Regarding the first topic, my personal opinion is that the Essential Religious Practices Doctrine is unnecessary. If any religious practice is to be struck down by the court, it can easily be done on the ground of violation of other fundamental rights. As Art 25 states, freedom of religion is subject to 'public order, morality, health and other provisions of this Part' ie Part 3. For example, as sir said, angapradarshana could be declared injurious to public health as it may lead to infections, and thereby struck down. Sati for instance is against the right to life itself under Art 21. It is unnecessary for the judge to assume the role of a theologist, browse religious texts and decide which practice is essential to a religion and which is not. This is not his/her area of expertise.

Exactly I was going to write but you did first. 👍🏽👍🏽👍🏽 Another point: the word 'Religion' is not the correct narrative of 'Dharma'. What does Dhrama mean "Duty" in simpler form. For example what is the dharma of fire ? To burn! It is the 'panth' in hindi and due to lack of exact meaning in english, the British have given the term 'Religion' which was nearly correct.

Religion Is Imp , But not at the cost of humanity . Writer Is Using One Religion Cases To Protect Other Religion , As He Can't Open Up Directly n Say Courts Are Discriminating Against One Religion. Courts shd consider holy books but everything in holy books Can't be given as judgement, Take Humanity As The Key n Pass The Judgement.

Religion is a faith a person should have.But this faith should not bring prejudice to other religions. For this to happen there must be a balanced decision that must be taken by the religious leaders because the people follow them blindly rather than the court's view's on religion. So, it is a intelligent act to pursue the religious leaders to bring a unity among all the religions through their unity.If any issues passes the doctrine of essentiality test, then it should be allowed by the law provided that it doesn't hurt the values and principles of the constitution. This can be one of the resolution for present problem....there are many more too........

Sir in my opinion on one hand in order to uphold the human fundamental rights, judicial can interfere into the Essential religious practices analysis. On other hand, when it comes on what should we consider to look into ERP, may be we can look into the consequences of that ERP HISTORICALLY whether it lifted the people in past or it pulled down the faith of the same people. May be in this it can give us the answer of what is essential?

Judges should not interfere in religious matters unless it directly infringes upon basic fundamental rights of the petitioner. In case of infringement, provisions of constitution in accordance with due process of law should be the source to rely upon while deciding such cases. However, judges should restrict themselves while taking upon such cases and should follow a consistent guideline in deciding which of the cases should be taken up because if all religious practices become subjected to provisions of constitution, it may restrict one's freedom to fully express his/her religion. Thus, we should not be at one end of the spectrum rather a middle path should be taken but it should be based on an objective, rational and consistent idea.

There are several yogis who have faced legal intervention from entering into permanant state of samadhi which are said to be a spiritual practice same goes with sallekhana in jain ,Judiciary permits passive ethunasia that too with prescribed procedure to be followed. I would love to attend session if at all my loved mentors are planning take one on said topic. O

Provided judgement by courts I'm with them in this era we can only belief on court for wright judgement and did as well so if look at example of nag panchmi it had struck down earlier because snake aslo life so and other in hijab i think court is true we have ban hijab because of women don't want to wear hijab many of one are wearing hijab by force and threats from their community and their family.. girls in muslim have to wear hijab from 7 years something 8 when she don't know about her choices she have to wear by force ...so my context banned also quite right and also look at 1 point court has banned a anga pardekshina which is wrong also because i lf look at they also harm body by doing that's type of practices. Court is not clergy I'm opposed writer because courts know about the meaning religion....

1) I think sir ERP test should be based on their religious text Because arbitration also is a violation of our rights. 2) And before SC struck down any religious practices , they should try to conduct a survey of their community view on that practice and how many people being affected by this. I don't think if you taking any decision without any based then it's always being controversy even, among judges and it's also important for judicial trust otherwise after sometime people taking not serious to judgement and try to interpreted to the judiciary contradictory with FRs .. I have more views on this topic but this chat box is not enough sorry sir but your teaching and all teachers their support is very big help for us thanks a lot sir😊🙏
