The neighbor's property with the excavator at the beginning of your webcast is not a seawall repair. They are taking down their seawall with permits and putting in a a series of terraces in their backyard.

It is interesting that they won’t let them repair it, when it’s well known that many other complexes have repaired their walls under permit. Kaleialoha finished theirs about three years ago, Makani Sands was working on theirs in November. Kulakane just finished the last phase of their landscaping to complete the wall project. I’m pretty sure Kahana Reef also had a sea wall project in the last 6 or 7 years AND there is planning for beach restoration down in Honokowai that is spearheaded by the Hotels down there. There is definitely an anti rental condo bias on the county council. The only reason they didn’t get the changes in zoning that several of the council people wanted was because the attorneys warned them that the county would go broke defending their actions in the courts, that and the loss of revenue via property taxes that rental units pay. People don’t realize that the rental units pay 5 to 6 times more in property tax than owner occupied units.

I saw a listing for a studio/1 bedroom condo that estimated the taxes at 1200 per month. Is that because they assume you will rent it out or is that probably just regular property tax?

The Leonardo Arms on Estero Island in Fort Myers Beach has had some similar problems with a crumbling sea wall and rising gulf. Part of the building is now in the gulf . Then Hurricane Ian hit this September and more damage was done . It’s an interesting story that can be googled . My family has spent at least 9 vacations at the Kahana Sunset over the last 30 years . I hope they can get this resolved . So many wonderful memories .

This is sad. I've been coming to Kahana Sunset since i was 14... stayed in the F building many times. My kids and I just arrived here this week after 5 years and I was really sad to hear about what is going on here :-(.

Jayne here... being from Nova Scotia surrounded by water...the sea is strong...at the time this condo was built codes may have been different...but these owners should immediately get the permit to rebuild the seawall because they are willing to...with the technology we have today...shame on Maui county for not making this happen...work with these property owners/tax payers...kinda makes you wonder what is going on in Maui County Gov there!!!

Very interesting. It would be a shame to not update the seawall in a timely fashion. And do Maui Jim's seawall while you're at it. Since Jim's seawall looks like a bomb went off, maybe there's a serious issue present that makes the construction process impossible.

Maui Jim’s property was eroded because of the existing sea wall at kahana sunset. He also had built structures that weren’t permitted.

I would assume that removing the building would present a huge gash in the shoreline, with further erosion to, eventually, take out the building behind it. Build That Wall!

It seems to me that the county's refusal to issue the permits necessary is causing basically an eminent domain type of "taking" from the owners of building F - is there litigation going on that you know of?

These are always hard situations for owners. If there is a law that restricts this issue, rebuilding on public land, then it’s a sad story. In Oregon any home built on the ocean front after 1964 is not allowed to build rockeries or sea walls to protect their home from washing into the ocean. Same situation as our non navigable rivers. The property line is established by the river. If it swings over t a new route the property line follows it. So one guy loses land while another gains it. But it’s Oregon law for both situations. So it goes back to the law as to whether or not they should be able to rebuild their wall. Buyers need to be aware of the laws. The laws were not made to hurt the buyer, rather they were made to protect all the people of the land from losing beaches. Property lines often go to high tide line which is determined by the ocean. Many places on that stretch of coast have lost buildings as well as well as yards due to the storms washing away their land. Like valley isle and others. Hard lesson to learn!

Your video failed to mention the reason for the orange cones in the walkway. They are blocking the walkway where the stones are rising up and down with the sea hitting the sea wall in that section of the building. I was there when they were placed only 4 weeks ago. (Dec. 4th week). We left the property and relocated to another after 7 days. The "Beach" there, is practically unusable with the rising waters. It is, or could be, a great place again, with the help of the necessary government assistance and a ton of money. The view of the waters are wonderful. And the unit I stayed in was modern and comfortable, however blocked view of the ocean by the F building. There is an opportunity for buyers who are made aware of the situation. Does anyone work at Maui County? Not approving permits and not removing junk and abandoned vehicles from all over maui. On the other if Maui County can make more money by making someone move a building over fixing a seawall then the answer is obvious.

I think Maui County is going to pay big for this. Loss of use, loss of revenue. Should be able to issue permit 30-45 days after engineered plans are submitted.

I am curious what the engineer's report says. We stayed at Kahana Sunset in April 2022 and watched the terraces of building A fill with water from waves at high tide. Normal high tide, not stormy. That building would need to be raised up 15 feet and put on a new foundation because building a taller sea wall would not work long term. Not to mention would completely block the view

Is the county still assessing property taxes for that unit, if so how is it valued? If they say it needs to be removed, then should be $0 for the building value and should align with their removal recommendations. Also I assume the land would have a lower value given that the sea wall is in disarray without approval to repair. I would pursue a property assessment appeal. I think their loss of taxable revenue has potential to start to change behavior on approval of repairs to existing sea wall.

