The Fugitive Economic Offenders Bill aimed at preventing culprits from evading the legal process and fleeing the country was last week passed by the Lok Sabha, as the opposition questioned the goverment's sincerity in taking any action against them. The House later passed the legislation by a voice vote as Finance Minister Piyush Goyal said the government had brought an ordinance before introducing the bill in Parliament which reflected its "aggressiveness" in acting against black money and such offenders. To opposition demand to bring the bill with retrospective effect to book offenders who have already fled, Goyal said it was not possible as the legislation was and the government "knows how to bring the accused to book". During the almost two-hour long debate on the bill, the opposition questioned the government's sincerity in acting against economic offenders saying many of them have fled the country during its rule, even as the BJP maintained that the banks were being helped to recover their money. The Bill will now have to be passed by the Rajya Sabha. On this edition of ‘The Big Picture’ we discuss the Fugitive Economic Offenders Bill of 2018.

🔍What is ex post facto law? ●An *ex post facto law* is a lawthat retroactively changes the legal consequences (or status) of actions that were committed, or relationships that existed, before the enactment of the law. In criminal law, it may criminalize actions that were legal when committed; it may aggravate a crime by bringing it into a more severe category than it was in when it was committed; it may change the punishment prescribed for a crime, as by adding new penalties or extending sentences; or it may alter the rules of evidence in order to make conviction for a crime likelier than it would have been when the deed was committed. Conversely, a form of ex post facto law commonly called an amnesty lawmay decriminalize certain acts. A pardon has a similar effect, in a specific case instead of a class of cases. Other legal changes may alleviate possible punishments (for example by replacing the death sentence with lifelong imprisonment) retroactively. Such legal changes are also known by the Latin term in mitius. 🔍What about India? ●In India, without using the expression "ex post facto law", the underlying principle has been adopted in the article 20(1) of the Indian Constitution in the following words: *No person shall be convicted of any offence except for violation of a law in force at the time of the commission of the act charged as an offence, nor be subjected to a penalty greater than that which have been inflicted under the law in force at the time of commission of the offence* Further, what article 20(1) prohibits is conviction and sentence under an ex post facto law for acts done prior thereto, but not the enactment or validity of such a law. 🔍Give me an example. ●An example for retrospective law in India is the Karnataka Schedule Caste and Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978[13] in the state of Karnataka Source:Wikipedia.

Regarding retrospective law,the panelist said at 22.50 it was under art 13,but it's under art 20(1) as there would be no ex post facto law.

yes you are correct.,article 20(1) deals with ex post facto laws.i think he is saying that any criminal law if made in such terms,will be violating 20(1) and hence will be declared void under article 13

Inspite of having some sagacious provisions in the bill one does get the feeling that much needs to be done when it comes to fugitive offenders...until and unless issues pertaining to offenders who can't be prosecuted due to lack of agreement with the sovereign state the problem remains unresolved..that seems to be lacuna in the bill..

what article 20(1) prohibits is conviction and sentence under an ex post facto law for acts done prior thereto, but not the enactment or validity of such a law. There is thus a difference between the Indian and the American positions on this point whereas in the United States, an ex post facto law is in itself invalid, it is not so in India. The courts may also interpret a law in such a manner that any objection against it of retrospective operation may be removed. An example for retrospective law in India is the Karnataka Schedule Caste and Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978 in the state of Karnataka

yes.. and that is why any conviction thus awarded will be held invalid in the court of law as being in violation to the provisions of the constitution as per Article 13 but the law cannot be struck off completely. Is that what you mean ?

I personally think that all d debate in india on TV must b stop completely untill the people gets educated, the minister gets educated as to who encourage people for nation building activity, EDUCATION then to start a business of PAKORA... we urgently need n educated govt...n should stop the Hindu Muslim debate... Rule will always b a only rule untill minister get a decent education...
