She is one of the Founding Members of Nightwish; she gets royalties and legal rights to the songs.

Not sure that is true. The legal rights belongs to Tuomas as the writer. Under general law, there is no reason why anyone cannot go up on stage and sign any song - the only issue is if Tarja records an entire show with the intention of releasing it, ie Act I and Act II releases. In such a case she would need to get permission from Tuomas to include it on the album / DVD. The fact she wasn't forced to remove the Nightwish material from those albums indicates Tuomas (ultimately) gave permission.
