Imagine a SWAT team raids a house-battering doors, breaking windows, and coating everything inside with tear gas residue. Now imagine the SWAT team had the wrong address. Who do think would pay for the damage? If you said insurance, you’re probably wrong. If you said the city, you’re probably also wrong.

Because the people deciding to fight the case are not the ones who have to pay for it. And they also don't face any personal consequences for fighting a case like this and losing. This must have cost the local taxpayers hundreds of thousands of dollars *but it didn't cost the prosecutor a single penny.*

Pretty much. The same laws that apply to the public do not apply to law enforcement. Thats how the system is designed. You should have little to no faith in the justice system at this point.

Technically speaking, it’s a correct thing to mention on their behalf, as the government should be issuing these compensations themselves, but the fact they don’t is another issue

Instead the insurance companies should be required to take the claim - BUT, they can go after the police for the compensation. Private citizens might not always sue and be determined enough to win, but Insurance companies will spend every last dime and minute recovering their losses

Also proves how insurance as a whole concept is a scam. not a single insurance in the world can monetarily sustain itself while actually providing the coverage they claim to offer. The fact that any insurance is government mandated should also be illegal.

@@vidshadow8919 , You do make an excellent point. However, consider what would happen if drivers were not required to have insurance for their cars. Some drivers cause accidents due to their own negligence or just being human. Not all of them are capable of paying for the damage they cause. is it really fair that their victims should bear the brunt of the costs? Or we can just mandate that anyone who wishes to drive must self indemnify by any means available, for at least $100,000.00 worth or even more. Then only the upper middle class and the wealthy would be able to drive. There are other, similar activities that also require insurance as well. There is a reason for requiring health insurance, too.

Mostly true. I do know a couple of good cops in my town. If I absolutely had to call th police I'd call thier cell phone first to let them know what was going on because these guys know me and I wouldn't get jacked and lied to by some random cop. Cops can be extremely dangerous!

A lot of this, IMO, is the romanticizing of CQC (Close Quarter Combat) in law enforcement and the military (Spec Ops community). There's of cool factor in doing these type of operations and dressing up in tacti-cool gear. Unlike, the movies, very few end up in gun fights like you would encounter in Afghanistan and Iraq. It's a necessary skill but must be used with extreme caution... for the safety of innocent civilians. Why do you think there's a thing called SWATTING? It's because they know how zealous the cops are to put on their tacti-cool gear and wreck havoc upon "the threat".

The sad part is it’s happening more and more not just swat, but police raids. It’s like half of them don’t even double check or use detective skills to make sure there where they’re supposed to be. It’s sad to see people who just don’t know their job anymore.

Tbh, that impatience/indifference (not sure what else to call it) being officially written into policy is an oddly recurring theme. It's not just door busters doing zero homework either, so many of the problematic random ID encounters on yt show exactly that also. Some rando seems sketchy and you think he bears investigating but you don't have RAS? Why not hang out and watch instead of baiting a lawsuit and escalating things immediately for ID? That seems like it would be a far more effective, safer for everyone and less expensive course, but the opposite seems to be the goal.

Nothing extra because they just use attorneys that were already on payroll. The city has attorneys being paid regardless of their caseload, giving them more work doesn't cost extra, at most it just means less free time while on the clock.

There's no reason an agent of the government should be able to enter your or any other building without notice or permission. For the exact reason that mistakes can happen to anyone. Even police are not infallible. That said they should have to check, recheck, and check again before carrying out a warrant. Especially if it doesn't require notice, which should be illegal.

Legal, Private Firearms Dealer in Norfolk County, Ontario, Canada was raided by Metropolitan Toronto Police SWAT Team replete with personal Ambulance. The Dealer was servicing a 'Patron' at the time in his home business when SWAT stormed through the doors and shot him quicker than he could verbally/physically respond. No reason was given for illegal, out-of-jurisdiction Raid. Man was murdered because he upset somebody in the Judicial System. Look that one up.

@@miramichi30 unlike you, im not afraid to fight criminals, i live in a crime ridden area no problem in a fight hand to hand, and most certainly no problem in using 2a dealing with intruders, muggers and house burglars. leos know there's crime in my are and they more often than not avoid those areas while harassing law abiding citizens. so spare me the high horse.

@@miramichi30 The problem resides in the fact that their fuckups cost the taxpayer and insurance carriers. Officers should be limited in how much financial liability they are worth. Once that amount is exceeded, they get terminated and their certification revoked. There is absolutely no reason for the taxpayer to employ fuckups, losers and sociopaths.

My neighbor had his front door kicked in by a SWAT team. They backed out real fast. He was a federal officer and so was his wife. Two police officers were arrested and it turned out the “tip” they were given was sent from a jailhouse phone by a gang member the wife had arrested a few days previously. The SWAT team didn’t have a warrant, didn’t check the address, didn’t do anything to make the search legal.

