@@mrbear1302 Incorrect. ESAs fall under the Fair Housing Act, and landlords CAN require a diagnosis and a Doctor's letter for the animal.

@@mrbear1302depends on the state. While a residence may not be allowed to keep them out, businesses can keep support animals out - unless the state has laws preventing it.

@@mrbear1302wrong. En emotional support animal is allowed for housing yes, but they are not ada approved as service animals. A service animal is trained to preform a task to help someone with a disability. A business can ask what the animal is trained to do but noting more. As someone who has a friend with a disability that requires her to use a wheelchair, I get so angry at people bringing their untrained pets into a store and saying they are emotional support animals and they can have them. NO you can not. It makes it so hard for people with legit service dogs. A trained service dog is ok because they will not go to the bathroom in a store, bark or snap at people and they do no damage to the business. Perhaps you should educate yourself on the law. AND FOR THE LOVE OF GOD, DOGS DO NOT BELONG IN THE CART. THEY ARE NASTY AND PEOPLE PUT FOOD IN CARTS. NOT EVERYONE LOVES YOUR PET

The problem are the people who SAY their dog is a service pet but really isn't. Had a friend who used to do that and her dog was terrifying and poorly trained. She really didn't like men. Kids made it nervous.

I’m assuming that’s why that employee at the bar said they will accept service dogs with documentation. To make sure it’s actually a service dog and not someone’s pet. But, just like the video said, that’s against the law, to ask for documentation on the service dog. Also people feel way too strongly about that Emotional Support Animals have the “same” rights as a SD. It also doesn’t help that there are ads on RU-vid (I’ve seen it a few times) and it states that ESA have the same rights as SD. By law, they don’t, ESA animals are only allowed in housing that doesn’t allow pets and originally, on airplanes, but due to too many complaints about ESA misbehaving on airplanes, they are now banned from flying in the area where passengers are (unless they can fit under the seat in a proper carrier and can’t leave that carrier, until they are off the plane)

Yeah I mean I do agree that's a problem. But we don't know that you can't look at somebody and say hey. You must be lying about your need for a service animal. I've definitely known people that I would say are very sussy, for sure.

Most emotional support animals are not trained to be in crowds. Service animals are trained to work in crowds. Too many people want to bring their pet everywhere but the pet is not trained. This has become a problem

I've only seen an actual service animal freak out once. My friend's seeing eye dog in response to said friend collapsing from a seizure. The dog was trained as a seeing eye dog, but wasn't trained as an epilepsy dog, so he was running back and forth trying to find help. Once I got my friend safely to the ground, I took the dog's leash and he immediately calmed down. Luckily, we were literally standing in a hospital waiting room at the time, so help was very prompt.

@@notright7 Exactly. Just like most humans. But even so, he didn't bark or jump or knock things over. Just ran back and forth looking for help. As soon as he knew his human was getting help, he called down and went straight back to "on the job" mode.

Can we bring back shame? People should be ashamed that they are taking advantage of a system, bringing their poorly behaved animals into a space, claiming ESA or service animal, which results in actually attempting to bar service animals.

Sharing public information like phone numbers and addresses is legal. If that business is inundated with calls and cannot operate because of their own actions, that’s their fault. Public information can be used freely.

Service animals are a relatively new concept and we were a much better society without them. I, myself, didn’t see one until the ‘90s because my school paid for a disabled educator to bring one, and no, they were not popular and I never saw one in the free world. Animals bring with them a disregard for public spaces. No business owner should have to clean shed, bugs, urine, feces, or anything that comes along with an unwelcome dog. No person should have to worry about being grazed or bitten. There should be no worry of property destruction, parasitic worms, or any unsanitation that comes with dogs. This is an ISSUE OF CONSENT. I do not consent to your dog. A business should not have TO CONSENT TO IT, EITHER. The first time I saw a service dog, I thought it was stupid, and I will continue to think it’s stupid, forever. It is a shameful concept abused by shameful people, and as a society, we should say ENOUGH.

My service dog has almost been attacked twice by fake service dogs and pets. I don't bring him into walmart anymore because I always see at least 3 pets inside. They are a danger to actual service animals which is why I'm buying a gopro to wear when I go out in public. I want to have proof of an attack so I can sue. I have a Rhodesian Ridgeback and Greyhound mix that has been owner trained and professionally trained as my service dog, and I will do EVERYTHING I can to protect my boy.

The guy in the blue shirt and the blind girl are 100% correct. There is NO documentation, NO database, NO registry that regulates service dogs. Documention CANNOT be demanded because it does not exist. The 2 permissible questions are accurate, and the ONLY questions permitted by Law. That said, they were also correct, any service dog can legally be asked to lea ve if they are being a nusance: barking, running around biting, jumping, deficating, urinating, etc. The ADA is a Federal office, and no State agency , or business owner can circumvent it.

I didn’t know about asking them to leave if they’re disruptive, I’m happy to hear that as someone who gets a lot of fake service dogs where I work. One was jumping up on the counter and jamming its nose into the bread shelf and trying to eat stuff, clearly not a trained animal. I’m glad to know we have the right to ask the people with clearly untrained animals to put them outside

@@breadcrumbhoarder You should give them one chance to get their dog under control. Tell them that if their dog is disruptive (or whatever they are doing per the ADA) that you will ask them to leave if they can't get their dog under control. The exception to that is if the dog is dangerous. That is an immediate ban. I would print up that portion of the ADA and hand it to them if they argue. Then if you have to call the police to trespass them, you can tell them the steps you took and have them removed legally even IF the person is disabled. Make sure you still offer the PERSON service without the dog.

