits from my dad. He died at age 87. She has been married before to someone else but my dad never remarried. She is currently a widow. I am his oldest child & I am on SSI. What are our chances of collecting those benefits?

Great video Devin, I always recommend your video's to everyone when the topic of social security comes up. I have one question about the widows limit, I took my social security at soon as I turned 62, I seen you video about when your birthday is not your birthday, this is a very strange rule, and I'm happy to say my birthday is on the first day of the month, so I was able to get paid for the month I actually turned 62, and since social security considered my birthday the last day of the previous mouth, I got a small increase for delaying a month, most people think I'm crazy when I tell them this. Back to the widows limit, since I took ss at 62, if I was to pass away, it looks like my younger wife that was born in 1965 could collect 82.5% of what I would have collected at full retirement age when she turns 62 and 7 months, would this be 82.5% of what my statement said I would get at full retirement age years ago, or would cola raises be added? Thanks.

When your child graduate from high school , they take away the social security benefits, as a widower we should automatically get the Social Security benefits before 60 years , this is so messed up.. because the grovment don’t care how we are supposed to survive!!!

I am 51 years old my husband took his life and because he was not military then it is considered a foreseen death and so there for they told me I would never ever be able to get my widows benefits only military spouses are allowed to draw their spouses benefits even if their spouse took their own life due to the fact that social security says that a suicide of a miltary spouse is considered unforeseen death my husband been dead now for 16 years and I live how ever I can it really kinda sucks I feel it discrimination against non miltary wives but do not get me wrong I have the greatest respect for our military but social security sucks they also say that sucide is shameful so sad from iowa

You do get that survivors benefit before age 60 if you become disabled or in no way able to work no more because of health problem you will get that benefit check before age 60

Hi, @ Devin Carroll I retired October 2021 and my husband passed in February 2015. He was disabled and received disability insurance. I retired at 59 and I'll turn 60 this year. I have an appt with SS in August. I managed to save some money before I retired. I want to know if this will affect me in qualifying for survivor's benefits?

yes, they have many rules, i was surprised i could collect on him, also to get the surviving spouse check one must have been married to the deceased for 10 years...if they marry a second time the new wife can only collect if they too married 10 years...less than 10 years the second spouse gets nothing...

I have PTSD I was home and so was my 16 year old and 18 years old when we had to break through a bathroom door and listening to my husband during I had to make the 911 call myself he beans gone 16 years ago he killed himself and they r saying that my husband took his life to early by 7 years 1 month and 2 days to early for me to ever qualify and that I would never qualify for spouses benefits so sad from iowa

@@sapphirerings: The surviving spouse does qualify for benefits: While married at the time of death, and the marriage was greater than 8 months. Surviving widow/widower can claim reduced benefits at 60/disabled at 50/at any age if caring for minor/disabled dependents. Former spouses are only eligible to claim similar benefits if the marriage was 10 years or greater.

@@ltmundy1164 we were married 20years. i was badly burned almost 2 years ago by a fireball to back, arms legs, i was surprised when the lady in ss office told me i qualified...not a lot but it helps, they already had all the info, on file, i turned 65 in burn unit , so i needed change from ssdi to ss, i got lead poisoning from working in a battery factory...for 15 years...lead is an insidious poison, i have it in my bones, some tissues, we had 3 young daughters when he passed from pancreatic cancer, so i was kinda familiar with some of the rules, was 55 before i received ssdi, but i helped with the mothers checks, i worked until my body could no longer go, but the girls were adults then...very lucky the lead did not affect my legs, however the burns were bad, was in burn unit for over 2 months, went home with half healed wounds, just glad my middle daughter knew my past med history, the burn surgeons said the lead poisoning made my treatments and grafts diff from usual protocols...

Can u explain Railroad Retirement with spouse 32 yrs of service, age 62...born 9/1939...? He started RR collecting 2001 (Tier1/2 as he paid 6.2% into Soc Sec plus 4.2% into RR and made the 30 yr commitment. Then in 2018 deceased at age 79. Surviving spouse was also a working woman in different field, has 40 quarters as Drafter. But was only 59 at spouse death, she was not disabled & no minor child at the time. Should she also get estimate or do something with Social Security office..or just apply at RRB Railroad Board? They had a question about "PROTECTING THE SOC SEC OPTION" But how does one do this?

