He skipped and fled the state before he had a court appearance and was sentenced. He is a dangerous man.

Because he allegedly fled Mississippi after the accident...Sometimes indictment take time to file. He had a "BOLO" ("We think he did this, but haven't filed charges"), at the time of this arrest...This judge did the right thing. No bond, until Mississippi decides to extradite him, or his time for this offense is served...

Most likely they were waiting on labs results (as the breathalyzer is not good enough for use in prosecuting for felony murder in many places). Once the labs came back they officially charge him. He was probably arraigned for DWI right away and given a PR bond. Then he booked it back to Texas, promising to appear when his DWI case was ready to move forward. I will bet he had no plans on going back to face the music.

@@brentfarvors192 At the time of this appearance the charges were filed. (they don't issue a BOLO until charges are filed usually) Sometimes the indictments have to go before a Grand Jury before the indictment is finalized.

@@Jadecrest123 It doesn't sound like he had a trial yet, so he didn't flee 'before sentencing'. The way the judge and lawyer were talking, it sounds to me that there may have been some sort of paperwork error (that would explain why Amy had little information in the electronic file, including not even having when the case was opened in Mississippi).

Newborn sons, sick or dead parents are always tear jerking pleas. This guy is dangerous. He cannot be let out to drive like this again until all his cases are finalized and his sentences served.

you have to love how they're SUDDENLY conscientious parents (or child) with "immense responsibilities" the minute they're staring at jail. as if, somehow, those babies (or parents) weren't around before when they were doing this shit.

Watching the whole hearing, it sounds like there was some paperwork error on the part of the Mississippi court. There was little information in the e-file, and they couldn't even find out when this happened.

@@leward7788 Not a relative, but worked for a local law office for the past 25 years. These kinds of errors happen. People are not always charged immediately after a crime or accident, and since the file has so little info (including no dates) it may be a clue that this is what happened. Being in a different state can also complicate matters. I'm just guessing, but it does seem to be a reasonable possibility.

Even though the defendant says the most important thing is his son what was the reason for driving this way? It doesn't sound like he was under the influence of alcohol or drugs so driving this way and being sober I wouldn't feel comfortable having him on the same street as myself.

Don't they usually give you jail time for DUI with a death. He can sit in jail forever for all I care. Doesn't need to be driving.

In Mississippi the minimum sentence is 5 years up to 25 for each death. Keep in mind that the 5 years is mandatory, no parole before the 5 years are served. Now if he is convicted they will also bring up the pending reckless driving. That shows lack of remorse or acceptance of the consequences. For sure will decrease the possibility of a sentence on the lighter end

Exactly...I dunno if ur from Milwaukee.Wi. ..but I saw ur tag..I am ...and here if u kill someone while under the influence of alcohol ur Going in PERIOD...unless u can pay 500k...I don't think he can....and then he gets another DUI?!?!! Pfft!!!!

@@christianromero6604 well in this case not a DUi but a reckless driving. Same principal. I would be driving like a saint to avoid being picked up. I am from MN and sometimes it seems like they don't get their act together on getting charges done very quickly.

His lawyer did a good job of pleading his case, however when you are charged with killing someone while under the influence, and then choose to drive at 97 mph on public roads, it tells us you don’t really give a crap for the lives of others. Even if you do have a newborn son.

As I see it, the public defender's job in a case such as this should be to see that everything done in court is legal, not to find legal loopholes or give tear jerking testimony to make the criminal look better.

Sorry, that’s the judge’s job. The defense attorney’s job is to make sure any exculpatory or mitigating evidence and provisions of law are properly presented. The standard for criminal guilt is “beyond reasonable doubt”, not “having been accused of a serious crime”.

Just once I want see the public defender just leave their defendant out to dry and say "Your honor I cannot find any reason why this man should be allowed a bond or get a lighter sentence. I agree with the prosecutions recommendation."

The defense should request discovery on the radar gun to see when and how it was last calibrated. Many speeding cases can be thrown out with this simple defense in most states. Request all records pertaining to said radar gun, the manual, calibration details, how and when it was last calibrated. Radar guns have to be calibrated on a constant basis. Every time they're brought back to the station from a patrol in some cases. If it's not calibrated properly, or at all, thay brings into question all information it provided, making it inadmissible as evidence. I'm no lawyer, though. So, obviously ask your attorney about this if you ever find yourself fighting a speeding ticket. Protip: For speeding tickets, if you reschedule the court date, it will be less likely the accusing officer will show up. The court date on the ticket is usually a day the cop will already be in court for other cases. Rescheduling it increases the odds that the cop will be busy with other things and unable to show. Since you have the right to face your accuser in court, if they don't show, the charges don't go forward. Again, ask a lawyer about this. Or at least look it up on legal resources. Don't just take my word for it.

Request the radar gun calibration for the 97 in a 65 or the DUI fatality case? First, this is a bond hearing. Next, I don't think the radar gun being off a few miles will fix the 97 in a 65 and cutting off cars. I'm guessing the officers have that on camera.

@@kdkarr yup, some radar gun are on the dash cam of the squad car...most likely it was on during the chase and it showed how fast he was driving.

You can make that argument for say 10 over. For a 97 in a 65 as a reckless driving ticket that will not work. It is a reckless driving, not a speeding ticket. That said, this is for an incident after the DWI causing death. The excuse that he did not know about that specific charge is no excuse. He knew had had a DWI, He may have not known about the death. He still should not have been driving with a pending DWI regardless of the resulting death. (At least in my state if you are pending a DWI case you are not allowed to drive until the case is resolved) The judge did the right thing. I am sure that the other state had conditions concerning the bond for the DWI, such as not driving a car. Mississippi will be happy the judge is holding him where they can pick him up. At least this way they do not have to go find him. A question I have. Was he even allowed to leave the state of Mississippi while the case was pending? My other 2 cents. If you have a pending case for DWI, I would be driving like a saint while that case was pending. He decided to play the stupid card.
