@Censored Opinions I take it that you are opposed to both the Roe decision and the Casey decision. Neither Roe or Casey completely legalize abortion. Both decisions go to great lengths to explain that the government does indeed have the right and responsibility to step in and prevent a woman from aborting her child. Roe set that limit at the third trimester, roughly 29 weeks. Casey, changed the limit to 24 weeks. Either way, under Roe and Casey there is a point in which it stops being a woman’s choice, and the government can step in and force her to carry the baby to term.

"How can America sustain that?" "It can't and it's wrong." Yes it can. And it will. Any issue that is a states rights issue will be different from state to state. That's the point. Not every law is supposed to be a federal law. "Free person?" As apposed to not free? If you don't like the Missouri law, don't live in Missouri. There is a reason a lot of Americans will not live in California or New York. Those states don't have an issue with it.
@WingsBanquet
@WingsBanquet 2 года назад
You may have a point. But it’s also a ploy to make people move out of those states because of the electoral college. They could gain total control of every election even though the vast majority of people don’t want certain laws at the state level. If there was a popular vote. Republicans would never win. That’s why they keep the electoral college. Make abortion illegal and those people will move to blue states. Giving republicans the control. Land doesn’t vote. People do.

@SelfReflective 2 года назад
Where does it say that you have a right to free speech?
@patricksmith4148
@patricksmith4148 2 года назад
@@WingsBanquet You make a valid point. However, the winner of the electoral college is most likely going to be the candidate that best represents all of the various groups within the nation. Trump beat Clinton because he did a better job of representing the nation as a whole. She ignored groups of people and it cost her the election. For example she did not campaign in rural AmErica. The popular vote is the same thing as majority vote. The white population is 70% of American society. The popular vote alone will allow a candidate to ignore all minority groups and win. The electoral college makes that almost impossible. It may benefit republicans; however doing away with the electoral college doesn't create a level playing field. The popular vote benefits the democrats. The electoral college is not perfect. But it's closer to perfect than just the popular vote. No one seems to be able to come up with a system that is better. I respectfully disagree that people will move out of a state or not move into a state based upon the abortion issue. There are a lot of single issue voters; however that only goes so far. If you have an opportunity to work and make a good living for yourself, the abortion law becomes less important. An overwhelming majority of the nation is pro-choice . . . to an extent. A very small, but very vocal, minority expect on demand, no parental consent or knowledge, no restriction, month -9 abortion at the expense of other people. That is not reasonable. If it's one extreme or the other, people are going to go with the conservative perspective. Democrats are attempting to use the issue to better their position for the mid-terms. It's not going to work very well; even though there are a lot of one issue voters. Nonetheless, the republicans should have left it alone until after the elections.

Looking at this from another country, I don't quite understand the issue. In certain states abortion is banned after just 6 weeks, thus in practice, banning abortion. In other states abortion is legal after 5 or 6 months, a time when everyone agrees it is a baby and through technology, a viable baby outside the womb. Seems that there is no definition of what and when a baby is, and when or how to terminate a pre-born in the US. The states are already deciding individually, and because of that, it seems to me, the Supreme Court is admitting an evident failure in the pronouncement of Roe vs Wade. Furthermore, I would like to point out that hardly anyone wants the status quo to change, thus it won't, as there is too much money to be made. People have made good careers as activists on either side of the abortion issue, doctors, clinics, hospitals and Big Pharma make a good deal off of abortions as well. It is a lucrative business, employs hundreds if not thousands of people, it will not be shut down. This is a "smokes & mirrors" issue to hide sthg else... The question is what?

