Didn’t really have the jury convinced when only the foreman backed him as not guilty and that was only Beacuse he believed Gibbs didn’t make her case

I don't think he convinced them he attended Harvard. He did convince them he should be a lawyer though, which is much better. Also, I think Mike on some level wanted to be found guilty (without going to jail). the constant guilt and the feeling of being stuck he was feeling could only go away if he took responsibility for not attending law school, and he knew that.

One thing I noticed is, the jury foreman who informed Harvey of the verdict, was having his arms free while listening to Mike, but at the time of Anita, he had his arms folded. Generally, whenever someone have their arms folded in front of you while you talk, they are generally NOT in a receptive mood. Nice little psychology detail. :)

@@gijuki1335 They may not be but my wife is a clinical psychologist and this is something she looks for, she consistently tells me that people close themselves off by protecting their core.And it's not until they relax that they take away that shield that is their arms.

A man posing as a pilot likely doesn't know how to fly a plane, so fearing one getting behind the stick is a valid concern. A man posing as a doctor will never even get close to an operating table. Mike posed as a Lawyer, but he actually knew what he was doing, at this point in the show he practically was a lawyer, just not legally

@@ujjwal7502 He had originally planned to go to law school, but under pressure he memorised a math test and tried to sell it (ending up selling it to the Dean's daughter) He actually had a scholarship iirc, but lost it after the Dean told Harvard what he did

​@@khalilrahme5227 As far as I know he never got kicked out. He just couldn't afford law school without a scholarship. You would probably really lose your scholarship if you did sell tests. So I wouldn't say it's weak or far fetched maybe just the fact that it's only mentioned once and even there it feels like a side note. Which it technically is i guess.

You say that like the jury was on his side. They all knew he was guilty, the foreman only made them not say guilty because gibbs didn't prove beyond a reasonable doubt that he was guilty.

That's what everyone keeps forgetting, that he never attended Harvard, when in fact he did. He got kicked out because he sold a test to the Deans daughter. There was even a flashback showing that very incident. Even if you didn't finish college, there would be records of you attending.

Unfortunately, the math test fiasco happened aaaaaand the dean of said college notified Harvard, causing them to rescind his scholarship and the rest is history.

Every word he says is more than just the truth, so many people who are not gratuated from high school can help the others. They can teach you better, they can actually be your doctor or your lawer, they can help you get thorough so many problems! Mike is definetly not a fraud, everyone deserves the second chance and I'm just so happy that thouse 12 people ended up founding him innocent...

It's one thing to find out the hard way that your taxi driver doesn't have a license, but finding out that you lost in court because your lawyer isn't a lawyer is something else. Mike seems to be better than many real lawyers, and all is well as long as he wins, but if he doesn't...

The da was so terrible Mike confessed to being a froad and still she tried to argue by basically repeating her accusations and saying that he didn't do this and that. Her arguments were so weak. You can't win a jury by simply stating some facts, you need to sell a story and no matter how guilty he actually was, he sold his story.

See that's the thing, they can't show him coming out of this victorious. Its a very well written dilemma for the audience. You like Mike and want him to be found innocent, but deep down you also know that what he did is fraud and he deserves it. As Gibbs said, if they let the jury find him innocent, it would set a precedent for future frauds to be let off scot free as well.

​@@sinuslebastian6366 in fact it wouldn't set any precedent at all, since juries don't set precedents and all a not guilty verdict would have done is confirm the prosecution didn't prove its case beyond a reasonable doubt. and you may think he deserves punishment, but the show could very well have had him get away with it - making him oj would have been an interesting twist.

Mike has to be found guilty for the very reasons the prosecutor mentioned. If he is acquitted of this crime, that creates a precedent and can allow anyone in similar situations to claim the same, but with potentially disastrous outcomes. There is a reason certain professions require licenses. Now I believe we should change the licensing standards so that anyone can take the test, but the test is much more difficult and a better representation of real life.

@Kevin C representing yourself is not the same as claiming to be a lawyer and representing others that give you large amounts of money. Besides, it is almost always better to have an attorney representing you than to try and represent yourself. It is the difference between pulling out an aching tooth with a pair of pliers yourself and going to the dentist. One choice is obviously smarter than the other, even if sometimes the bad choice does work. With Mike, it would be like going to a man who never went to dentistry school but claimed to be a dentist. Imagine the damage he could do.

but it does not create a precedent. Jury's do not create precedent. Only appellate courts do. Jury's are finders of fact and decided if the facts of one specific case violated the law the judge instructs the jury to follow. If mike was found innocent, there is nothing that would stop a jury from finding someone else guilty of the same crime.

A bit late to the party, and somebody probably already said this. But, I don't know if it was intentional from the showrunners and scriptwriters, but Anita Gibbs listing down what a fraud could potentially pose as for the day (Lawyer, Doctor, Pilot) is very reminiscent of Leonardo DiCaprio's character in the film Catch Me If You Can (2003). If intentional, that's neat. If not, nice coincidence :)

I had the same thought... and in both cases, Mike Ross and Frank Abignale, they both studied and passed the bar. IMHO, who cares if you have that piece of paper that says you paid a lot to sit in a bunch of classes for X number of years? If you are able to pass the test that determines if you learned what you were supposed to during that time, you should qualify. If the test is easy enough that an average layman can just take it and pass it, then it is a worthless test to begin with.

What I never understood was why did the Mike go first and Gibbs go last? Normally, in a criminal case in most common-law jurisdictions, the prosecution goes first and the defence goes afterwards. Thought it was weird for them to switch the order.

for most of our nation's history you could practice law without a law degree. but we have moved towards licensing requirements as a means of quality control.