I will give you what I think is happening, from what I can see in the video. I have been a concrete contractor for 18 years here in Washington, and I spend a lot of time living in Wailuku. From what I can see in the video quality, The wall looks to be in good condition. But I can see that the footing is starting to get undermined in some spots, along the front face. If that is the only visual issue with the wall, they are probably concerned to put the risk on the county by reopening, even though it would stand for a long time. With undermining in that spot, over time, it will continue to get worse, and eventually will destroy the wall, but that could be way after our lifetimes expire. I think the other factors are this. They see the risk of what happened next door. And anything on saltwater frontage, is extremely hard to get permits for building or working on bulkheads right now. If it was my bulkhead, I think I would keep bringing in the best engineers, until someone agrees that this is not something that will fall over soon.

You bring up the main point in all this: if the county permits the work and the seawall fails, we taxpayers are on the hook for the immensely expensive lawsuits that follow. With properties like this ringing the island, the county would go broke in no time. Our council members are doing the right thing by protecting their constituents. The owners can shop for engineers all they want, and find plenty that will do the work that will be dead and gone in thirty years when the wall fails again with sea level rise. Will be interesting to see what happens, but I detect our tax money flying out of our coffers for those who built too close to the ocean, and I think that stinks.

Aloha from South Carolina. Here if the original sea wall was built with drawing by a Engineer, building permits and a licensed Contractor there should be no responsible excuse to not keep from issuing a Repair permit since you already proved the neighbors already were issued a repair permit. Lawyer need to be involved that know he system. Some times lawsuits are required for action. Loss of income, depreciation, ect. A good Attorney can think up 30 things but all Homeowners must unite

Manage retreat does not happen with this sort of property, unfortunately.. There's just not enough land to 'move' the entire building back. Hopefully our new mayor will be able to do something about this, as well as the Kahana Beach restoration. Kahana beach restoration has been pretty much stalled.. I hope we get to restore our beaches back..

What happens if the owners simply repair the damage and replace the seawall WITHOUT a permit? Obviously, the County will fine them for rebuilding/repairing without a permit; then what? The owners pay the fines, life goes on, and at least the property becomes livable, no? Or does the County condemn the property because the repair was not permitted?

We could use these units for housing now. Additionally, the county will also lose all the tax revenue from the building which also is hurting the residents of Maui. The county should issue the permits immediately!

Pretty severe beach erosion going on and out of the blue the state recently pulled out with funding help and even ALLOWING beach repair and enrichment at Kaanipali. You’re not in control of your own destiny in you buy a condo. You have one vote.

What does Maui county WANT?? Have them itemize the codes and get a contractor that will follow the codes step by step for the wall. Last resort hire a good attorney . Sorry for the trouble!!

I live down the road & this is a shame. I think they should dredge sand from the ocean & build the beach back. They did it in Dubai & the CCP has built islands in the Pacific. This is a beautiful place & the beach should be restored & this building will be fine. If they don't fix it the building will eventually fall & be washed away

I believe this is an environmental issue, I think the sea walls are eroding the beach and the crumbling walls leave harmful debris in the ocean. Others can speak to the problem much better than I can. I do know that Maui County officials are very aware of the problem. Do you know if the beach in front of the condo was bigger before? Maui County wants to save the beaches for everyone. I do know that it’s illegal to build this close to the ocean now.

Those walls look as though they were built onto the beach itself. I feel bad for the owners but the original developers should have never been allowed to develop that beach front that belongs to everybody. The county should compensate the condo owners and then tear down the condos.

Former owner. This has gone on for 20 yrs. Before the A units sea wall was rebuilt and before that run off from the property development above kahana condemned the D building. Miss it terribly but the county has been trying this for decades and there was almost a hostile takeover to drive out average people and redevelop. Island politics. Buyer beware. As a whole, the only chance to recoup is to give up snd let the powers that be have there way.

Please county of Maui give the proper permits to rebuild the wall!!!! The seawall was existing. The owners of F need to be able to get back to rebuilding their condos that they own. PLEASE HELP THEM GET THE PROPER PERMITS FOR THE SEAWALL TO BE REPAIRED! We have been coming to Kahanna Sunset since the early 90’s- we absolutely LOVE it there! We return every year. County of Maui please give the proper permits!

I'd bet the Crook's on the county is waiting for a little (big)off the books payoff to approve any permit's.... In my opinion... I could be wrong... But.... Prolly not...

Unpopular opinion here but I think the beaches should be preserved and the building be moved. We don't build walls to stop lava flow, why are we building walls to stop beach erosion?. All of the islands are slowly sinking back into the ocean. If Mother Nature wants to erode the beach we should let her, otherwise all of the beaches will disappear and it will be nothing but seawalls. People can build elsewhere, let's preserve nature before it all disappears!

These people have lost their investment . Recent video shows waves crashing over building F . The beach erosion is too significant and continuing . A new sea wall is not going to prevent the catastrophic loss of this building . Too close to the water!

Exactly. Because someone has to pay and maintain it. The city/county aren't going to help with that. There goes up the maintenance fees are high in Hawaii.

Too much risk with oceanfront properties. The ocean will eventually reclaim her space. And this condo is teetering there already. Nobody should buy such properties; its a literal losing investment. You say "Best condo". Remember by RE ethics this is called steering. You're putting yourself at risk with such statements. Or just trying to get your viewpoints up with eye-catching titles. Not cool