So here's the hypocrisy, those rights that they constantly whine about being curtailed, like FREEDOM OF RELIGION, they don't care to take away from the "others". When they create laws based on their religion, they're hypocrites. Also, about property, they couldn't care less about "other's" property as people like Ted Cruz, Moscow Mitch, and the like have pushed for years for congress to make it easier for corporations (especially oil) and the government to seize property from people in order to expand and make more money. It's hypocritical, especially considering that less than 10% of the property that the government and corporations hold is currently being used. Their hypocrites opining about "pro life" when they did everything possible to help spread COVID, when they can offer no solutions for mass gun violence, when they're trying to force births and at the same time repeal or limit the aid that most of those ppl would need in order to have the children. I could go on all day, but I digress. This isn't about life. It's about keeping their base pissed off. Does someone have the right to use someone elses body? THE answer is NO they do not. If one argues a fetus needs the body to survive, then when does that right end? If I need my mothers liver at 50 years old, in order to survive, do I not have that right to take it? Are we giving special rights to fetuses?

Imagine a fully grown homeless man with no resources, who is completely utterly dependent on you shows up on your doorstep. And the law says, "you are obligated to to devote your entire life to this man's welfare for 9 at least 9 months. It's quite possible he'll kill you--these things happen. But he's your responsibility now or you're a murderer." The man is no doubt alive, but you're supposed to have rights. Only this scenario is worse, because the person in question is living inside of your body and will at some point rip through it. This is a scenario that can happen any time a man decides to ejaculate inside of you, whether or not you wanted that. Whether or not a man ejaculates inside of you is really kind of up to the man. He can pull out or use a condom....or he can forget to pull out, or slip off the condom. Or he can straight up rape you. Doesn't matter--if he wants to impregnate you, there's really nothing you can do, unless you have the right to abortion. This is not about when life begins. This IS about the rights of women to live and control their own lives and bodies. We are not free without that right.
@Kevin_Williamson
@Kevin_Williamson 2 года назад
Debating when life starts is one reason it's a quagmire. Why is that the question, exactly? Life isn't a special thing bestowed upon humans. It's organic chemistry. And that chemistry begins at successful fertilization. And then comes the silly questions like what criminal charge do we slap on a woman who has a miscarriage of a developing fetus so darned small she never knew it even happened? IMO there are no, good, one-size-fits-all rules that can apply to what is essentially a very unpredictable, biological process. Anything can happen from fertilization to late term in the gestation process. Which is why the best thing seems to be leaving it up to the individuals involved and their chosen medical professional in charge of their care. Late term abortions are the rarest of procedures. Usually because, by that time, the people involved know they want to have a baby. When they are performed, it is most often from medical advice due to any number of complications. There's a long list of physical disabilities and diseases both the developing fetus and the mother can contract during pregnancy. Some women breeze through the process with no big issues. But not everyone is so fortunate. And that's why we need the wiggle room; to account for all the exceptions that inevitably pop up along the way. If anyone has some religious or other personal reason to not have abortions, that's their choice. Don't ever get one. But we legalized abortions in this country for good reasons. And attempting to go back in time and make it illegal again with the idea that there will be a different result is utter stupidity. And trying to chip away at it with this or that restriction is the slippery slope that got us to where we are today.

Slavery and abortion cannot be compared. Slavery is a legally established system of labor while abortion is a human vice like prostitution, gambling, drugs, alcohol, and any other action or substance that many people will partake of no matter what its legal status is. As Stephen Douglas pointed out to Lincoln in the Lincoln Douglas debates in 1858 a state could be a "free" state simply by not enacting a slave code. When you outlaw a vice you legally create many nonviolent criminals, you increase corruption in the criminal justice system, and you increase disrespect for the law in general. Exhibit A for this premise is the 18th Amendment that made alcohol illegal. A major side effect of prohibition was the creation and enrichment of the modern American mafia.