@@shakeyj4523 thanks! This is good advice to have! Luckily that person stopped coming in after a couple times, maybe she realized her dog was too out of control or something. Most people who bring in a dog at least have it very well trained, even if they’re lying about it being a service dog, which I wouldn’t be surprised about. I don’t really mind as long as the dog isn’t disruptive, but the people whose dogs are jumping around, bothering people, or sticking their nose in the food make me really mad. Some people are so entitled that they have no problem making the lives of people with service animals harder just because they don’t want to tie they’re dog up outside or leave them at home.

A few month ago I saw a confrontation between a woman and a store manager in a grocery store. This woman had a dog that had taken some food item off the shelf, ripped into the packaging, and was eating whatever was inside. The store manager was telling the woman to take her dog and leave the store immediately, or else the police would be called. The woman was screaming about how they couldn’t make her leave because it was against the law. The store manager told her that he actually knew the laws regarding service animals, and that even service animals can be asked to leave if they’re not behaving appropriately - but he said that he didn’t believe her dog was a service animal in the first place. He asked what service the dog was trained to provide, and the woman kept saying he was there to keep her anxiety under control. The manager calmly explained the difference between support animals and service animals, but the woman refused to listen and kept screaming about her "rights." I have no idea how it was resolved because I moved on to another part of the store, but it’s people like this woman who give service animals a bad reputation. I’m a type 1 diabetic and for years I considered getting a service dog who could alert me to falling blood glucose levels. Continuous glucose monitors can do that now for far less money than a service dog, so I use those now, but I very easily could have had a service dog in the past. I would not want to have to deal with store owners/managers who don’t want ANY animals in their business because of bad ESA owners.

I sincerely hope you haven’t reproduced, because your children would be so terribly treated by you that they’d grow up to be as harmful to society as you are. Diabetes dogs actually save lives. You just hate anything you’re not intelligent enough to comprehend. That makes dogs better citizens of the world than you could possibly be.

Bar owner needs to change the sign to SUPPORT animal. I don't want to get attacked by a crazy persons "support" animal while trying to enjoy my evening, nor have animal hair in my drink. A service dog is trained and a completely different story.

The pittie caused thousands of dollars in medical bills for her dog, my roommate was bit by the pittie as well and had to go to the ER for a possibly fractured arm due to the pittie's bite, and my roommate also had to undergo a series of rabies.

If you get paperwork for an ESA besides just from your medical professional for something like for access to a home you will be living in, you were scammed. But yeah, regardless, ESAs aren’t service dogs. You can have a psychiatric service dog, though..

I hear radio/youtube commercials for support animal certification. It is not for service animals. The commercials even say “well, you can’t find a dog sitter? Take you best friend with you as your support dog. A slap in the face for true service animals and their owners. If all the animal dies is make you ‘feel’ good then stay home with it. If that dog is trained to detect a tremor/seizure etc. or to guide/fetch that is a service dog.

@@kell_checks_in You're wrong. Certain seizures have tell tale signs of when they're about to happen. If I can tell my husband is about to have one, I'm pretty sure a dog can be trained to. Like I said, depends on the types of seizures to which there are many different kinds of epilepsy.

​@kell_checks_in actually, your a myth. Seizure alert dogs like my friends dog is able to alert 15 mins in advance to hopefully get rescue med on board or at least get them to safety to have a seizure.

A bar-owner SHOULD BE ABLE TO REFUSE. If he or she doesn’t want to clean shed, worry about parasitic outbreak (intestinal or skin/hair), have unwanted grazing, assume liability for bites/pet altercations, have one’s property destroyed, or anything that comes along with hosting an animal, that should be in AN OWNER’S RIGHT.

I have an ESA and he goes with me most of the time but if it's a business that doesn't allow pets I don't take him inside. If I know I'm going into a place that doesn't allow pets I leave him home. Service animals are specially trained and need to be with their human.

@joannestark3023 the terms are NOT interchangeable. A service animal HAS TO BE SPECIALLY TRAIND, an ESA does not have any training. ESA is for emotional support only. ESAs are not allowed where most service animals are except living places. I only take my ESA where I'm legally allowed to.

@kell_checks_in I'm not addicted to my animal. He is not just an ESA he is my pet. Nothing wrong with having a pet. He gives me comfort when I'm alone in the car waiting for my family to return. I also have 3 cats in the home. If you think having pets is an addiction then, I have been my whole life as I grew up with many pets in the home. I take it you don't have any pets

I worked retail. I cannot tell you how many times these types of pet owners would put their "support" animal in my face while I was trying to do my job and expect me to fawn all over them! Made me sick! They had no idea if I was allergic or afraid of them. They do not care. It is all about their "baby." People who are truly disabled and need a service animal do not do that. Their dog is "on duty." It is very bad manners to approach a service animal.

There are some places that allow pets. Absolutely agree though if it is no pets, do it go get a vest just so you can take your badly behaved purse puppy into a restaurant.

@@vickiefinney6073I said something similar to someone with their pet in the child seat. She responded with “well, she’s my baby. Why wouldn’t I put her there?” I asked her what did she think would happen if the next person who used that cart had a kid that’s allergic to dogs sitting there. She told me that’s not her problem. I said “well yeah, it kind of is. Because you’d be the one to cause that child to potentially end up in the hospital. Or worse.” When she asked me how she had no clue that dander can’t be cleaned off easily.

