This is akin to rape charges for having sex with a 12 year old. Emotional IQ and intellectual IQ are 2 different aspects. What if you had an extremely intelligent advanced child? A 13 year old in college, with the capacity to interact with adults on all levels? Would it them be rape also if he chose to have sex? The only way I can see this having any meaning, is towards the OTHER person. Whomever takes advantage of his low IQ would then be seen as rapist/predator. What if both participants have extremely low IQs? There are so many nuances to this sort of public policing on human issues-- there's good and bad points. I dare not mention the recent turn over of roe v wade. We are not all cookie cut humans. Government should be like a pillow we have to support and catch us, not suffocate us! The wording of this infuriated me, but once I thought about WHO he might be with (predator?) and his actual capacity to care for himself (could he even live alone?) that certainly throws in some need for extra thought. The IQ number shouldn't matter as much as their actual abilities. There are several intelligences, but without proof that he is incapable of comprehending what sex is, or incapable of even speaking or saying no, the govt needs to stay out. But if this is a human who can't truly take care of themselves with basic needs, who in the hell IS trying to have sex with them? Ooh, wait... But does sex have to be anything more than pleasurable? If he can get 'aroused' and it is not harmful to him or the others in a way that would be obvious, then why shouldn't he be allowed to have pleasure? What if he paid someone for it? Are they still rapists if he sought out and paid for said activity? So many different thoughts on this. Physical age, emotional age, intellectual ability-- so many variants. My 18 yo can enlist and go to war, but can't drink legally until he's 21? This opens such a pandora's box of shit i could rant about. Govt is us, our voice, but I'm not sure when my/our thoughts and feelings stopped being represented because we're 'too stupid to understand' so they do it for us? (Real quote from a politician.) This was the UK, but they elect the high court, don't they? Democracy for all intents and purposes, yes? Regardless, this is a real shit starter, and I'm gonna have to bring it up around a circle of people I don't know very well just to watch the sparks fly! Did anyone ask Alan? Lol. I'd love to know the back story here. Why in the hell it was a court case in the first place! Thanks for diverting my brain for an hour-- with nothing but questions now.

You're right, I felt the same way when I first came across and dug into the issue. It raises a lot of very delicate and nuanced points of debate that we never knew we needed. We will never know the full context of the case to protect those involved, which is fair enough. But one thing I did find odd was that they classified an IQ of 20-40 as "severe MR" and below 25 as "profound MR". The pseudonymous Alan reportedly had an IQ of 48. The fact that there are enough people below his IQ level to merit 2 entire buckets of categorization, but he was the one who was on the end of this verdict suggests there might be more context or even vested interests (not trying to start a conspiracy out of nothing but it is a court case after all) behind the ruling.
