Taxes on Illegal Income

Income from illegal activities is considered taxable income.
The IRS says illegal income, including income from dealing drugs, must be reported on your tax return.
You can report illegal income in one of two ways.
If you stole money, received a bribe, or were hired to kill someone, you would report the income on line 8 of Schedule 1 where it says, “Other income.”
But if you earned money from an illegal business, like a money laundering operation, you would report the income on Schedule C.
This way you can take deductions for wages, rent, and other expenses of your business.
There’s an exception for drug traffickers, however, as they only get a deduction for the cost of goods sold.

Most of the big time drug dealers are already known as drug dealers by the authorities. So you're saying that they can and SHOULD file taxes on this income, plea the 5th, and not face jail time or fines for filing those taxes???

Do you know how often this is enforced?

I don't have any statistics on it. If the IRS knows someone has illegal income that they didn't report, the IRS will go after them. It's how they got Al Capone

But what are the legal repercussions that could be exposed to one after doing so?
@programking655
@programking655 2 года назад
Because enforcing the requirement that you must pay taxes conflicts with the 5th amendment, there was a court case a while ago which decided that you could list illegal income as from “undisclosed” source, and you’re good 😂

It's the best catch 22 ever conceived by lawyers. If you declare it, it's an admission of guilt ; if you don't it's tax evasion.

Think about the marijuana industry. It's still illegal federally even though some states legalized. They still have to report their income but don't get to write off the expenses. This has always been a thing. It's not just for joe selling the hard stuff on the corner.
