"oh, huh." Imagine a prosecutor saying "oh, huh" when told that the state had unlawfully arrested someone. How many times in the past has the lawyer enforced a blatantly illegal covenant against poor people who just didn't know their rights? Very concerning.

Oh, he knew. He surely knew. There is no way on Earth he didn't know. If he really didn't know, he would have immediately and strongly contested the point, but instead he said 'oh, huh'. He was just playing the old 'let it roll and grab what we can get until we get called on it' game. That's some entry-level shyster action right there.

A person in that situation then has no business just thinking that “it’ll all work out” many cities are like this, I’ve done what I could to find a great house share where there’s private entrance, etc etc, all utilities included in a giant home for far less than that, where I live one bedrooms go for 2k minimum, I’d rather save money and not have this situation, and wait for the the right time to buy if it’s worth it, otherwise it’s smart to get a job where it’s possibly to get money for housing , like in healthcare, etc., it sucks, but one HAS to live within their means, things are bad enough if something unexpected comes up, living where one is barely able to afford rent, much less the utilities, is a recipe for misery and disaster, unfortunately.

@@livingcreatively1 $800 right now is cheap! average 1br in my area is $1100 plus utilities. I am on disability and don't bring in enough to cover even remotely close to that! and income based housing is average 8 to 10 yr wait!!

@@livingcreatively1 I live in a city that claims "affordable housing" is available for everyone. Avg apartment rent is $1400. I like many seniors here get around $1100 a month for social security. Affordable for who, exactly? MANY people here are working two jobs just to pay rent. RV parks aren't much better.

As Simpson stated that a $50 late fee for EVERY DAY LATE payment is unlawful. But you wonder how many tenants have actually paid that because they were intimidated to pay. Bad faith on the part of landlord.

Why? It's called freedom of association. Why am I not allowed to agree with my next door neighbor about whether we should match mailbox colors? Or arrange a BBQ that we equally pay for? And you think it should be illegal for residents in a condominium to get together to pool resources to pay for maintenance of common areas? You want the government to come in and shut that down? You're a tyrant. You should really sit back and consider whether you think that's the role of governments. How about you just not buy a house within an HOA? Easy fix, no constitutional issues. No tyranny of you telling others how they're allowed to live their lives.

After watching many landlord tenant proceedings, I have come to conclusion that unless you have a management company representing your interests, renting anything to anyone is way too financially risky. Who needs the hassle?

I don’t rent my properties out to renters anymore. I only use Airbnb and VRBO for short term rentals. I was burned several times by tenants and I will never make the mistake of trusting renters again. They will happily give you the deposit, first, and last month’s rent, then not pay rent for 6 month’s. They will declare bankruptcy to stop eviction proceedings. It’s a nightmare.

@@Gramatic69 Yeah and on the flip side a renter will pay everything every month on time reliably for years, fix up the house, do favors for the landlord, and the landlord will just abruptly raise the rent $500 and give you the notice of the rent increase on Christmas eve.

Well, if you're going to expand your business' industrial plant to boost output, and you are not yourself an engineer, you will pay an engineer rather than draw up the plans yourself. If you're not a mechanic, you pay a mechanic to install a new engine in your work truck. When something is vital to your business, you either have the expertise to do it right or you pay for someone else's expertise in doing it right. Otherwise you will not be in that business for long, and your exit from that business may well be painful and costly. And landlording is a business like any other in this.

@@KenyanBunnie Well the lawyer's job is to win, and no lawyer is going to offer information that would keep him from winning the case for their client. Lawyers are known for being shady so it shouldn't be a surprise. And if you're representing yourself in court, it's on you to speak up in situations like this, which she did, so I don't see the problem. If the lawyer lied and said they no longer have that information or something like that, then I could understand

As a landlord my advice to anyone who wants to remove a tenant is use a lawyer. Yes, it will cost you some money but it is money well spent, much less stress on your part. Plus you submit that cost at tax time for credit against the income generated. For an individual who is not versed in the laws that pertain to landlord, tenant agreements. Each State has different laws. First and foremost common sense does not apply, the laws are written in favor of the tenant ALWAYS.

Squatters can be really frustrating, especially when they have an entitled attitude, and I don’t understand why the legal system allows them such vast leeway. At the same time, I think it’s important for legitimate tenants to have protections in place, because landlords can be blood-sucking vampires haha

The sad thing is that this whole area of law is complex and fiddly and frustrating precisely because of a thin sliver of tenants and another thin sliver of landlords who try to manipulate the law to see how far they can go in exploiting it. Whenever one exploitable dodge gets shut down, these slivers come up with a new one. And then the vast majority of landlords and tenants who are straight-up and interested only in dealing honestly get caught in the added complexity.