@@ktan8except practicing law isn’t a physical job like practicing medicine and plus in this case Mike is back by one of the biggest law firms in NYC so you know he’s the real deal. He’s not just some guy practicing out of his house. Law school is a waste of money if you already know everything so that’s why people should be able to skip ahead and prove their knowledge to the state bar for their law license. Had Mike just had that choice from the start, his lack of education wouldn’t be an issue because he already proved his worth to the state bar.

What i always found amazing is that as someone standing in front of a judge, you got the right to defend yourself without a lawyer. When you think about it Lawyer is a bizarre job to be in need of a qualification simply because laws in generel are supposed to be understood by society. Hence while a studied Top university Lawyer should rip apart any hogposh rando. Mike had shown he´s more than capable to play a Lawyers game and do it so well, he worked for one of the best law firms and no one even suspected him of being a fraudster for a long, long time.

That's why I dont understand the job itself or why Mike is wrong here. Ultimately being a lawyer is an overpriced certificate for understanding how society functions and the knowledge of its intricate parts are horded by elite people who can pay for that peice of paper. It dosnt really make sense.

Operating does require hand eye coordination is essential for being a surgeon and someone claiming( say fraudulently) to be a surgeon isn't necessarily saying that they are a diagnostician. It only because the education of doctors requires immense wide ranging knowledge that it would be difficult for you(possibly) but not for a character like mike.

Basically in a nutshell, people only go to college for an overpriced certificate despite the fact much of what they learn can be learned by themselves. Practicing law isn’t a physical job like practicing medicine, so yeah it’s pretty bs most states hold people back from becoming lawyers due to the requirement of law school.

I haven't watched all of this show, but if his claim that he passed the bar was in fact legitimate, it doesn't matter one bit if he went to Law School. Law is one of the only professions you can fully study on your own for. If you can pass the bar in your state, you can be a lawyer. It's really that simple. So, even if he hadn't passed the bar, he obviously could very easily and it would make the whole case of fraud illegitimate...unless the case is about him pretending to go to a certain school...

That's what I'm confused about too. Because in the beginning he claims he took the bar exam but during this they say he didn't pass the bar. Are there other aspects to getting a lawyer degree besides passing the exam? And why is it necessary to go to a college if you can prove you already have the qualifications to pass their exam? In my mind, it's a form of gatekeeping and locking the job behind the law school pay wall

@jangelaclough5457 as far as I know, haven't watched the show fully...Mike passed the Bar. Which means he's legitimately able to be a lawyer. The issue is they all lied and said he went to a specific school to prepare for said Bar exam. He did not ever go to any law school and is self taught. So, he's legally allowed to be a lawyer, but his claims of going to a certain uni are false which poses ALL SORTS OF PROBLEMS.

I'm honestly not sure at this point why Mike hasn't done a Kim K and "read for the law" the man has the knowledge and skill to be a lawyer. I'm in the Robert Barnes camp on this one. There should not be a licensing board to be a lawyer. If you can pass the bar and practice then what's the big deal about the Bar? I've won more than 10 cases Pro Se against debt collectors and landlords and actual lawyers for insurance companies. Why am I allowed to go it alone Pro Se but he gets punished for not having gone to law school and passing the Bar?

He passed the bar, which is the one thing that determines if he can practice law in a state - that surpasses the law school situation. He did prove that he had the knowledge/skill that the state mandates. He just didn’t have the official paperwork proving so legally. If the same could be said for your engineer, then yes I would take his advice. But still, surely you must agree that you can’t compare that engineer or doctor to someone like Mike

@@PrimoStracciatella He did, on a bet - he said it in the first episode, in his job interview with Harvey; someone bet him (a thousand dollars I think) that he couldn’t pass the bar it without going to law school. I’m guessing he didn’t do it in his own name though so he didn’t get the credit for it

Tbf, lawyers needing to go to law school is more of a superficial restriction they imposed on themselves to keep their profession exclusive. If it was about being capable and knowing enough about the law, passing the BAR should be enough, but instead they put up a paywall via tuition for law school.

My questions for Trevor are. In the time that Mike was living with you in New York did you see him reading law books? The answer is yes. Did you see him working on a case? yes Did he tell you that he was in Law School? yes but I though it was to impress a girl. Did Mike go away for hours at a time? Yes he said he was going to visit his grandmother. Is it possible that when he was away he didn't go to see his grandmother? Yes. Is it possible that he took a train to Boston for the day when he said he was visiting his grandmother? Yes or I don't know.

I loved this show and I always found it funny this scene made me realize that Mike Ross is very loosely based Frank Abagnale Jr. aka Leonardo DiCaprio’s character in Catch me if you can as he was a fake pilot and a fake doctor, but technically legally a lawyer as he’d passed the BAR though he didn’t really follow through on being one. Anyway, love the vid.

The sense I got from Gibbs is her closing started with facts but the problem is she used too many hypotheticals with setting a precedent. Also she came across as talking down to the jury in her closing.

If I recall correctly, they DID find him not guilty but Mike took a deal instead so he never actually heard what the Jury's decision would have been.

@@SergioHernandez-ut8lb As I recall, only one person on the jury found him INNOCENT, not guilty. And he described the situation to Harvey as a 12 angry men case where he eventually got all the jurors on board with declaring Mike innocent.

​@@blutz6966 the work product of doctors is less subject to vetting than that of lawyers, you have to trust doctors on faith more, whereas every tiny detail of a lawyer's performance is recorded. so it makes sense to make some distinction between the professions.