Dear Deven, If my husband passed away at age 30 and we were married for over a year and had. Daughter together am I also eligible for benefits as his spouse ? I currently have been collecting on my daughter's behalf but wonder if I have been eligible all along as well? He passed at 30 and I was 27 at the time of an accidental death.

Do you have a video on DAC on Dads records after he passes. I didnt hear you give info on Child in Care benefit for the disabled Adult if the surviving spouse is NOT disabled. Do they limit income also for parent in charge of the adult disabled child. I have gaurdianship.

that's where the GPO falls into place. it's like SSA sees 401k, annuities, saved retirement against you. the pension you received or have saved up will be considered unearned income.

I'm thinking of filing for widows benefits, I will be 60 soon...I am working and my question is do they adjust your income if I file in the middle of the year and made over the limit of 17,000. Do they start to calculate from the beginning of the year or when I file? And can I finish my year working and collect S.S as long as I stay under the limit?

I was 22 going to vocational school Mother passed I was I'm Jeep rollover lost vision in right eye I had last rites and came back to wouldn't I qualify under my Father(Charles Perpich first Lt WWII Marine hero) only got Ssi in 2019 I been blind and disabled since 1984. I am very confused. My mom just got approved for Survivor's yesterday. She just turned 60. My dad passed at age 73 in 2019 and he was retired. There's an X amount that she will begin to receive for January beginning February 2021. However, at the bottom, there's another dollar amount from April 2003 through December 2020. Does this mean she's getting a lump sum of the total amount from 04/2003 - 12/2020??? We are super confused as to where the second came from and what its for. Someone, please clarify. Do you have time to email back and forth a little? I’m berry worried!!! I’m 40 my wife is 39. She was disabled her whole life but we got married at 22. She was thrown off for years & just ot it back 2 years ago. She’s getting bad with a few rare diseases. We have 2 kids. 1 is adopted both are considered disabled. I have a question on Children who were disabled before they are 21 . actually my child was 16 ,and diagnosed as schizophrenia . Was marred 23 yrs . before divorcing his father , We were a military family for most of the marriage . I was not eligible for any military benefits . but my child would be if he could get survivor benefits . it turned out he was not eligible because he got married at 19 . they were married less than a year and he spent the next 3 years in a mental hospital . and they never saw each other again , he is now 37. they are still married . of course being on SS and a income of under 800 a month . My husband passed away in 2014. One day before his Birthday and five days before our 5th wedding anniversary I was told that I couldn't receive anything due to I made more money than my dead husband. Then I was told my by one of the SS worker told me that they should have given me at least 1/3 of what he was receiving but I did get anything.

Carrie Morgan yes you can switch to yours whoever is higher assuming yours is higher now that you waited but you are eligible for sure at 66 but I am waiting on 67 good luck

@@mima4392 You may be thinking of the 10 year requirement for divorced spouses. A surviving spouse must have been married for only 9 months to receive survivor benefits.

Question: im FRA and collecting my full benefit and my Divorced spouse died also after his FRA but I do not know at what age or when he began to collect his SOC SEC benefit...is my divorced widow benefit calculated based solely upon the amount of benefit he was receiving at death regardless of whether he began reveivong benefits earlier than his FRÀ?

Kajun, sorry for your loss. Based upon your info: Your late husband was receiving 79.65% of his full age benefit. You're eligible to receive that amount or the 82.5% max of his full age benefit, whichever is greater, but no greater. And that amount is subject to survivor benefits reduction, dependent upon your age. Best scenario for you: Max claim @ 62 years 7 months. Refer to graphics @ 7:00/8:00/9:40.