My daughter has an emotional support animal. It literally kept her alive during the worst time of her life. She woke up and kept going each day because of this animal. It gives her emotional support and enables her to keep going. And you know what else? Her emotional support animal stays safely at home. She doesn't bring it on planes, she doesn't take it to work, she doesn't take it to restaurants. It legitimately keeps her emotions steady....but it's not in your face. Service animals are *needed* 24/7. They have a job they are literally trained to do. They must be with their owner all the time. Emotional support animals are entirely different.

I wonder if this is aimed at people who claim their pet is a service animal and buy them a vest off eBay to bring them places. A real service animal is well trained to deal with existing in public spaces and do their job but I've seen some people claim their pet is a service animal and the animal is eliminating where it shouldn't be and snapping at people around. If that is the establishment's issue, I think their approach is asinine and illegal but it's a bar so 🤷🏼‍♀️ I don't think this is for legal scholars, by legal scholars.

You would be surprised at the number of people who don't know or pretend they don't know about the ADA laws just because they don't like dogs or don't want to obey the law. It's not just about allowing service animals either, they also act dumb about work restrictions and asscessabilty.

IGNORANCE OF THE LAW IS NO EXCUSE! They will still be fined. And hopefully sued. It will put them out of business. How uneducated do you have to be to do something like this and actually believe you have the right to do it?! I'm disabled and this pisses me off! People just don't care about anyone else and their possible needs. This is DISCRIMINATION, plain and simple. Are they trying to keep disabled people out? They'll pay dearly with this one. Probably by losing their business. I doubt they can take a $50K hit and stay in business.

@@kelly73 There are no fines involved. The DOJ will likely write a letter, and if they don't correct, they will request training. If that doesn't get them to correct their behavior, the DOJ MIGHT sue. That rarely happens with small businesses like this. If they sue, it is usually for hundreds of thousands of dollars, and that happens to state and government agencies, not small businesses. You can read the cases for yourself. It's public record.

So what if the business owner is deathly allergic to canine animal dander and hair? What if that person has a disabling phobia of dogs.. **coupled with a heart condition? Is a disabled person's convenience more important than someone's LIFE? Personally, I hate dogs.. most dogs (ESPECIALLY medium to large dogs).. and so, because my Best Friends are all cows. One of my cows is missing half her face and 1 of her ears because a pack of dogs mauled her. She was the lucky one. They killed several of her sisters. Even little dogs can Stir up a herd of cattle and stampede them through barbed wire fencing. I don't care if you're blind. You still should not be able to force your animal on someone who doesn't want it there. I cannot put a halter on my 1400 pound pet cow and walk her to the grocery store (even though she IS my emotional support animal)- and why? BECAUSE people don't want her there. That bar owner does need to take down his sign.. and then go buy an air compressor, pvc piping, and about a 1000 dog whistles!

If a customer was in a wheelchair, you can not deny them service because you don't like wheelchairs. I have trained dogs for 49 years. I have trained and certified Service dogs and I have obedience trained several emotional support dogs and taken them in for their Canine Good Citizen test because even though there isn't much required in some areas for emotional support papers, I personally feel it's important that every dog be trained. However, a Service Dog is trained on a whole different level. There are people who can not function in the world without assistance, and that is what a Service Animal is for. I had a friend who wanted to go to college but had epileptic seizures sometimes every day. Her service dog, a German Shepherd, was the only reason she was able to go to school. A human couldn't have been able to tell her that she was going to have a seizure and to sit on the floor....but her dog could. It is a gift that some dogs can sense medical issues, and once these dogs are recognized, they are taught how to alert. Service dogs will stop their human who has a loss of eye site from stepping in front of a car, they can show them where the restroom is and they can even be taught to tell the women's from the men's because they smell different. ***** I will add, Service Animals are very expensive. It's about as much as a new car. You either fork out the money, or an organization might donate it. I'm a retired European German Shepherd breeder and donated the 2 that I trained. They were from litters I had and showed the right temperament and tested to be good candidates, so I held them back instead of selling them. I wasn't looking for pups to be service dogs but those 2 pups stood out, I had a friend that trained Service dogs come look at them so I kept them back. For me, it was my pleasure to do it. I have never been afraid of dogs but have always had an allergy to them. I get allergy shots. I'm sorry you are afraid of them. But the people that need them, I'm sure, would rather not have their disability. They would probably love to see the butterflies on the flowers or the cows in the fields. Maybe get up and run, or go ice skating, maybe not have the reoccurring memories and pain of war and the teammates they lost, or the pain of the auto accident they were in. Or not have a medical condition that might seriously injure them if they fell and hit their head or one that could kill them if they didn't take a medicine. This is what these dogs are for. They are life-saving, life changing....allowing people some form of freedom to do things that most take for granted. So, I ask you ..... if you cross paths with a service dog, know that the human with that dog for starters is very, very lucky they have that animal. If you are uncomfortable, politely ask to be moved to a different table, but don't make a scene. You could explain that you have a severe allergy but be polite because that person has an equal right under the law everywhere in the USA to be there with their service animal.

Let’s start treating people, lying about a service animal, as committing fraud. Conviction with punishments on a sliding scale escalating to felony fraud. Their conviction should also include ruling the person is unable to own an animal or permit an animal to reside in their dwelling under risk of higher fines and felony jail time.

