LEARN THE BASIC INTRODUCTION TO SHOUTH AFRICAN LABOUR LAW.
The employment relationship is regulated by labour law. It is important for the parties to an employment relationship to understand the basic principles applicable in labour law. As a starting point, it is important to note that in terms of South African labour law, only employees can be disciplined or dismissed. Therefore, as an employer, it is important to be able to identify an 'employee'. An employer cannot enforce discipline to anyone else but an 'employee'.
It is important to also note that South African labour law only prohibits UNFAIR dismissals and not dismissals. In other words, employers are allowed to dismiss provided that the dismissal is FAIR. In order for a dismissal to be fair, an employer needs to have a valid reason for the dismissal. In addition to the latter, the employer also needs to follow a proper process prior to dismissing an employee. For more information on procedural fairness, you can watch this video:

Awesome video Ali! Can one be dismissed for not going into office 5 days a week, even though this is a company policy but this specific employee works in a different location to the head office? In the office where the employee is based everyone works from home, but it’s not the same division of the company ! This employee happens to have a scarce skill and got hired from different a City. Hope this makes sense.

Hi Ali, thank you so much for the great session. I am interested in the part of laying a charge against an employee in a language that they understand, as an example, I am Xhosa and also speak English as a second language very well, The charge is written in English and in my Matric I got 30% in English. How do we measure the level of understanding of an employee as an employer to make sure that we the employer is on a safe side when laying a charge to avoid an employee claiming that they did not understand the charge.
