Teen Accused of Dumping Baby in Trash Faces Major Issue Ahead of Trial

Alexee Trevizo allegedly dumped her newborn in the trash after giving birth in the bathroom of a New Mexico hospital in January 2023. Trevizo is charged with first-degree murder, or alternatively abusing a child resulting in death and tampering with evidence. Her defense won a legal battle to prevent some of the evidence from being presented to a jury in her trial. Prosecutors are now fighting back, claiming the evidence is key and should not be suppressed based on patient-physician privilege. Law&Crime’s Jesse Weber breaks down what this means for Trevizo.

I have no sympathy for this girl who very much knew she was pregnant. I don't argue everything she has endured has been traumatic. Younger women *cough* teenagers may not be aware of it because of their ignorance which is why these type of crimes are more common with them. I used to work as a CPS worker and I in fact had cases where women delivered their babies at the hospital and they told the staff they didn’t want their baby and we were called. They don’t even have to sign the birth certificate. In one case the mother accidentally signed it because the hospital staff didn’t know what they were doing and the court sealed that birth certificate. Also what does Trump have to do with this? You guys stay deflecting, yeah you’re going to be in for a rude awakening when this man is elected because the way Joe is out here getting names confused and don’t know what year it is, it is becoming incredibly likely 🤷🏾‍♀️

Based on what I’ve read, the child was not stillborn. He had air in his lungs proven by the autopsy. He was wrapped in a SEPARATE trash bag, which was twisted shut, with other bags on top. As for her Miranda, she was not being questioned by the police, she was responding to her mother. The doctor stopped the mother’s interaction to refocus on health care. It’s my belief all that footage should be used.

She never told the doctors, though. She was caught, and the baby was found. She lied about having the baby at all and claimed she wasn't even pregnant tell the baby was found and presented to her. A breach would be if she told them, tried to get help and they called the cops on her. That's not what happened. It's a case to find a un-live baby alone. That baby was left to be thrown away and she went on with her plan to pretend it never happened. She full on committed a crime of murder and lied about it all.

He states it in the video. It’s because discussing what happened to the baby with her was mixed in with talking about her personal medical treatment from her doctor. It’s also an issue that the authority of the doctor was blurred with the police, both being present and communicating with her instead of separately. I’ve worked in healthcare for years, and I’ve never seen police and doctors communicating with a patient at the same time, ever. Honestly I do blame the cop on that because when I watched it the first time I knew it could potentially be an issue for evidence.

I think the primary issue is that she was never read her rights prior to her discussing what happened. The doctor had every right to contact the authorities, but the issue is she was incriminating herself while being videoed prior to being mirandized. Had she been read her rights, specifically the right to remain silent and the right to an attorney, she may have exercised her rights. I absolutely do not agree with her actions, but at the same token, she wasn’t disclosed her rights either.

⁠@@candicane1that may be, which would contribute to her not realizing she has a right not to speak to cops. The problem is she felt extra pressure or forced to make a statement because her doctor was in the room also asking. Her doctor should have or could have asked her what happened before cops there, then when cops arrived Lexi could then evoke her fifth amendment right to not incriminate yourself. Now I’m not sure but possibly because the crime of murder was committed the doctor would be able to make a statement of what Lexi told her.

New Mexico "grown woman." People should stop referring to her as a teen. It evokes a picture of a helpless "child." Legally though, she's not a child. She was 19 y.o. at the time, she's grown. She's charged as an adult, in big kid court.

A few of her friends have come forward saying she told them she was pregnant. I think this case really comes down to mental health issues in this family. I think both the mother and daughter knew she was pregnant and didn’t want to face reality. They are both delusional and need MH treatment.

There’s a video of her clutching herself going to the rest room and then the testimony of what the staff found in the bathroom afterward. The autopsy showed the baby was asphyxiated. It doesn’t matter what she said, but what she did.

Actually if it's past tense...they are not required to disclose confessions. They are morally obligated to report if you are threatening/planning to kill someone. Someone else's right to life trumps your right to privacy. If it's a confession of past deeds, it's too late to intercede so privacy holds.

Sounds like there is more to the story if they reported you to CPS- "arguing in a separate room" doesn't sound like a legit sole reason for a therapist to get CPS involved, especially for the crime of child endangerment.

The doctor was not allowed to touch her or examine her to see what the source of her lower back pain was from. I expect that if the doctor had felt the "baby bump" or done a vaginal exam then no one would have wondered and they would have found she was in active labor and was already partially dilated as low back pain is a common experience of women in labor. She only went for the meds like morphine and denied being pregnant multiple times.

As a juror, the big question I’d want answered…if u didn’t know you were pregnant, when u started to give birth in the bathroom, why didn’t u yell for help? Why not let the nurse come in when they were knocking? She could’ve told the nurse she didn’t want the baby, & didn’t want her mom to know. As a legal adult, it’s up to her who knows her medical decisions. Instead of even leaving the infant in the floor of the bathroom, she instead wrapped plastic around his face and stuffed him in the garbage…even if she hadn’t heard him breathing or thought him dead she gave him no chance to survive. She had chances to make it right and did nothing. Ultimately it shouldn’t matter what she knew beforehand, what she told her mom etc…what she did in that bathroom is all I would need to convict. I don’t care at all about her relationship with her mom, at the moment she was in the bathroom she was alone and there were opportunities to talk to the staff alone. I have an 18year old daughter, I would not only be horrified if she did this but sad for my grandson, which mom doesn’t seem to care about. They are both awful.

Doctors are mandated reporters so the concerning death of a newborn would be a reason to call the PD and they did, but the issue is what is said to the doctor is privileged by HIPAA. The doctor calls the PD and the evidence and the investigation done by the PD needs to lead to solving the case and prosecuting it and NOT the discussion had between the doctor and patient.

She handled that baby..she put it in a trash bag.. She SAW AND HANDLED her baby and threw it out..buried in the bottom of the trash bin and covered it with new trash bags on top.. She knew exactly what she was sneakily doing

For anybody, wondering why she never considered leaving the baby at the hospital is one, she didn’t know she could, and she never looked into other options and two, she knows that if her mother knew that she was pregnant or realize that she gave birth she would not let her daughter get rid of the child because it would make her look just as bad as her daughter who did not want the child. More than likely, the mother would’ve forced her to raise that kid she would’ve lost the rest of her life because of it and whatever and she had.

The fact the hospital had to get the police involved should not be covered under doctor patient confidentiality. Doctors are obligated by law to be mandatory reporters which is exactly what the hospital and doctors did. I hope the DA uses that argument in the Supreme Court hearing

This entire case makes me so sad I can't imagine throwing my own child in the trash as if they are disposable or are trash to me. Thats how she feels about her kid. I found out I was pregnant at 16 I was scared to tell my grandparents (bc I never grew up with my actual parents) anyways I told them bc I know better. How could this 19 year old girl do this to her baby. I was 16 and even more mature to know what to do with my baby. That girl is lying how did she not know she was carrying her baby for 9 whole months?! U go through lots of body pain and even start feeling the baby start kicking at like 20-25 weeks. She’s makes no sense, she KNEW and theres no denying it.

This case enraged me more than most. That poor baby.. suffocating and struggling to breath his only few gulps of air on this earth as the plastic bag smothers his face. Meanwhile his "mother" chucks him in the bin and dumps waste on top of him. Those were his last moments alive. Plus, do you know how thick and hard the umbilical cord is... She would have had to have possibly chewed through it .. This is pure evil