I think they should change the sign, but I feel for them. There are so many owners that just buy a vest off Amazon and say they have to take the pet everywhere Which is one thing if they behave. WRONG. There is NO documentation from the federal government for service dog teams, NOR is it required, NOR is anyone allowed to ask for any. It doesn't exist for a multitude of reasons. U not understanding those reasons is NOT a valid reason for it to exist. Some stupid fake B's piece of blank paper is NOT what makes a dog a service dog. NOR do u need to see one to tell the difference between a highly trained service dog team and some fool with an untrained pet. NOR would it do ANYTHING to stop fools with untrained pets. NOR would it do ANYTHING but CAUSE MORE PROBLEMS for innocent people with disabilities who rely on service dogs teams.

There are myriad problems with this, as a handler myself. I’m deaf and use a hearing alert dog (signal dog or guide dog, depending on where you are). Training a service dog takes about two years. Because a professionally trained dog costs 10k-100k USD depending on needs of the handler, many handlers have trained their own dogs. The introduction of a registry would stop affordable owner training that can be as little as 2k-8k USD. I spent around 4K USD training my current deaf alert dog. I cannot drive for neurological reasons and traveling is rough. Having to travel to complete official examinations to register my dog would be nearly impossible for me. Not all disabilities are created equal and introducing a registry requires standards for the dogs to meet, which some people would fail to meet due to differing needs. My dog needs to work around horses and cats... but not all service dogs do. Mine needs to detect fire alarms, but not all service dogs do. Mine needs to be able to lead me to an exit, but not all service dogs do. Introducing a registry, and be extension standards for training, would mean an immense washing (forced retirement) of legitimate service dogs and would force disabled people into spending money they already can’t afford to lose. This is a hot topic within our community and the general consensus among legitimate handlers is, we don’t want a registry, as it would be detrimental to the already incredibly inaccessible environment we face.

There exists such a thing as “unjust laws” and if one doesn’t consent to cleaning up shed, welcoming the exposure of parasitic worms, assuming the liability for property damage, bites, barking, or slips and falls from vomit, feces, and urine, that IS PERFECTLY REASONABLE. I used to drive paratransit and never saw a service dog. NOT ONCE. Profoundly disabled people do not buy dogs. They are too busy learning how to actually manage their illnesses. This service dog TREND is for ATTENTION. I miss the days when those people were locked in institutions. I have HAD ENOUGH.

I agree that the establishment is WAY outta line with the signage. They should know better. However, I can see WHY they would do that too? I go into stores/restaurants CONSTANTLY and see people carrying around puppies/animals with them that are obviously NOT service animals?! They’re loud, misbehave, poop or pee everywhere and these people don’t care? They just turn a blind eye to it? So, maybe we need to start implementing some consequences for people who do this? If we can stop people abusing the “service animal” exemption by bringing in literally puppies/household pets, maybe businesses wouldn’t have to put up signs like this? Just a thought…

If an establishment does not enforce their no pet's policy, they don't have one. So don't blame the people, blame the establishment. Unfortunately a good portion of non disabled people are entitled D!cks, so they will continue to break the law and bring their pets into establishment.

It is usually pretty obvious when a dog is not a service animal. If they follow the guidelines on the ADA website, they are protected by law, but the business owners fear lawsuits if they are wrong, so they let it go. Emotional support animals are NOT covered under ADA, if anyone says their animal is such, you can tell them to leave, and have the Law behind you

I'm really glad that she highlighted a current problem, people defining their pets as "emotional support animals" and demanding the same rights as people with designated service animals. I've seen people take pet chickens into grocery stores and peacocks into airports. As a person with anxiety who knows the value of great pets that help us feel better, it's not okay to expose other people unnecessarily to your pet... and it can be traumatizing for the pet to be placed in the circumstances.

It's important to know that laws regarding ESAs and service animals operate under different laws and requirements. Service animals fall under the Americans with Disabilities Act (ADA). ESAs fall under the Fair Housing Act and are only legally relevant when it comes to housing. ESAs are not protected under the ADA.

Having a service dog shouldn’t be an issue for most jobs… There are certain workplaces, such as kitchens, that I think might be exempt, for health reasons. But those jobs are few and far between! (And are pretty common sense, really).

They claim I’m not a good fit but the reality is that they are not willing to hire a person with a service dog. They just won’t say it to your face, for fear of being sued... I’m not a liability in terms of being deaf. I hear partially and my current girl, an overly friendly husky mix, alerts me to anything of concern. Oddly, the one place I’ve been at for 2.5 years... is the school for the deaf. Which, frankly, I love. But when I had my previous dog, I was almost always declined for a job if I took her to the interview, yet I was hired if she wasn’t with me at an interview for the same position. She was a very small, black, friendly chow chow who was pretty much invisible in public when working.

