I'm a Professional Surveyor in multiple States, NOT MN!, but Minnesota was initially divided up using the rectangular system (sections, Townships, etc.). Those lines are as they were originally set, whether slightly off or not. The lines don't move. If original section corners were found by the surveyor(s) then it would have been a straight forward job to establish the line. BUT, fences don't always get built on the lines and if they have represented the line to both parties for 7-20 years (depending on individual State law and title) then you could have a claim to the land up to the "old" fence and vice versa for your neighbor. Surveyors usually note the presence of a "possession line" when it differs from the "title" line and the its up to court to make a decision on ownership. At least that's how we do it. Love the channel!

According to my husband, a licensed civil engineer and surveyor in NC and KY, an existing fence or roadway that has been recognized as a property line and not contested by either land owner for a period of 10 years is legally defined as that property boundary. In your case of closer to 100 years, I would question the objectivity of the surveyor. Was he paid by the Fisheries and Wildlife agency?

I know in Wisconsin it doesn't work that way. We lost a small amount of land about 50 years after the fence went up and they surveyed it.

It works the same way here in Kansas after a period of 15 years. I know this because my parents went through this when the neighbors bought a additional 10 acres behind them.

I am not a surveyor but I am a land owner and here in Washington state every corner should be marked with a steel rod or a brass/bronze hat. The government has tried many a time to adjust my lines by a chain length. Also a fence line in place for over 7 years without disagreement is a line. Get it back Larson farms!

@@tedr8454 you missed the point, it moved 60 feet on one side but inches on the other. Pretend you buy a Tesla, it is promised with features but then doesn't come with those features... I'm sure you wouldn't feel ripped off... right? The problem is the State is trying to take land that it did not purchase - that IS a problem. Just like your attitude. Wrong.
@warrenclaassen5959
@warrenclaassen5959 Год назад
Others have stated that an uncontested boundary is now the legal boundary after a given amount of time and I believe I have heard that before as well. However a real question to ask is did they require the roads on either end of that section of ground to also be moved 60'? If they are adjusting a quarter- or half-mile line is their line now exactly that distance from the reference point of a road at then end of the section? Your deed provides the actual distances from a road and the roads, not their supposed digital pin. We know almost nothing is in the real location where it was supposed to be located due to the accuracy of the technology at the time. There are boarders with Canada that are wrong and not at all straight but their countries have long ago agreed to leave them as they didn't want to pay for the correction. Minnesota has counted on you aren't going to fight. As for doing your own survey I would also have that done. Minnesota has been getting taxes on a give amount of acres over the years. If you now don't have 2 of those acres you need to have that corrected and ask for a refund on overpayment.

Ask around and see if there are others and maybe you all can work together for the greater good! Tell them you don’t want to “gain” it at the other end…/they can have that unusable land. Old chain surveys measured up and down hills. This gave a true measure of crop land surface area. GPS measures in a straight level line from point A to point B and does not account for surface area inside the parcel. At least that is my opinion. Good luck with future land issues.

Look into MN law regarding "prescriptive easements" where you've farmed the land for 100 years and that was agreed where the property line was. The old time surveyors worked year around, guessing they may have consumed some adult beverages when it was cold out (?) May have affected the accuracy now and then.

In Michigan there are metal stakes at corners, that land is measured from. No matter where you are in the US there should be a starting point and all surveys should come out to the same location. Beyond that if the land boundary can be contested in court. If the field was not contested for for over ten years, it can be claimed.
@billbrooks9464
@billbrooks9464 Год назад
We had a boundary dispute with our neighbors and both surveys were in agreement on where the property line was at. In the end, we were able to prove that we had maintained the area in dispute for over 10 years and won the court case under adverse possession in MO. You might want to check into adverse possession laws in MN and even with the new fence up, the fact that the old fence is still there might cause the court to award you the land. Also would check into why the two survey companies came to different boundary lines.

I was a party chief for a land survey company for a few years. GPS is definitely more accurate, but if the base station is not set up properly, it can be off by a few inches or miles. Something as simple as the base station not being leveled correctly or not verifying the known point hasn't moved at all will affect the location the handheld says the property line is. In most rural areas, it's usually a piece of rebar in the ground as a known point. In the city, they use a disk embedded in concrete. Next time you're walking down a sidewalk, look and will see them. These are the simple things that can cause an inaccurate reading. Other complications can come from entering setup info wrong on the handheld, not having enough satellites connecting, not keeping the handheld still while taking measurements, not verifying your setup is correct by measuring multiple know locations. and many other mistakes. You would need to hire your own surveyor and compare it to your neighbors' survey.

From the point of inception (the starting point of measuring, which is probably in town somewhere), if they are off 50 feet on "side a" of your property, then they would be off 50 feet on "side b" as well (more or less). This is the reason why the surveyor said you'd make it up on the other side. It is basically shifting the property line down. The shifting doesn't work so well if there is a road or waterway at side b, because those are hard to move!

AFAIK, a chain is 66 feet. A lot would depend on the age of any previous surveys and how accurate they were. A little over 10 years ago I sold off the cropland to the family farm. In talking with the surveyor he told me that we did not have over 200 acres. When I asked how much we had he replied that he did not know. Part of our land had been deeded onward, without any intervening surveys, since the original 1836 survey. He then said that to do a survey he would have to start from 2 known USGS points and triangulate in. Time consuming and quite expensive. And then to cap it off he commented that even working in from 2 known points he would not be able to state precisely how much acreage was involved. So, the land was sold as "200 acres, more or less"
@StewPedassle
@StewPedassle Год назад
Correct on the chain -- also 4 rods or 100 links. Regarding the land, last I knew, "MOL" is a legal requirement for all intents and purposes. As every survey, no matter how accurate, will vary because all measurements are relative on a fundamental level.

As for the property lines several things could of happen. One if it was owned by family way back when the fence was put it there could of just said this looks like a good place and just put the fence there. Or another thing is that there was a old ditch somewhere and they dig a new one in and it actually split the field up now. Also like you said just was off and no one question it till it was sold. Depending on if your county has online plot maps you can measure the field online and check it with the acres you are to be farming or own. It is a quick down and dirt thing to try but gets you close and if you really feel it is way off you can get a new survey done and check. Also the legal description you can measure it on the road and see if it is right as well. and then go from there. Some will say the fence is gold after so many years but its really not its a fence no one really knows if that was the true property line or not when it was installed.
