At a time when the government is mulling changes in the RTI Act, information commissioner Divya Prakash Sinha has suggested that investigative, intelligence and security agencies like NIA, CBI, IB and paramilitary forces should come under the purview of the law, saying there are adequate safeguards in the Act to keep sensitive information outside the public domain. The former IPS officer, who spent most of his time in Intelligence Bureau, says transparency needs to be “all pervasive” and that the RTI Act helps bring in accountability in government departments. Currently, 20-odd investigative agencies are outside the ambit of the RTI Act, subject to exceptions like allegations of corruption and human rights violations. Sinha’s remarks come at a time when CBI is virtually going through turmoil with the top brass trading charges against one another.

Vipul mudgal had valid point that there is need of RTI by there own officer. But we need them be in RTI we can have separate mechanism for enquiry in transfer and suspensions.

Every common man has right to know act is very essiential and top burecarts and top agenices like CBI IB NIA should maintian transparency,. RTI gives full rights to know about every thing which is exmpeted and it is very important for all us to maintain this ACT i know their is some condradict statement in RTI i would like sort this issue as soon as possible

CBI is greatly influenced by government which leads to CBI being a means of tool for their own play. There are some cases of CBI where they are tainted by scandals and corruption. I strongly think that they shouldn't be under RTI act but there should be change in structure of command.

Since the RTI Act was made in 2005 , lots of change is taken place in administrative scenario of the country. Initially administration was reluctant to implement the Act and put information into public domain. But now administration itself puts lots of information public. Now a days, every administrative and executive decision has taken with bearing in mind the the RTI Act. So, now time has come to amend the Act and make it more powerful and toothful so that much of the information put on public automatically. Protection given to such organisation in the name of secrecy and national interest, must be rationalize. No one against national interest but at the same time we must ensure that the shield of national interest must not be misused. After all accountability and transparency are the bedrock of the Good Governance. We need RTI 2.0.

When Singh says that if brought into RTI, officers will hesitate in giving their true opinions for the fear that the accused may in the future be in ruling dispensation. And then he says that under CrPC, every document is available to the accused. So, what is he really trying to say? If every document is already available to the accused, why would officers be afraid in giving their true opinions after the info is available under RTI?

Imp takeaways: -Section 8: info exemption -Section 24: organizations exemption -Blanket exemption should not be there. -Only sensitive info needs to be protected. Other info such as adminstration info can be disclosed under RTI. -RTI originates from Article 19 of the constitution. Thus, it also faces some reasonable restrictions in availing info to the public. -CBI was originally under the purview of the RTI. But in 2012, it was also exempted like other intelligence agencies like IB, RAW, NIA. -there is debate with data security and privacy of individuals as well. Agencies like NIA, NATGRID have access to the digital data without being answerable to anyone. Way forward: +Parliamentary oversight like the US +Full implementation of Sec 4 which ask organizations to put information on public domains +Need for rationalization of Sec 24 and relook at the organizations which can be exempted and which can not be.

Found a little bit biased....why an ex cadre officer from the paramilitary or Capfs was not invited to the panel for discussion.....there has already been allegations of step motherly treatment to these forces.... please a channel like Rajya Sabha TV shouldnot indulge in such blatant exhibition of popular perception of these forces.....and Mr mishra must know that paramilitary forces are not police forces......their very nature is that of armed forces ......even in their constituting act they are named as Armed Forces of the Union..,,,invariably they must come under certain exemption for specific purposes e.g. ITBP, BSF etc protects the borders so sensitive information which could jeopardise the strategic interest of the country should definitely be exempted....

People need to understand that Bureaucrats in India behave like 'British Sahibs', and this includes those in Institutions like CBI, RBI, ED, CVC, Election Commission etc.. The Modi Govt wants these SAHIBS to have accountability for their actions, and is rightly asking them questions. The 'SAHIBS' have to learn to stop seeking favours SINCE It affects the integrity of the Institutions; the clean-up has been SWITCHED ON by Narendra Modi. It is painful to undergo any surgery (in this case a surgery to weed out corruption from the Institutions, who have no accountability for their actions!). RBI has not been doing anything to monitor the NPA (non performing assets) of Public Sector Banks for the last 71 years, which shows that RBI is a lazy inefficient institution and hand-in-glove with certain banks. Now that NPAs have been identified by the BJP Govt, suddenly RBI wants to take charge and implement its policies. This is basically a governance and accountability issue. There has to be some sort of penalty on RBI for allowing NPAs to be built up in PSU banks over the last 71 years.

Good points. A lot of people have a misconception that institutions such as RBI, Supreme courts don't make mistakes. For a long time, there was no government or other groups to questions the performance of RBI. Rangarajan was an incompetent governor who left a lot of bad loans just slide through. The RBI seems to be in defence to save the face because they realize that there see a body who's questioning them publicly as per the RBI act. Mainstream media is looking at everything in black or white. For instance, I read an article by one of the popular journalist, according to him, demonetization was wrong, but no one is explaining the steps one should take to identify the shell companies who are evading the taxes for years. Why only about 1% of people paying taxes of 1.25 billion people? Aren't we capable of taking risks? A risk doesn't always guarantee a positive/expected result, but we learn lessons from it to get better. No one in the world can control oil prices, the rupee value against the dollar, and trade. It's normal and expected them to fluctuate. I hope people acknowledge the reasons behind these issues and be patient with the current government to take risks to clean up the system.

Vipul Mudgal speaking like a foreign paid NGO... Sorry for being harsh but that's the truth. What balwinder sir and Mr. Mishra said was absolutely correct ! The accused is more willing to get information regarding the investigations... Normal people and normal citizens are not at all interested in getting any sort of secret information. Anti-India elements want accountability for intelligence agency but there are already proper safeguards to take care of.
