The businesses do not get kickbacks. They hire tow companies to watch the lot to keep it clear of cars that park and don't do business with them. When the two company picks up a car, they keep all the money. It is simply a service provided to the business. Now, if that McDonald's manager is taking money, then he/she is breaking the law. A call to corporate McDonalds's would take care of that. These ladies should also file against McDonald's since they hired them. Then it would be taken care of a lot quicker and the employee would lose their job.
A lot of legitimate towing companies require cash because dickheads like to initiate chargebacks after the service has already been rendered. Just sayin'.
This has been reported on multiple times on the news. I'm curious why the IRS, the Mayor, the Governor, and the state congress have done nothing about this.
These crooks are always 2 steps ahead of the public and law. They need ro be swimming with the fishes to learn their lesson. When businesses choose to be indecorous, you show them if they FoFo.

Let me start off by saying Detroit is a very shady government, from the mayor in city hall down to these so called business owners. Every one has there hand out. Their justice system say thing. Their churches same thing. School districts, yep same thing. Everyone is going around overcharging to make sure all the crooks with their hands out get paid. Who says crime doesn't pay.
The tow company is ignoring almost every law already. Making more wont matter to them. Someone needs to enforce the laws they are breaking and arrest every single person working for that tow company and seize all equipment they used to break the law.
@David Benner they have to be getting something. There are other reports on this same McDonald's and same tow company. There's no way the McDonalds just let's them tow that many cars that quickly without having some kind of arrangement in place
Plus... That's a relatively new truck. Tow trucks and flatbeds are expensive... Between $75k and $80k for a rig like this one. This thing probably still has a bank note on it since it's highly unlikely to be paid off. Assuming he paid between $15k and $20k down, and his payments are in the neighborhood of $1,500 per month, after all the taxes, title fee, and all the other taxes and fees and shit that towing companies have to pay to stay in business, the odds are pretty good that there's still another 1-3 years of payments to be made. Nothing will be destroyed, scrapped or shredded... The bank will put out an order for repossession if he fails to make a payment. As long as he stays out in front of everything and pays whatever fines are levied against him, if and when that happens, nothing will happen. One thing that is guaranteed to not happen... The trucks won't be destroyed or damaged in any way.

Or better yet, give their business the death penalty if they refuse to pay. In certain situations the government does have the authority to either suspend business operations or force the dissolution of the company. I guarantee you that if they are not allowed to operate at all until they pay they will pay. Or were they able operating illegally in which case their entire business assets could get impounded and each individual working illegally would serve jail time.
The thing is this McDonald's and Towing company has been doing this for a while. I seen videos about this issue going back around November of 2018. I'm sure it has been going on even further.

I had this happen to me at a gym one time. The tow driver claimed that parking at the GYM was only 30 minutes. He had my car hooked up already. Between me and my gym buddies we "convinced" him that it was to his best interest if he released my car....if he wanted to go home safely. We had the upper hand because the last thing he wanted was for the police to come. He chose wisely that day!!

Had my brother and cousin hide in the back seat as a i parked and went into the McDonalds they play their mafia at, i have all tinted windows so as soon as 3 minutes , THREE fucking minutes passed by my brother's already sneaked up to the driver seat all ducked under the wheel, tow pulls up and my cousin taps my brother and he jumps up behind the steering wheel, starts the car and drives around and i run out the McDonald's laughing at the tow driver and flipping him off as i hop in the passenger seat. We drove off and i tell you that tow driver was pissed but was smirking at the same time. Fuck them, why the fuck can't the judge have a team of his court officers go and shut their business down?? This is bullshit.
We had this same type of problem in philly. The city got so many complaints and sued for the lack of towing laws thanks to the local news 6abc that filed the suit on behave of hundreds of people, they immediately passed a law say that a private tow company cannot tow a car under any circumstances even if its on private property unless it was given a parking ticket by the police or ppa first. At least three towing companies in my neighborhood alone have gone under lol.
That’s a crazy experience, I’ve never had that sort or problem I usually have trouble getting a tow truck to show up on a timely manner lol. But I’ve heard about unmarked tow trucks stealing peoples cars and holding them for ransom. Glad you stood your ground, one thing I’ve learned in this city is never let your guard down. That’s the reason I always carry even when walking to the store.