I would love to talk with you Devin!.. My wife died ..age 36 Nov 2008.. at the time our only child was just months old. My own convicted felon (1988) mother intercepted and lied to the SS administration ...claimed she was caring for my daughter including me living with her resulting in her stealing ALL of the survivors funds from my deceased wife.Still to today's date she receives my now 12 year old daughter's portion. I have never recied with my mother passed age 19 and briefly after the Marine Corp release in 1996. My mother took me to corrupt family court to get guardianship and remove fathers rights ...my wife's name was forged for consent. I have so much proof from the banks claiming this. Could you point me in the right direction ? I would appreciate any help.

My husband took his life 3 months ago. I have talk to Social security Office I needed know at the time I would get any money till they told me. I am 63 9 months they said they had to figure out how much I get manual because I have SSI an Social security I didn't know until I washed your show that I would get very little. Could you tell me what I would get?, He had 40 Credits at age 37 I get 770 an 42 please let me know if I need an attorney. Thank you for your time

I have a question for something I haven’t seen anyone explain. I have a relative that is a retired postal worker. He was drawing his pension and a very small amount of SS due to the WEP. His wife was drawing her own disability SS and she recently passed away. Her Disability SS was much more than what he was getting from SS because of the WEP so would he be entitled to get her part because it’s greater than what he’s currently drawing. Thank you

Government Pension Offset (GPO) rules may apply. Since his retirement is funded through Civil Service Retirement System (CSRS), he is subject to Windfall Elimination Provisions (WEP). Current postal/federal employees are enrolled into Federal Employment Retirement (FERS) System, and into FICA/SS. You should (with relative's permission) contact local USPS HR center or US Office of Personnel Management (opm.gov). Edit/addl: Employed under a collective bargaining agreement? Contact the national offices for the union that still represents him.

My husband collected ssdi and died at age 42. I haven’t remarried and I am age 62. Am I eligible for his full retirement amount if I wait to file at my full retirement age

My husband battled brain cancer in 2004 and he was 100 % disabled for 11 1/2 he collected his Social security until he passed away in 2015 at the age of 55. I will be 59 here soon so will I be able to collect the 82% of my husbands Social Security Survivors benefits when I turn 60 ? We were married 31 years and have no young kids. When I turn 60 and I start collecting my husbands Social Security Survivors benefits will I then be able to get married and still continue to collect the Social Security Survivors benefits or will I loose them if I get married? I heard if I get married before I turn 60 I will not be able to collect his Social Security Survivors benefits Thanks=)

A worker entitled to social security benefits under their own work and subject to the WEP reduction. Why would that same worker entitled to survivor benefits as a divorced widower, married after age 61 and after the death of the 2nd spouse, have to forfeit benefits of the 1st deceased spouse. The 1st spouse served 20 years active military, ten years on the military recall list after retirement, worked under the Federal Employment Retirement System for 16 years. He died at 55 years of age and never drew social security benefits. Why do the social security administration reduce my suvivor benefits under the GPO provision. There were no social security or other benefits due from the 2nd spouse.

SSA office told me when my husband passed that his benefits would go back to when he first started drawing in the 1990 s I am drawing SSDI. From my own SS. I am also raising his grandkids and tell me I can’t draw anything on his babies

If he received/had legal guardianship of his grandchildren. Or, possibly, if they are declared dependents on your/his annual joint tax filings. You could have standing to appeal: Show a history of ongoing care/support for school age minors. Challenge/dispute the ruling. Ask, the worst they can do is say: No.

I will turn 62 before my husband would have reached full retirement age. He had a much higher P.I.A. than me. Can I claim my benefits at 62 and then switch to his survivor benefit when He would have reached full retirement age?

Something I don’t think you addressed. My wife files on her own record at 62, I the older one and higher earner waits until 67. I die and my wife continues her benefit until 67 can she then file survivor benefit and get my full amount ?

Either/or. Not both. Tax considerations may come into play. Unlike SS, Disability/SSDI amounts are generally tax free.

My husband worked for GM over 22 years and recently passed. GM says his pension is for me at age 55 and will be $244. per month. This doesn't seem right whatsoever. He made over 65k per year