I’m a simple guy but it seems to me that this, along with the cake fiasco years ago, is a different way to give a business a bad review and try to close it down. It doesn't matter if there r other bars in the area. The bar in the video broke the laws. And cake has NOTHING to do with this. The ADA and anti-discrimination laws have been in existence for DECADES. And a business that refuses to obey this country's laws should NOT be in business in this country. It's amazing how many businesses and/or staff in businesses, both in America and the UK (I don't know about other places) are completely ignorant of what exactly the laws are concerning service animals, and react very badly when someone tries to speak to them or inform them about it rather than being willing to listen, or even treat disabled people with with basic human respect. Sadly, in fact, many businesses owners and staff treat disabled people in general badly, not just those with service animals tbh, for example a branch of a large chain store local to me in the UK tried to ban anyone using any mobility aid from entering the store because they had one incident of one person with a mobility aid accidentally damaging something in the store. Then, when they were told by head office they couldn't ban all disabled people with mobile aids from the store they doubled down on the ban plus started a harassment campaign against the woman who had done the accidental damage! There is also another large local chain store my partner is afraid to go in alone as the staff always make nasty comments about her wheelchair being in the way the entire time she's in the shop

As someone with emotional support animals, it really upsets me that people will use them to their advantage and pretend an emotional support animal is a service animal which then causes things like this, my birds don't even leave my room let alone the house, and even with animals like dogs it's the same thing, if it's not trained to help you with a disability, then it's not a service animal, but can still be an emotional support animal that remains at home

Yeah. I feel bad for those who do need emotional support, and people use this category to abuse the system. It is not fair for those who actually need emotional support or for those who have to have a service animal, not just because I want to have my pet with me. No, I need them with me. They regulate themselves better in crowds, and you don't feel like you are getting stabbed in the heart wherever you go. But if you cannot train your pet, they should not be allowed to be emotional support pets.

You can ban service animals if you or a worker have an allergy. I had to do it a few times as a store manager and people flipped out, I even had to call the police to have someone removed and trespassed from my store. Every one of them threatened to sue lol not one person sued. I'm sure every lawyer told them the truth

Would it not make sense to have service dogs registered and the handler given some documentation for their dog? I think a state issued photo ID of the animal with a service animal registration number would be perfect and it doesn't disclose the handlers personal medical information at all.

And break HIPPA laws? Because that’s what would happen. Other countries do have registries for service dogs. The ones that do are very strict about who can get one and who can’t. Japan, for example, allows them for only 3 disabilities. Anything even remotely out of that realm and the person gets denied.

I've always been passionate about service animals since childhood bc I love animals having a purpose and the disabled becoming more independent so as I've been seeing the popularity of ESA skyrocket I knew it was going to eventually start affecting actual service animals and those who truly need them 😢 People in my area have even stopped trying to fake them as guide dogs and just straight up bring their pets into grocery stores, it's only a matter of time before the situation escalates and businesses are forced to do something. I just feel awful for those who truly need it who get caught in the cross fire.

There is NO such thing as "verification" (so if u r referring to paperwork or IDs) from the federal government for service dog teams to show to anyone. U can't ask for something that doesn't exist. And it doesn't exist for a MULTITUDE of reasons. U not understanding those reasons is NOT a valid reason for it to exist. NOR would u need to see any to tell u the difference between a highly trained service dog team and some fool with an untrained pet. NOR would it stop any fools with untrained pets. And it would do NOTHING but CAUSE MORE PROBLEMS for innocent people with disabilities who rely on service dogs. It is NOT the service dog team's fault that fools with untrained pets break the rules and laws, and businesses fail to do anything about it. So do NOT take that out on innocent service dog teams by demanding they give up their American rights. Business can ask the two allowed questions when it is not already obvious, that handlers must answer, is it a task trained service dog needed for a disability and what task is it trained to perform for the disability? No other questions r allowed. Handlers must then answer the questions appropriately. Refusal to answer those two questions, or not answer them appropriately, and or the dog inappropriately acting out and showing clear signs that it is not a service dog and is causing problems then gives businesses the right to deny them entry/service.

I take allergy meds that don’t work, so selfish people like you can parade your untrained mutt around with you while you buy produce. get over yourself and stop screaming about how allergies work when you barely have a grasp on the english language, much less something like the complexity of human bodies.

A lot of Service Dog handlers bathe their dogs frequently. I would go shopping one day a week, and would bathe my Service Dog the day of. People would be shopping actively and moving past each other, so time around them was brief.

Ignorance of the law is no excuse. The Americans with Disabilities Act exists because of people like this that discriminate against the disabled. Denying a Service Animal entrance is denying that disabled person service. Absolutely no different than saying that soldier without legs can't bring a wheelchair in your joint. Failing to accommodate the disabled in a public place is against federal law.

They need to start registering service dogs. 1) service dogs should be 100% tax deductible as a medical necessity 2) then they get a free ID so owners owner’s don’t have to deal with questions at all 3) that would eliminate fake service dogs Would require assessment, documents from the Dr just like handicap plates. Make it easy and once you remove all the fake service animals and emotional support animals things should be easier for everyone.

What's causing this reaction by businesses is people bringing their pets into these places and saying "it's my emotional support dog". As the newscaster said, "emotional support" dogs are NOT service animals and NOT protected under ADA laws. How do we change this etitled need for people to take their dogs everywhere they go? 1- Make it illegal to sell "service dog" vests on websites and in pet stores. The vests can only be obtained through the state certified service training center. 2- Shut down these "fill in the blank" certification websites. Make laws that if caught with one of these fake certificates, minimum fine is $250,000 and/or 3 years in prison. 3- Require real service animals to carry at all times state endorsed service animal certification or a special type of dog tag that can only be obtained by the state. 4- Anyone falsely stating that their dog is a service animal will have their dog removed from their possession and will be imprisoned for a minimum of 1 year.

