@@saudahmedsiddique7406 r Please note, it generated feeling of hate and separatism amongst Kashmiris without contributing to over all growth on country that subsidized almost 70 % of goods and services for Kashmiris. I was born in Kashmir and went to school and college in Kashmir and completed my professional schooling there. Children of politicians and religious clerks were admitted freely even with barely pass marks whereas merit holding Kashmiri pandits and lots of well deserving Muslims without political connections were held back. The chosen free loaders got their education free since education was heavily subsidized. It was free up to and including post graduation and professional degrees. The Abdullahas and Muftis and others freely looted the money coming in because of article 370. Muslims in general are heaving sigh of relief on account of abrogation of article 370. What else do you wish to know. I even posed this question to late Sheikh Mohammad Abdullah whose answer was how could I question his ‘wisdom’. I was one of his treating physicians during his frequent admissions to the AIIMS- New Delhi.

Federalism of Indian state is and always was a concession for the integrity of the country. Similarly the case of privy purses for rulers of princely states. The project was always about a strong centre. The check on center’s power is the people who are diverse. We are not USA in that regard. More like Germany.

Clearly some people have no grasp on what Article 370 actually did. It created a feeling of separatism and bred hate against India. The Supreme Court delved into whole matter and untangled the mess created by politicians like Abdullahas and the Muftis. Justice Lukar has very superficial understanding of the provision. Fortunately he is no longer a judge. Look at how the J&K assembly was constituted. Jammu was systematically degraded and all CM’s came from Kashmir province. The Buddhist majority in Ladakh was eroded too. I would appeal our non-Kashmiri friends to educate themselves about realities of Kashmir before indulging in high fluten utterances.

That it had to be done through the governor's rule under Presidential cover? You bypassed a people and their voice. That was the fundamental argument of this program. And the honorable Supreme Court fought the case for the government is yet another huge anomaly...and that's a polite use of the word. Even going by your argument, two wrongs made a right?

The basic question is, do we have any provision in the Constitution to make a new Constituent Assembly for J & K for some specific purse? I think you don't have any such provision. Moreover, where is the guarantee that a new Constituent Assembly, if made for this purpose, will agree to the abrogation of 370? The proposal suggested is wishful. BTW, one shouldn't forget that 370 was specified as "Temporary". Thus under no situation, it could be made permanent.

Let me address them one by one. Before I address your points, let me make a general observation. The guiding principles in a democracy are agreement by vast majority of the people, precedence, and natural justice. Now, to your points: a.) The Constitution of India can be amended by Constitutional measures, creating a provision for a new J&K Constituent Assembly. b.) The new J&K Constitutional Assembly may or may NOT abrogate the Article 370. That is NO different than any law of parliament. The law comes into force if it is approved. c.) Temporary does not mean it can or should be replaced by an arbitrary acts of the Executive (no matter how well intentioned). Should we do it, we run the risk of doing away with the checks and balances of the Executive, the Legislature, and the Judiciary. What we have at stake is the whole country of India. Personally, I’m not willing to do away with it. This is easier said than done. It will be long arduous process. It may take multiple tenures of government. Life of a country is orders of magnitude longer than length of human life. That said, you may have other, perhaps better, solutions. I would like to know them.

@@myfeedback572 The intent of GoI in abrogating 370 was to make Kashmir like any other state/UT. You are proposing Constitutional amendment to make a new Constituent Assembly for Kashmir and then telling that this new CA of Kashmir may or may not abrogate 370. In other words, you are trying to legalise the permanency of 370. This idea is strange. What were "arbitrary acts" of the Executive? The issue is, were those Acts of the Executive done as per Constitution or not? Using convenient words doesn't make the logic stronger. The bottom line is if you want to continue with 370, you can have thousands of reasons to support. But that doesn't mean that GoI did anything illegal or unconstitutional to abrogate 370.

Madan Lokur is part of the same justice system which has delayed payment of 22 years pending salary + retirement benefit to my father. So i don't have any respect for the so called Indian judiciary. It has always been faulty system. Our callous judges go on their months long holidays while people suffer and perish for no fault of theirs. My father is also in the state of perish. He's paralyzed now. So he can't even fight his case. We his family are not expecting he'll get his dues in his lifetime.

Well in 1991 kashmir was under president's rules. And the government of the time ( supported by the BJP ) refused to interfere in J&K . Just like Manipur . And refused to send CRPF when the entire Kashmir was asking for the central govt to restore law and order.

And when finally Mehbooba sent a fax saying we are ready to form the government, Satya Pal, a liar, said the fax machine was not working and everyone was on leave and he didn't get the fax so he dissolved the assembly, which is kinda joke. It was all a plan.