"There are laws that enslave [women], and laws that set them free." -King Arthur, First Knight It's not easy to see abortion bans as liberating women. They're decisively focused on fetal rights. By requiring a pregnant person's life to be at risk to terminate a pregnancy, and closing all clinics that employ trained abortion doctors, they push lifesaving abortions out of reach and judge a fetus's right to life superior. On the other side, even though state abortion bans lead to medical abortions and interstate travel for families of means. There's some evidence that they reduce abortions in total. The poorest women can't escape. That means, more fetuses develop into babies and enter the world. That liberates more fetuses from abortion. On balance, sacrificing the liberty, and rarely, the lives, of pregnant Americans in favor of potential Americans, looks like a plain violation of equal protection. As Alito explains, however, conservative courts have steadily upheld laws that disproportionately burden women and non-whites (like these bans) absent discriminatory intent. This presents the fundamental problem: calling policies "pro life" shouldn't sanitize those that harden racial and gender inequities. The 14th Amendment doesn't have a "free exercise of religion" exception. The stated motivation should matter less than the obvious impact, or rights like equal protection lose meaning. Since the 14th Amendment aimed to reverse decisions like Dred Scott, protecting the citizenship, freedom, and equality of blacks, Maher's reference to Dred Scott fits.

Jane Harman served 9 terms in Congress. If this is such a big issue to her, why didn't she follow the constitution and make abortion a federal law? Congress writes laws, not the Supreme Court. Better yet, during her 9 terms in Congress, why didn't she propose to add abortion to the Bill of Rights? She sat on her ass, just like all the other people in Congress (on both sides), and punted the issue to the SC to make a ruling it has no business making. Now she's writing a book about it to line her pockets over the rift it created when she didn't do her job as a member of Congress. Did this "9 term" congresswoman just simply not know how our system works? Did she not take a civics class in highschool? Or did she play the career politician's game of taking the easiest route possible while soaking up dark money and favors?

Such a list, when made public and used as a educational tool, would surely have shock value due to its length and the severity and duration of the various risks. The 13th Amendment, which very specifically prohibits involuntary servitude, seems to be pretty damn clear on the matter. Why the plaintiff's council for Roe chose to frame their arguments around the 14th Amendment instead of the 13th Amendment, I will never understand. In my mind, the way to fully restore the right to unquestioned bodily autonomy should go through the 13th in a post-Roe landscape. Seems pretty elementary to me. No need for debate or state decisions. The issue about when a fertilized egg becomes a person and at what point a woman should be forced to continue a pregnancy, regardless of the reason she may not want to. There is no consensus about this, never has been. It's unethical to allow the religious or moral objections of a minority to dictate what a woman should do when facing an unwanted pregnancy, if the fetus is not viable, or her health/well-being is at risk. We don't have a theocratic form of government, but it appears some Christian activists want it that way. The only person who should decide about having an abortion is the woman involved. As long as there are unwanted pregnancies there will be a demand for abortions. History has shown that someone will serve this demand, no matter whether it is illegal or not. The abortion business will simply move from regular clinics to secret or sinister places and into the darknet where one can order abortion pills. And those women who can afford it will then simply have an abortion abroad if it becomes illegal in the US. Poor women will resort to unsafe measures and some will die. The major conundrum is how to enforce a ban, when our judicial system is already overburdened. The "Bounty" plan in Texas only serves to pit neighbor against neighbor, in order to score a payout- not to mention women who have miscarried at home could possibly be under investigation. Much like the Temperance Movement, the conservatives who are intent on overturning Roe v Wade are leading this country into a Prohibition part 2, whether states are left to decide or if the GOP takes Congress and abortion is eventually banned nationwide. We all know how things turned out with Part 1. Organized crime was rampant, people found ways to get alcohol, and the law was unenforceable. If men are concerned about abortion and are "playing the field", then they should take responsibility for spreading their seed and have a vasectomy. Pregnancy starts with sperm, male orgasm and putting his noodle in the right place at the right time. No one is forcing him and he knows the result of unprotected sex as much as any woman does. Vasectomies are safe, painless and the most effective form of birth control. It's also reversible if and when there's a committed relationship where both parties are ready for a child. No more unwanted pregnancies, no worries about contraception, or abortion. Everyone wins. You're welcome.

@@Pangora2 It's really none of your business, or anyone else's, why a woman would seek an abortion. But, I'll play along: Pregnancy starts with sperm, male orgasm and a guy putting his noodle in the right place at the right time. Men should be held accountable for spreading their seed, rather than the forced birthers vilifying women whose contraception failed. Vasectomy is simple, safe, highly effective and reversible- it should be mandated. Signed consent of a partner, proof of gainful employment and a criminal background check would be required for reversal. No worries about unwanted pregnancies or birth control. It would end the abortion debate once and for all. Everyone wins! I’m sure the forced-birthers will be the first to sign on to this common-sense solution, because they so desperately want their government in control of women's bodies. This plan deals with pregnancy at the source.