the sign should say no 'emotional support animals' as they are very different from a service animal. A service animal will ALWAYS be well trained and well behaved as it is a part of the requirement for them to perform their duties as a service animal. If it is the law to allow service animals then there needs to be a nation wide certified training program that these animals need to pass to get documentation with a photo ID including identifying characteristics and micro chip. This will ensure these animals are well trained and not a danger to people and other service animals. A few weeks ago at our local grocery store a "service animal" defecated in the store and the owner of the dog did not clean it up. 🤢

I am glad they included the part about being able to ask them to leave. I always get flak for that when I say businesses can, but there needs to be a cause. Too many people think any animal is a service animal and do not understand they are trained to perform tasks, not accompany you on a trip (except ESAs, but that is another category with their own rules). Before I get more comments on how I am uninformed, we were looking into getting one for myself and all the requirements and responsibilities, due to worsening health and for rescue but could not afford the costs. Those who take a family pet and put some twenty-buck vest on thinking they can do whatever makes it harder on others. I do think there should be certification, to protect the owner, business, and ensure the trainers are "official", barring that Texas seemed a good compromise.

You don't have to have a dog trained by an "official". Granted, for certain disabilities, such as visual impairment, it's 99% likely to be trained by a professional trainer, but you are allowed to train your dog yourself. And some dogs self-train. My ESA has begun reacting to my low blood sugars.

The problem is too many people take their pets..who are NOT service animals..into stores now and that shouldn’t be allowed. Also pets that people claim are “emotional support pets” shouldn’t be allowed…”emotional” whatever isn’t a disability….no “emotional” things qualify for disability under the government disability law. You having anxiety or depression isn’t a disability under the law so you shouldn’t be allowed to take a pet inside a business. Only actual physical disability service dogs should be allowed in businesses….if you are blind or if you have schizophrenia (yes schizophrenia isn’t an “emotional” thing but a brain disfunction so it does qualify as a disability). I have even seen people take their pit bulls into Walmart….and pit bulls are NEVER used as service animals for disabled people and they are also a danger to the public more so than other dogs. So maybe it’s time the American Disabilities starts giving out documentation like a printed license for actual service dogs for actual disabled people so they can prove their animal is legit and so businesses can ban all other animals from entering. Many people also have dog and animal allergies….if the dog isn’t a legit service animal then why should people with allergies have to suffer from these animals? This woman wants to act like it’s an invasion of privacy to make sure her service animal is legit….yet she has no problem violating the rights of other people who have allergies or have PTSD from dogs. Businesses should have the right to make sure a service dog is an actual disability service dog and they should have the right to ban ALL other animals.

Not all service animals are service animals. More and more people are buying worthless "emotional support service animal" "certified IDs). They just pay internet companies for certification and often halters. These animals have no ADA protection and businesses and landlords can ban them. Real service animals are trained to do specific jobs. Under ADA, they can't be barred from any public place or business. Currently its very confusing for businesses and landlords because genuine service animals don't have "licenses" or certifications and under ADA privacy laws, disabled people don't have to provide proof their animal is a genuine service animal or tell what their disability is. However, they can be asked exactly what their animal is trained to do. When stating their animal is trained to do, business owners and landlords know this is a service under ADA laws and they can't deny entry. Emotional support animals have no training, no specific job theyve been trained to do. They just make their person feel better, safe, etc. There are service animals trained specifically to give emotional support. They're legit. Their owners can say they're trained emotional support animals. Non- service animal owners can't say their animal has been trained to do a job. Congress needs to modify ADA laws and put in penalties for people who falsely claim they have a service animal. Currently the untrained "service" animals are making a bad name for real service animals. That's why this bar owner put up that sign. Untrained animals wreak havoc in business or restaurant environments.

You just stated that ESAs aren’t the same as SDs then restated that some SDs are trained ESAs and are therefore legit( which is untrue). I’m not sure if your trying to say that some SDs are helpful as ESAs while being say a medical alert or mobility dog or if your confusing trained ESA for psych SD but I think you should really reword your comment cuz it comes across as if you train your ESA now it becomes a SD which it doesn’t.

For the purposes of ADA law, an emotional support animal isn't a "service" animal; therefore, this business would be perfect within its rights to keep ESA's out. They just can't ban real service animals.

There is no certification and there should never be certification. People shoplift and rob banks, and do all kinds of criminal activities ALL THE TIME. So do you think because people shoplift that you should be certified and have to show paperwork to shop? No? Then neither do disabled people have to be certified because non disabled people break the law.

People would abuse that law SO many times at the library where I used to work and we couldn't do anything about it due to the restrictions on what we were allowed to ask. There were dogs getting into fights with each other, growling at people, running around, and peeing on the floor inside the library and so forth on a fairly regular basis. If they got too far out of hand we could ask them to leave for being disruptive, but it had to escalate first, unfortunately. A lady got trespassed from the library after repeatedly bathing her small dog in the drinking fountain despite being told to stop (due to the health issues that posed) by multiple staff members. Then there were the people who tried to pass other types of animals off as service animals, such as birds and guinea pigs. I remember that someone got into trouble for letting a guinea pig run loose on a table in the library where other people were trying to read and study and so forth. Some guy brought a chicken into the library too and tossed it off a second floor balcony so that he could watch it flutter down into a crowded room below.