It is mind-boggling to realize that after 250 years there is no settled law in the United States. The same crimes and circumstances keep happening over and over and over and we decide each one Court by Court working our way up the ladder and each Court says yes or no and some of them contradict each other, anyway it's mind-boggling isn't it!.

After SCOTUS decided against equity theft, Arizona and Minnesota introduced bills to let them keep stealing equity by giving homeowners a deadline to demand what's theirs. Arizona shtting all over the constitution does not surprise me, but say it ain't so Minnesota!

When cities have SWAT teams, there's too much incentive to use them. I lived in Newport OR, and watched them use a swat team to evict a kid across the street. Insane.

Search warrants, particularly narcotics search warrant execution are notorious for unnecessary destruction of personal property. I'm a retired cop, and saw it many times. A warrant is executed and during the search the house is trashed. I mean trashed. Dishes raked from counters and tables and broken, drawers emptied on the floor and things getting broken and strewn about. We've left houses and they looked like absolute hell is left in our wake. I never liked it and argued about it many times. Thousands of dollars of damage. Children's rooms, clothes and toys were not "exempt". There is a way to search, and search efficiently and effectively without causing total destruction.

I can't even write a coherent reply to the material of this video that won't be taken down by RU-vid. I am not anti-government in any way - I pay taxes because they're my dues for living in a functioning society; understand that there are limits to my freedom and things that government needs to do that I don't like and don't want to happen, realize that policies can be made by people with whom I differ politically because they are in control of the process. That said, some of these things are so patently obvious and unjust it's nearly impossible to understand who is defending it. Thank you for your work.

Implied exception to the takings clause? Case needs to be sent to the USSC. Terrible argument that the gov't can torch my house and then leave me with the bill because the destruction was necessary. Who makes the decision that it was "necessary" should be a jury not an appellate judge.

That is a general problem. One of the earliest scenarios that I thought of is serving a search warrant on someone else who has the same 2nd Amendment Rights as the one serving the warrant. They have a suspension of Civil Rights, in that instance, but in America today, they take it much too far.

I live in mckinney and I’m not surprised about their swat team. They shut our neighborhood down and talked to me like I’m a criminal (the raid was 3 blocks away from me) and damaged our grass

An appellate court sua sponte making up a new argument should be an immediate grounds for appeal to at least an en banc hearing. You don't ambush the appeals process as they just bring in their own facts with no rebuttal. Especially when you have a Jury finding.

Did I get lucky? I sued NYC in 2013 in small claim court when city's Parks dept contractor destroyed my sidewalk while removing a large sidewalk tree stump, and won in arbitration. NYC Comptroller office played dirty. it waited until last week of an entire year, and denied my damage claim. It pissed me off so hard.

Going to the right house seems like it would be easy for LE to figure out. Just order a pizza sent to the address and follow the delivery person. I guess following the delivery person without losing them could be a challenge that SWAT might have a problem with.

I just talked to five officers from five different municipality and they all know the city will not pay for swat damages they have cards for citizens to call for damages it goes right to a law office of their insurance company the attorneys take the damage clame from citizens then tells the insurance what to say on clames over certain amount it goes straight to denial and lower than that amount a certain percentage is offered like 20% is original offered then negotiations above that amount if a attorneys are involved then your original amount may get paid but now you have to pay for your attorneys fees which is all most the same as what you were asking for

Are insurance companies forced into not covering government damages?? Seems odd to exclude. After paying the claimant,insurance companies go after the guilty party for compensation. Seems another way for government to be unaccountable.

It would be similar if a cop seizes your vehicle in the middle of a police chase in order to stop the suspect yes? So the cop wouldn’t be liable but the city/county would be liable. It’s preposterous that cities don’t automatically recognize their liability. I can guarantee that if the police destroy the mayor’s home in an identical situation, the mayor guaranteed would be immediately compensated. Or a city council member, or a police officer’s home, or the DA’s home. That is what pisses me off most about this. Is that they exclusively don’t compensate people they don’t deem to be important enough or people they don’t believe can afford to fight them in court.

the solution to this is easy, Police departments should be REQUIRED to have insurance in the event they break the wrong door down, and an increase on their rates everytime they claim. If they force me to have car insurance ill force them to have wrong house insurance!

I would argue that the best way to tackle this is for the FTC to step in and make a rule saying insurance cant exclude damage done by the government anymore. Make insurance do their actual job. Ignoring that tear gas is technically considered a war crime under the Geneva protocol why is it still being used against civilians by law enforcement in the first place?

Complaints to POST or whatever agency in that area, a complaint to the attorney general, of course an IA complaint, and finally a lawsuit. These last will require some resources, or help from some benevolent attorneys. Record and document everything.

Hmmm. Sounds like private property (her home) was taken for public use (apprehension of a criminal). Boy, I wish there were something that protected protected people from this. Maybe the 5th amendment does: "nor shall private property be taken for public use, without just compensation."