Didn't you watch? She DOES appear, at the 50 minute mark. She DOES have valid issues. She got frantic at the first hearing because she WAS being mistreated by the landlords. Then everyone online jumped on this frantic woman. Maybe it's a shame on US moment.

WHO in their right mind would sign a lease that charges $50 a day for late fees???? Did they actually READ the lease?? If that is found to be illegal to charge $50 a day, previous tenants that had to pay that SHOULD be reimbursed the overage.

Don't take legal advice from me: if a rental agreement has an illegal term in it, it's better to sign the lease, and fight the illegal term in court if it comes to it rather than upsetting the landlord. The guy is paying $1700 a month for rent; that's a pretty clear indication that he didn't have many other options. Why upset the landlord by pointing out that one of their terms is illegal? Just sign the contract and refuse to pay an illegal late fee.

The courtroom is not a classroom for litigants. All these folks with handshake agreements, or "serving" folks by email, or making decisions to not move in for "personal" issues, just go to show why we have a legal process for these type of proceedings.

It's an issue of access to justice. If lawyers are so expensive and court rules so complex that lay people can't hire a lawyer or work out how to do something, that's an issue of the system being too complex.

$3800 RENT in the case where the woman never moved in. That's insane for rent. If that were your mortgage payment, you'd be living in one hell of a house even in Washtenaw County, which has some VERY nice homes/properties. Edit: NOWWWW I see what the real issue is after watching a bit more. HOA is involved. Don't EVER move into a home with an HOA. There needs to be a movement to outlaw HOAs.

@@Vaelosh466 Pfffffft! Maybe you can afford that, but most of us can't. In this case, that's RENT... not a mortgage payment. That's just throwing money out the window... and a LOT of it. For starters, your credit would need to be stellar to get approved for such a mortgage and you're talking about a house that's roughly $700k for a $3800 monthly payment over 30 years (for which you'll pay well over $1M and that's with a rate that's lower than the average right now).

@@kennywood6434 There are 3 of them splitting the rent though, that's the whole reason you rent a house. Yeah I wouldn't rent a house on my own for that much but between them it's $1267 a person. We're also assuming the 3 people on the lease are the only 3 living there, the other couple might have kids.

If enough people smarten up and shy away from buying or renting properties under HOAs, the HOAs will see both the market value of those properties and the quality of those buyers/renters drop. People learn about choices and consequences when the consequences hit them in the wallet hard enough.

It's bad enough they don't pay their rent but propping a child's face in front of the camera in a public forum is just disgusting. These two don't have the basic parental urge to protect their child. 🤦‍♀ And Judges need to start calling it out. She didn't need to be standing there, her husband/boyfriend can deal with it or put the child down.

Who the heck changes systems and does not carry balances and supporting information forward? If nothing else, they need a final DETAILED dump of the last 3 years and it should be at their fingertips. "We have to check the old ledger" is complete BS.

That was their attorney. He doesn't have the information at his fingertips like his client does, which is why the judge is having him get the information from his client and coming back to court. Courts tend to move slowly. It can take months and months, and sometimes years to get a tenant out of your property depending on which state you're in since laws vary by state

I'm not sure of how common that is, but I had much the same thing happen to me, but with a hospital. I had set it up for automatic payments to be made, with my payment information on file, but they changed their system but said they didn't keep my payment information on file, so I had to go in and give it to them again. Admittedly, it was more an inconvenience than anything but it seems to me that if they are taking out automatic payments, then my information must be in their system somewhere, and if the system is changed, ought to be moved to the new system.

So the attorney Jay is troublesome.. He is nit picking the Dari woman, and then he is the one who represented the company that had $50 a day penatly. If he is going to handle these matters, he needs to know the law better.

Seems like they are just trying to be made whole. Any expenses incurred at that address are the responsibility of the leaseholder for the time specified in the lease plus any damages.. seems like something fishy is going on, she’s using her credit for other people’s leases. The risk of which is being responsible for the property, the hoa penalties, and the rent..

@@projectj3494 hoa issues would need to be defined in the lease. Jay had another case where he charged $50a day late fee... Judge Simpson quashed it bc it was illegal. If they got a notice from HOA after the residents left, and the owner didn't know, that's not on them, its him.