The issue is when businesses fail to do their jobs and keep those untrained pets out. If a dog is causing issues and showing clear signs it is not a service dog, or bringing in other animals that r not a type of animal that can even be a service animal (so anything other than a dog or miniature horse), or r bringing in clearly marked or verbally told as an ESA, and also if the human is causing issues with the dog, like the bathing in the water fountain one, then a business has the right to kick them out and ban them, and if u need more help, then call the police. The law is very clear on that. If ur business wasn't doing any of that, then the business is just as much to blame. Also, really hope that u definitely called the police on the guy with the chicken, not only is that animal abuse, but it is also disorderly conduct. Any of these people can also legally be banned from the location as well.

​@@carriehollyland3596 Because the library was run by the state government there was a lot of red tape that needed to be followed in order to kick anyone out and they generally needed to have three documented "incidents" before they could be trespassed. My boss tried to kick someone out after just one incident once (for a guy yelling racial slurs at other patrons) and the guy complained to some other government body and was allowed back into the library again because he hadn't been involved in three separate incidents yet. We had more "incidents" (as they were called) at that library then we had open days in the year and the police were frequently called. I wasn't at the library the day that the incident with the chicken happened but my coworkers told me about it. I did see plenty of dog incidents though. The only incidents that got people immediately arrested and removed from the library on the first time were the ones where people were getting in fights with each other, spitting on other people, walking around naked, breaking windows, openly masturbating, etc. Often the police would be slow to respond though, which meant that people would get away before they could be caught. It was a very stressful place to work.

​@@carriehollyland3596 It's on the state government for setting the laws/rules. As a public entity there are very specific steps that the library must follow in order to restrict a member of the public from using library services and everything needs to be meticulously documented along the way. If the library tries to trespass someone without going through all that red tape then either the police will refuse to serve the trespass in the first place or it won't be legally enforceable later. Trespasses also only work for one year so even someone who does something really egregiously terrible on a regular basis who gets trespassed for a year can still come back a year later and start the whole process over again. Things got a little bit better in that regard during the early pandemic because the governor had an executive order in place that allowed the police to arrest people after only one "incident" and not three, but it since reverted back to the way it was pre-pandemic. I don't work there anymore. I work at a library in another state now where the work environment is less stressful, but even here there are restrictions on when the library can trespass people they just aren't as rigid or complicated as that other library.

@@ARKdeEREH trespasses can be made permanent, and the police can legally trespass someone if the owner of the property wants them to, whether there is more than one issue situation or not. It isn't the law that is stopping the library from doing that. It is the owner of the library themselves that sets up rules that allow bs like that to keep happening. However regardless of whether or not someone had prior issues there or not, if a library knowingly allows an untrained pet inside when it is not a pet friendly location and that untrained pet causes harm to someone else or harm to a service dog team or distracts a service dog team and the library refuses to correct the issue at all, the library can then be held liable for that.

The business is responsible to assign another employee to help the service dog team. The employees with the allergies is not to stare at or touch the service dog at all (which u r not supposed to do anyways). And the employee can take their allergy or anxiety meds if needed. But the service dog team is still to be provided equal access and service. It is NOT the service dog team's fault that the employee has an allergy or fear. So it is NOT to be taken out on the service dog team.

@@carriehollyland3596An allergy would mean their throat could close where they have trouble breathing. In which case the animal should stay outside. Any dander and hair could cause a severe reaction which “a pill” would not work. You’re thinking of hayfever, maybe you should educate yourself on people with allergies and their conditions. People need more education on allergies and asthma and how they can help. Isn’t that what you suggest??

I always call bars with patios... if dogs are allowed.. my dog was just a sassy doxie.. a rescue .. who hated men.. and didn't blame her.. but I always respect others.. and never portrayed her as a emotional support dog.. even tho she was.. she kept me from committing suicide and she recently passed and I'm struggling ..doesn't help fee months a ago I was diagnosed with ptsd a d acute depression with anxiety because of my ptsd.. I cry all day for her.. I carry her ashes room to room ..

I love animals and they are one of the only things that I do truly love and they've helped me through some terrible times, they are loving and loyal, way better than any human tbh. I'm sorry for your loss, would you consider getting another pet perhaps, wouldn't take away the grief necessarily but it would be a new love to have in your life. Much love ❤

I dont blame any establishment for banning pets, people calling them service dogs. I wish real service dogs had a specific collar only able to be ordered thru agency every 3 yrs with dr paperwork. I have to prove my disability for my handicapped placard. Dr retired now have to start with new dr, but at least i dont expire for 2 years. Sad thing is the morons just bringing pet and calling it a service dog already know what the 2 questions are and how to answer.

I understand some people don’t want animals in their place of business or even dislike animals and therefore ban them. It’s their right. All I can say in that case is you better not do a lot of traveling abroad especially Europe. Dogs are allowed virtually everywhere including bars, restaurants, stores, etc. I was once in a very fancy restaurant in Paris and two tables over a group of Americans started complaining about the three dogs that were lying at the feet of their owners at various tables. They got so loud and rude about it the owner went over to ask them to keep their voices down. They said they didn’t want to eat in a restaurant where dogs were because it was “nasty”. The owner said that was fine and they could leave if they didn’t like it and good luck at finding a restaurant where dogs were not allowed in Paris. France is particularly liberal when it comes to dogs. It’s not the first time I’ve heard North Americans complaining about animals in public places while traveling throughout Europe. Personally, as long as the animal is behaved, I don’t have a problem with it.

I’ve been to Europe and never saw a dog in a food establishment. Maybe it’s a France or Italy thing. Fine dining in England and the countries I went never had an animal inside. Funny I thought it was a trashy American thing to eat near filth and animals.