I'm not American, but isn't that how the American federal system is supposed to work? With this issue I'm seeing more and more people basically saying they just don't like how the Constitutional system works, and of course this only happens because some States might pass legislation they don't like. This is not a ban on abortion, you'll just have to convince people from now on that abortion is a good thing. I wonder if the underlying issue is that the pro-abortion movement is just not comfortable in that debate and they rather avoid it altogether.
@Joe-ij6of
@Joe-ij6of 2 года назад
That's not how it works. The 5th and 14th amendments establish Due Process and Incorporation. Incorporation means that the bits of the constitution that describe individual rights not only limit the Fed, but also the states. This is why the first amendment cannot be violated by states, not just by the federal government. Roe v Wade, Griswold and other cases rely on a 'right of privacy' interpreted from the 14th. Like free speech, privacy is derived from the constitution as a personal right so Incorporation prevents states from violating it too. The issue here is that reversing roe means reversing a constitutional right to privacy derived from the 14th. This could open the floodgates to all types of crazy stuff. Griswold for example protects the right to use contraception via right to privacy, anti LGBT sodomy laws A counterexample would be something like insurance. This isn't mentioned in the constitution, and insurance doesn't conflict with individual rights in the bill of rights or anywhere else, so it's up for grabs to be regulated by individual states, and in fact it's HIGHLY regulated by the states, especially life insurance. However, the interstate commerce clause means that the Fed gov't could legalize buying/selling insurance across state lines, triggering the interstate clause and justifying fed regulation. Insurance isn't a big issue so it's left as is with individual states. On the other hand the stock market involves public companies and shareholders across all fifty states so it is federally regulated.

@@simplenough I reject that. Each person owns their own life. States always try but so far we have seen how brittle totalitarianism is. We're seeing it in China and we'll be seeing more of it here if we don't find a balance between the private individual, the private sector and the public sector. I, for one, still recognize Natural rights. The child belongs to themselves.

@S Ri Ever heard of Amelia Dyer? Children are a gift that we are to give guidance as caretakers, teachers and gaurdians until they are fully able to claim their own lives and decisions. The child owns themselves, as do all people, black, white, old or young.

The comments below show that only a minuscule minority of commenters know anything about democracy or the roles of the three branches. I've observed the same in all comments sections to discussions of abortion. The Supreme Court's role is not to decide is universally available abortion is a good or bad thing. It's to decide whether it is a right. ?If they say no, then every state .legislature has the same power, though in such debates whether something is a good policy is relevant. The anger over the Roe leak is because most of the angries have zero confidence that they can democratically convince their felllow citizens of their views.

How often does that happen? Do you think most women who undergo abortions just do it casually like it's any old procedure? If you think that's the case, I can assure you you are mistaken. Ultimately, people need to mind their own business and let the woman and her doctor decide what is best for her.

Without getting into the abortion issue I can drive across America and gain and lose my second amendment rights 20 times. Is that talked about?. I can do all the things I need to to conceal carry in my current state but as soon as I cross certain state lines be arrested immediately if I haven't secured it in a manner that state deams necessary or even if it is secured you can be arrested for not passing through the state fast enough to satisfy the police in that state.

Disclaimer: I am pro-choice early on. I think contentious issues should be handled closer to home as possible. I don't intervene in Mexico's abortion law. Why should I intervene in what Hawaiians want? Why should Alaskans force their world view on Bostonians? There's also the issue that the Court shouldn't have been the one to write the laws. Why hasn't congress acted in all this time? Roe v Wade has not settled the issue at all. RvW doesn't force it being outlawed. The states themselves will be responsible. It is easier to change your own state's laws than Congress/President and such. I'm in Massachusetts so we'll keep it up here.