What's really funny is you hear the tenants kvetching that the courts are unfair to tenants, and the landlords kvetching that the courts are unfair to landlords. The trouble is, if the law and the courts cater to either side, there will be abusive effs on that side who promptly try to get away with everything they can. (sigh) This is why we can't have nice rights. 😔

Even if Miss Davi WAS a straw applicant, the lease is over and anyone who stays is liable for the holdover tenancy. IMO. I think Miss Davi is smart, understands the law in this matter, is articulate, and isn't trying to scam the property owners. She's addressing her interest, or non interest, in this issue.

My water bill is about $125-140 per month. 3 story home in Atlanta. We wash clothes frequently, take frequent showers and wash dishes all of the time. Now that it’s summer that will probably go up another $50-$75. If the rent was $3800 I’m pretty sure they live in a 4 bedroom home

The people in eviction cases really irritate me because it's like, if you've broken your lease or you agreed to not have a lease and you know the owner wants you out, then you're a crappy person for making them take you to court and have to pay just to get you out! Just be a decent person and get out of THEIR property!!! I understand that people need time but the laws need to change so that they can't keep stalling. And the tenant should be responsible for the court fees because it's their fault that the landlord has to take them to court just to get them out!

Landlord likely has a claim against her in a civil proceeding ... something to the effect of damaged from fraudulent inducement but they can't use the landlord tenant court system. "Fraudulent inducement, also known as fraud in the inducement, is a type of fraud that occurs when someone tricks another person into signing an agreement to their disadvantage by using fraudulent statements and representations."

She couldn’t get out of the tenancy, so it was sub let with his knowledge. They claimed she was on the group chat and then emails. It’s a mess.

@@patsysadowski1546 There was never any sublet... All 3 parties were on the lease and SHE was the guarantor... It's not as messy as it may seem... My Perspective: She allowed her income to help her "folks" get the residence, with her never moving in... EXAMPLE: If I put my name on your car purchase, to get you a cheaper interest rate, I'm a responsible party, even if I never set foot in the vehicle... What do you think? 🤔

She shows up at the 50 minute mark. Turns out she DOES have valid issues. Shame on the landlords who didn't fix the hot water issue until AFTER the last hearing and STILL had not given her the mailbox key. If anyone needs to be humbled with jail time, it's the landlords.

I don't understand on the tenant who used her income to obtain tenancy. She signed the lease, if she moved out why WOULDN'T she be responsible for fulfilling her part of the lease? I'll never be a landlord, they have no rights.

Basically everything was paid during the contract period. Maybe check if the one guaranteed for money actually was extending the contract. (Looking for the stupid comment that claimed she reading some laws and talked with a realtor friend and were prepared, was proof she was volunteer to be on rentcontract and responsible if anything happens during the contract (which it didn't). 1 how would this be illigal, kinda like having someone guarantee your loan 2 why would someone with a decent economy risk that by guarantee for people maybe not paying rent/damage the property. Any motive or how can this possible be a problem? If shit happens she will be responsible!

Also if you read a newspaper from the 30's and even earlier than that people are complaining and there are articles about how 'no one wants to work anymore'. It's not that people don't want to work, it's that people are learning that they don't have to accept abuse from our bosses and be paid almost nothing for work. It's not a generation or age thing. 38:00 defendant needs to learn a very clear lesson: don't interrupt your opponent when they're making a mistake. The judge was eviscersting the plaintiff's arguments. You're winning as an unrepresented party against a lawyer. Sit back and let it happen, don't interrupt and risk upsetting the judge.

In Arizona is the same but dig this. You have three days to pay the rent. On the fourth day of the rent is not paid, there’s an additional 250.00 added. Now, they also tack on a $50 a day fee. If the rent is not paid by the 10th day, you get any eviction notice. But you also have $100 a DAY late fee. I moved to Arizona in 2008 and I never heard of these things before because I rented for a short time in Michigan and they didn’t have that. But now this is the norm so their goal is to make as much money off as possible, especially when your worst possible position. It’s disgusting.

What? I can’t believe he actually did shut the live stream off for her! He should’ve done the default action that he mentioned and put her down as a no show. If it were a criminal case they, usually, do a bench warrant for failure to appear. I love Judge Simpson but I wish he would’ve made her appear like everyone else or deal with the consequences. Hopefully he doesn’t do it for her again. Here’s to hoping on the 14th!