Here in the UK especially in the nicer areas of London, pets are often encouraged to come in, with doggy treats and little water bowls, one or two people have brought cats in and of course most people either don't mind or fuss over them, as an animal magnet they often come to me. It's so nice for people and kids in the cafes as they might not have a pet at home, and most are well behaved and clean, unlike some screaming kids or rude loud boorish people who come in like the Americans you mention, causing trouble for everyone and ruining the atmosphere. Obviously if a pet is noisy then that's a problem but it's no different to a noisy person. And tbh especially cats are very clean. I'd be more likely to go in a cafe that is doggy or kitty friendly, but I'm not that keen on exotic pets coming in though if they are scary!

In Germany many restaurants allow dogs as well. It's common sense to only bring your dog when it behaves well tho. They don't allow dogs in supermarkets.

I no longer put a vest on my service dog. I’ve seen dogs that are simply pets in stores just acting like untrained pets with vests on. I’ve had people question why he doesn’t and I tell them it’s not required. Not everyone knows the law. I don’t mind answering questions of those who are truly curious and not being jerks.

Why can’t a business have rules that make THEM comfortable? Why are people with service animals so demanding! There’s LOTS of people who are not comfortable around dogs. Some have PTSD from dog attacks and so what...we should ignore them in favor of the person with the dog? Bs! If a business doesn’t want you there, for whatever reason, then go somewhere else! Better yet, open your own bar!

I have a Walking Assistance dog and I have had people try to throw me out because he was not a lab or golden retriever! He is professionally trained and certified. I now pull out a copy of the law and my phone and threaten to call the police! I shouldn't have to do that.

Actually, we got him certified by the county. I have the document. I know perfectly well that certification isn't required ( remember I carry around a copy of the law) but the trainer suggested it because he's an unusual breed for a service dog ( a large whippet mix). It was useful. Simply mentioning he was certified does not mean I was saying it was required, just that I had it. They also gave him a special tag.

I myself am so sick of seeing those people who get an online certificate so the can bring Puckie or Fufu into every public space. The legitimate service animals are trained very well. No problems with them.

I shop at very small, chemical-free/organic farms. I used to shop at a local place of a small family's and this lady one time brought her dog into the shed that they sold food out of. This woman has this dog in a harness on her chest, and she proceeds to tell everyone(because no one asked and she probably was nervous about it and knew people were judging her) that it's her emotional support dog, and she cannot do anywhere without it. She was with someone else too. It's one thing to have such issues, but it's another to be so rude and inconsiderate of everyone else. This woman could have had her friend purchase the food, take pictures and/or video/facetime the store to the woman with dog IN THE CAR. She had no reason to come out and shop herself. She was incredibly selfish and rude. I love dogs, but I don't want someone touching their dog an then touching my food. Idk where your dog has been, what it's eaten, how it's licked you, etc. Unacceptable. and to play it off like you're a poor old lady who needs this emotional support dog or else you couldn't function is beyond pathetic and sad.

I've been saying for several years now, that contempt and hate towards the disabled have exploded over the last eight years. But that's after years of many employers and businesses thumbing their nose at our laws, and authorities doing little to nothing about it.

I think part of the problem is that people abuse it and automatically state that their pet is a service animal, because it’s illegal to actually ask them to show that as a fact, so they get away with bringing their pets anywhere they wanna go. In a lot of cases, these are absolutely not service animals. There needs to be a way to legally ask if that is in fact a service animal.

If the dog is not housebroken, under control, or is disruptive or aggressive the store may remove the animal, Service dog or not. If stores allow pets, that is on THEM, not disabled people. Also, establishments CAN ask if it is a Service Animal, and what task or work it provides. They just cannot ask about the person's disability.

Regardless of our personal values, the owner of the place was breaking the law. What about the restaurant down the street that sees that? They will want to defy the law as well. I know a restaurant in my area that tried to do that.

Don't blame the bar owner, blame the entitled pet owners who purchase vest from Amazon and claim their pet is an 'Emotional Support Animal' and thus a service animal. This is so they can take their untrained pet into places animals wouldn't be allowed to go to for safety and hygeine reasons. Every animal, including my cats, can be labelled an emotional support animal, but they are not trained. Another one is animals whose owners claim are able to warn them of a possible medical issue. Again, this can be claimed without proving the validity of the owners claim. The place you see this emotional support animal crap being claimed is at Disney parks. The things I've seen are gobsmacking. Dogs dressed in costumes being pushed around in strollers and the owner telling the cast member that the dog can sense when the owner is about to have a migraine, really? Dogs of all sizes are there with the owners loving the attention they get. People with genuine service dogs make it clear it's a working dog and shouldn't be petted. I've seen dog owners allow their dogs to urinate and defecate in public areas, snappy dogs, nervous dogs and distressed dogs. But, while I've seen service dogs that are trained help wheelchair bound guests I've never seen a seeong eye dog because blind and visually impaired guests either have a friend or family member accompany them or a specially trained Disney Cast Member will accompany them to make their experience magical. The federal law should be changed to clearly state only trained dogs be allowed in premises like bars, shops and cafes and the owner be issued with an ID card with the owner's name and dog's photo on it and what it has been trained to do. It doesn't have to have the owner's disability on it. But, anyone claiming their animal is a service dog should be the one who is fined as that is fraud and leads to places putting up these signs, because if te dog causes a person to be injured who is to blame?
