***A civil suit is instituted by presenting a plaint. (Section 26),order 4,6. Place of instituting suit Section 15-20. Pleadings- order 6 Plaint -order 7 Written statement -order 8 *** consideration of plaint by court If court finds there is no cause of action, also notice limitation period then can dismiss a suit. And if finds reason then admit plaint. ***issue of summons Section 27,order 5 Writhen statement must be given by defendant within 30days if court want then can extends to 90 days. **if summon served but defendant absent then court order for ex parte decree. (Order 8,rule 10) If failed to submit written statement within specified time then court can pronounced judgement. Remedies Against ex-parte decree- appeal,review, set aside. Order 9,rule 13- can apply for set aside the ex-parte decree. If defendant comes within specified time with written statement then procedure ***production of documents by parties Plaintiff and defendant produces documents, evidence. ***examination of parties by court (Order 10) (Called first hearing) After examine court ascertain the disputed matter. After this stage court may direct for * mediation *arbitration Section 89 of cpc *** order 11 and 12 Admission If any party admit anything that need not to be proved. ***framing of issue Order 14 Identify the main point for dispute and frame issue. ***order 16, issue of summon to witness. Plaintiff's witness Defendant's witness It also includes order 18(examination of witness) Examination in chief Cross-examination ***judgement ***preparation of decree. Order 20 *** Appeal,review, rivision . **execution of decree.
