Sir, I am having one question that which act is to be applied in the Union Territory of J&K because if we keenly look into both the act (Consumer Protection Act,2019 & J&K Reorganization Act, 2019), the former act clearly mentions u/s-1(2) that the act is applicable in the whole of India except the UT of J&K. And on the other hand the later act clearly says that the Consumer Protection Act, 1986 is applicable in UT of J&K in its 5th Schedule. Again the Consumer Protection Act, 2019 clearly repealing its former act of 1986 by clearly mentioning u/s- 107(1). Then how could we understand that CPA, 2019 will be applicable in J&K? Sir ...the old act can be amended ...if there were no provision for e commerce, forums/commission jurisdiction all these can be added in the old act .....then what is the need ofaking new law about it..???
Sir you said that Consumer Protection Act, 2019 is applicable to Jammu & Kashmir as well by virtue of Sec 107 of the said Act and mention of the Act in the Fifth Schedule of Jammu & Kashmir Reorganisation Act, 2019. But in Sec 1(2) of The Consumer Protection Act, 2019 it is stated that it extends to whole of India except State of Jammu & Kashmir. Please clarify.
One interesting fact about both of the laws is both acts were notified on the same date I.e. 9th of August 2019. Since J&k reorganisation Act, 2019 talks about consumer protection Act, 1986 not about the Act of 2019. But if we apply the Principles of General Clauses Act, 1897 it indicates the applicability of J&k Act on COPRA 2019.
I'm a Delhi university second semester student. I have a one querry. Recently my Flipkart loan was reporting on my cibil. Although my smaller brother closed my loan account. I asked flipkart to close it. But they were delaying. I'm wating for them to show closed loan account on my cibil. Actually I'm in distrust weather my brother closed it or not. Suppose they/flipkart don't show closed loan account on my cibil , can i proceed a civil suit under tort against flipkart. As under Consumer protection acts 2019/2020 it is mentioned that e commerce sites should adress grievances of customers. So my question is this if such e commerce sites don't respond to my grievances and caused me frustation/mental damages can they be sued under tort.
I have taken loan for studying in coaching classes ,I found the classes to be not worthy of the amount they are charging against the course.how to cancel loan and recover the paid amount for 3 months because I haven't accessed any classes till now on their LMS portal . I want my money refunded back and avoid any further payment of loan