Why didn't they sue the McDonald's store. It was their property from which the vehicles were towed. I would have my attorney sue McDonald's faster than a speeding bullet going into the Tow Truck driver's head.
The only problem with that is that the restaurant typically does not call and ask for a vehicle to be towed. The tow truck operator is acting like a Maverick actively seeking out vehicles to tow for the money motivation

If they choose to enforce it or not is their prerogative, but they have to make it publicly known you're only allowed to be on property this amount of time otherwise you are trespassing

McD's profits from the deal, likely they get a few thousand a month to allow the towing service to operate on their property, and it's probably a cash deal so no taxes.

There was a video about a guy who turned the tables on the Bank of America by starting a foreclosure of one of the branch offices. Since this guy hasn't paid, perhaps they could foreclose his business. It's at least worth looking into.

I MADE MY COMPLAINT LAST NIGHT to my states Consumer justice department the police LOCAL TOW COMPANY CHARGED ME $342 FOR 4 MILES, EVEN WHEN THE CITY DOESN'T LET THEM CHARGE OVER $159! BTW this was 2 days before Christmas! This is such a wide spread problem between tow companies and municipalities using them for their services.

Its a franchise store the owner hired them They tried talking to the owner she lied and said it wasn't her. They took a 87 year old ladies car she couldn't get a cab so she had to walk home they told her it would cost 450.00 cash to get her car back. That's a racket the IRS should check his books.if he's towing all over town like that i guarantee all that money is not being reported.
Corporate licenses the franchise to the owner. If corporate decides the franchise is harming the brand image they will step in. With media attention it appears to be hurting the brand image in that area.
If I EVER went to any restaurant or fast food place that had a sign stating a time limit to park, I will take my business elsewhere.. If they'd rather rush their paying customers, then that shows how they are. Just my opinion.

Maybe if enuff people complain to Micky D's corp headquarters they will send an inspector to visit the place. Hopefully his car will get towed and he can ask the manager, as a customer, why his car was just towed when he was only there for 5-10 minutes. Just turn the tow company into the IRS & let karma take over. When a company demands cash payments for services rendered, I believe they are committing tax fraud or tax evasion. That is how Al Capone & many criminals were taken down.
I think the IRS has an online form to complain about fraudulent tax activity, if enough of us send in complaints we should be able to get some sort of ball rolling...

If Break Through refuses to pay, have the ladies get a seizure letter from the courts, then get a crew to take the door off Break Through’s office and take possession of all of the property as well as the trucks there. Everything can be auctioned off to satisfy the judgement. Don’t know how much the courts allow a person to collect for interest on non satisfied judgements. They did it to OJ Simpson and a Florida deputy that had liens placed against them.
I'd be willing to bet they own almost nothing or that assets are not in the company's name. Small claims court is unfortunately not very effective because the plaintiff usually doesn't have a lot of money and trying to collect on something this small can end up costing more.
If it has there name or is in there property they can take it and action it off, until the dept is played the profits go to the tow company if there are any.
Had a tow guy try to steal my Durango from a parking lot. Went to a business. Made a purchase then next door to get something else. Returned to see my truck being hauled onto a flatbed. Didn't say a word. Got into my Durango. Put it in 4 wheel and started driving my truck away while still hooked. The tow operator was screaming and banging on my window to "Stop You Will Destroy My Tow Truck" I cracked the window and assured him that he would unhook me or I will destroy his winch. I gave the cable a little slack, Jerked it tight as a reinforcement, gave him some slack and he unhooked me all the while screaming how he was going to kick my ass. LoL.. I drove off with my property intact and left him red faced before a crowd of on lookers..
I'd ask a judge to put a lien on everything he owns including the company and then I'd have the cops show up with a processing warrant kick his employees out of the building and sees all his trucks so we can't make any money until he decides to pay

We did that but as a prank and just drove off when the tow guy pulled up. But i like your idea better, drive up to the mcdonald's go inside and have a buddy hiding in the car that can sneak up and be ready behind the wheel. Call the police in advance as this mafia moves quick, as soon as the trucker shows up the police will be pulling up, have said friend take it from there in complaining to the police. This happened once, not as a bait but where a lady stayed in her car and called 911 and she wouldn't get out, they kept at her but she refused, Detroit police showed up and helped the woman drive off and told the mafia tow trucker that he couldn't do what he was trying to do. She caught a lucky break that a cop was close by, had they took longer to respond God knows what would have happened as these thugs are armed.
Edit to first say, great job as usual Rob. Companies like this get away with this stuff because they know the public is splintered, made up of individuals that will not get together and force the issue. Isn't this company and their drivers licensed by the state? Why aren't you filing complaints with the state and taking this evidence to them? They could impose fines and suspensions that the company and people involved would have to pay and deal with.
