Even in the wake of big scandals and royal commissions, regulators and lawyers have struggled to pin blame for corporate wrongdoing to individuals. But a landmark High Court ruling could radically reshape that. It involves the competition watchdog taking action against Captain Cook College over the use of pressure tactics to enrol vulnerable and disadvantaged consumers in courses they were unlikely to ever complete. Safeguards to stop inappropriate students signing up were removed and profits soared. The ACCC won the case and the High Court upheld the findings. The college was found to have engaged in systemic unconscionable conduct, and the parent company Site and former executive Blake Wills knew about it. The ruling potentially makes it easier to pin blame on individuals who have had oversight of failures by corporate or government bodies.
